Genera 1 c . ice-s~vey--bvr~r~-izrgs--inT-a-T~si~rtia~-distY-rct <br />may-be--izrcat-e~-n-vt-~e-ss--than-fives-f 5~-feed-f-rvnrt~re-src~e <br />~rrt--fig-anrrf-zv~-f -~~--fiat--~-tfi~-rearr-fa-r rrn~ A c c e s s o r y <br />buildings, other than garages in a residential district <br />may be located not less than five feet from an interior <br />side or rear lot line unless the accessory structure is <br />located in the rear twenty percent of the lot, in which <br />case they can be located not less than one foot from the <br />interior side or rear lot line (overhangs may not extend <br />into the one foot side or rear yard setback). <br />Garages in a residential district may be located not less <br />than five feet from an interior side or rear lot line unless <br />they are located in the rear twenty percent of the lot, <br />adjacent to an alley and oriented such that the vehicular <br />access door does not face the alley in which case they can <br />be located not less than one foot from an interior side <br />or rear ]ot line (overhangs may not extend into the one <br />foot side or rear yard setback). <br />Accessory buildings, including garages, on a corner lot <br />in a residential district, may be ]_ocated within the corner <br />• side yard subject to a conditional use permit. The issuance <br />of such permits shall comply with the provision in Section <br />~9-15.04 of this Code (conditional uses). Design and placement <br />of such structures must be consistent with the surrounding <br />residential district, and shall be evaluated based on the <br />following criteria: visibility, height, safety and potential <br />distraction to passing motorists. <br />Upon a vote being taken, the following voted in favor thereof: <br />Barry, Boche, Duncan, Finegan, and the following voted against <br />the same: Black, Daykin and Grittner. Motion approved. <br />Finegan moved, seconded by Boche, to request staff to review <br />the fee structure for conditional use requests and set an <br />economical fee structure for residential vs. commercial <br />conditional use requests.
