Plant <br />Falcon Heights <br />Commission <br />Street <br />~Iinnes ota <br />Re: Arthur Lindig Application <br />for Rezoning <br />Our File No. E152g.461 <br />Dear Mr. Plant: <br />Enclosed for inclusion in the Minutes of <br />the Planning Commission's Meeting of September 30, <br />1964 is the form of Resolution to be signed by the <br />Chairman and Secretary, and forwarded to the Clerk <br />of the Village of Falcon Heights . <br />I noted with interest the questions relating <br />to mutual driveways and side lot setbacks adjacent <br />to detached garages. <br />This matter has been discussed on one or two <br />occasions with the Council. Ordinance 64, section <br />6.4 requires a side yard setback of five feet on <br />interior lots. Section 6.3 authorized as a per- <br />mitted accessory use detached private ga~ ges. <br />Section 4.5 defines accessory buildings ame'n'd provides <br />that no such accessory building shall be located <br />nearer the front lot line than the principal building <br />located on that lot. Section 4.6 deals with required <br />yards and open spaces. Reading the separate provisions <br />of the ordinance together, it appears that the most <br />reasonable interpretation is to repeal by implication <br />that provision of ordinance number 3, section 5-12, <br />requiring only a two foot setback for detached pri- <br />vate garages, Ordinance number 3 was adopted in 1949, <br />
