SULLIVAN <br />Enclosed is a copy of the notice of public hearing <br />that was forwarded to the NORTH SUBURBAN NEWS for publication <br />on June 23, 1865. <br />It will be necessary to make mailed notice of the <br />public hearing to all people located within 300 feet of <br />the subject property. This office will make arrangements <br />for mailed notice. <br />From a review of the Falcon Heights Zoning Ordinances, <br />it appears that the subject property was zoned as an <br />industrial district in October, lg4g when Ordinance No. 8, <br />the first zoning ordinance, was adopted. Under the pro- <br />visions of that ordinance, the property could be used for <br />industrial purposes. <br />The present ordinance was adopted and published January <br />11, 1862. Under the provisions of Section ~+.3 any use of <br />property or buildings is allowed to continue as a non-conforming <br />use. Under the provisions of Subsection 6 therein it provides <br />that when a lawful non-conforming use of a structure or land <br />is discontinued for a period of six months or more, any future <br />use of the building or lands shall be in conformity with the <br />ordinance. <br />It would appear that the subject property was in non- <br />conforming use at the time of the adoption of our present <br />zoning ordinance. If no abandonment of its usage has occurred, <br />the owner can presently use the property for any purpose con- <br />sistent with its non-conforming use provided that the new use <br />
