This application <br />involved the construction of an attached garage on the north side of his lot which would <br />be built up to three feet of his north lot line, The Planning Commission considered the <br />application incomplete and did not consider it because no permission from the neighbor <br />to the north was submitted. <br />Since that time, hir. Helms has indicated a desire to change his plans and now <br />wishes consideration for a detached garage to be built four feet to the rear of his <br />residence and he requests a variance to allow him to build this detached garage within <br />1~ feet of the same north property line. T <br />This was discussed at the council on September 1l~, 19156 and we have no alternative <br />other than to make a re-referral to the Planning Commission and I world ~~taisly <br />appreciate this being considered in the near future. <br />Initially, it appears that Mr. Helms is asking us more than he asked for at the time <br />of his first submission for variance. Perhaps this i~o~rltirely true as there do appear <br />to be some points in his favor. There some things which are perhaps worthy of some con- <br />sideration and can probably be discussed in detail at the ~,ime we can arrange a meetings <br />1. the ~definitions~ section of the ordinance is really not entirely clear as to <br />whether or not it applies to a detached garage built to the rear of the house. <br />2e ~[r. Helms was allowed to build a cement driveway to a distance of several <br />inches from the north lot line and this was appa~oxisnately two years ago, <br />3. Yr. Helms, although not refused permission from his nett door neighbor, <br />apparently has some real problesm in getting affirmation asltd these problems are <br />somewhat unique. <br />!te Thia party does haw a 65 foot lot which pre exists the ordinance requiresents of <br />75 feet. <br />Hs feels rather strongly that he ahonld have apse lavc~rahle ooasidsratian in view of <br />the above factors.
