No. 0 -92 -6 <br /> CITY OF FALCON HEIGHTS <br /> O R D I N A N C E <br /> Date 11/25/92 <br /> AN ORDINANCE AMENDING CHAPTER 5, PART 7 OF THE <br /> CITY CODE RELATING TO <br /> ITINERANT PEDDLERS AND SOLICITORS <br /> 5 -7.01 Regulation of Itinerant Salespersons and Solicitors <br /> A. Definition. The term "itinerant" salesperson means <br /> any person who sells or attempts to sell any goods where <br /> the solicitation or sale does noty occur within a <br /> building, store or structure owned or leased by <br /> a business and properly zoned for commercial use. The <br /> term shall not include persons delivering goods sold <br /> upon commercial premises prior to the delivery, or <br /> persons distributing their products to regular customers <br /> on established routes, such as vendors of milk, <br /> groceries or newspapers. <br /> B. License Required. Every itinerant salesperson must <br /> apply to the city clerk for a license. Upon approval <br /> by council and issuance of the license, license must be <br /> carried by the salesperson or be in his /her vehicle at <br /> all times. If a business employs more than one <br /> itinerant salesperson, a separate license is required <br /> for each salesperson. The license fee is as stipulated <br /> in Section 5 -5.01 of this code and will not be prorated. <br /> C. Hours of Operation. It shall be unlawful for any <br /> peddler to engage in the business of peddling within the <br /> city between the hours of 7:00 P.M. and 9:00 A.M. the <br /> following morning, or at any time on Sundays, except by <br /> specific appointment with or invitation from the <br /> prospective customer. <br /> D. Entrance to Premises Restricted. It shall be <br /> unlawful for any peddler to enter upon any private <br /> premises when such premises are posted with a sign <br /> stating "No Peddlers Allowed" or "No Solicitation <br /> Allowed" or other words to such effect. <br /> E. Exemptions. Itinerant salespersons acting on behalf <br /> of any religious association or any non profit <br /> corporation registered with the state of Minnesota shall <br /> not be subject to this section provided the proceeds of <br /> any sales are being used for such charitable, religious <br />
