ICINNEY <br />The Planning Commission and Council have asked <br />my opinion concerning the application of Ordinance 64, <br />the zoning ordinance, to a request by a Mr. Sederberg, <br />1452 West Idaho Avenue, to erect a forty-foot tower and <br />to install an antenna on the tower for the purpose of <br />receiving and transmitting amateur radio communications <br />under regulations of the Federal. Communications Commission. <br />Mr. Sederberg°s property is located in an area <br />that is zoned "R-l". Section 6.2(5) provides that acces- <br />sory structures other than private garages are permitted <br />uses within an R-1 district but a conditional use permit <br />must be issued for such a conditional use. Under the <br />definition of "structures", I would construe a television <br />or radio tower as being an accessory structure. Thus,. the <br />Council must look at the facts of each application and deter- <br />mine whether a conditional use permit shall be issued. <br />Another section of the R-1 regulations is also <br />pertinent here. Section 6.4(1) provides that no building <br />or structure shall exceed two stories or twenty-five feet <br />in height, whichever is less, except as provided in Section <br />15 of the ordinance. Section 15 increases the height limi- <br />tations by fifty percent for certain types of structures <br />such as water towers, flag poles, smokestacks, church <br />• <br />
