0 <br />ARTICLE VI <br />PLANS AND DATA FOR PRE-SURVEY PLANS AND DATA <br />6.1 While it is understood that generally a proposed subdivision <br />of an existing lot, or conveyance by metes and bounds description <br />will not be a development of the scope contemplated by the presenta- <br />tion and acceptance of a plat, the Council hereby declares that it <br />is in the best interests of community planning and development to <br />require the same or similar plans and data for such a subdivision; <br />as it does for the presentation and acceptance of a plat. The <br />Council shall require compliance with this ordinance which is <br />hereby made applicable to all conveyances when the parcel of land <br />conveyed is less than two and one-half (22) acres in area and <br />one hundred fifty (150) feet in width, unless such parcel is a <br />separate parcel of record at the time of the adoption of <br />M.S.A. §71.29, and all related statutes thereto. <br />6.2 All provisions of Article V are adopted herein by reference. <br />ARTICLE VIZ <br />VARIANCES <br />7.1 Hardship. Where the Council finds that extraordinary hard- <br />ships may result from strict complaince with these regulations, it <br />may vary the regulations so that substantial justice may be done <br />and the public interest secured; provided that such variation <br />will not have the effect of nullifying the intent and`Jpurpose of <br />the General Community Plan or these regulations. <br />. -17- <br />
