Meeting Date: 2/10/93 <br /> Agenda Item: C -4 <br /> CITY OF FALCON HEIGHTS <br /> REQUEST FOR COUNCIL CONSIDERATION <br /> ITEM DESCRIPTION: Request for reimbursement of costs from Mr. <br /> and Mrs. King, 1427 West Idaho <br /> SUBMITTED BY: Mr. and Mrs. King <br /> REVIEWED BY: Susan Hoyt, City Administrator <br /> Peter Bachman, City Attorney <br /> EXPLANATION /SUMMARY: <br /> Mr. and Mrs. King submitted a request for reimbursement of costs <br /> for typing and copying materials for distribution related to the <br /> request for a variance for the garage at 1433 West Idaho. <br /> The request states that it is being made because the city made an <br /> error in issuing the permit without a variance. The amount is: <br /> A. Typing and printing materials for neighbors 55.10 <br /> B. Typing and printing materials for planning 12.00 <br /> commissioners <br /> C. Typing and printing materials for council 12.00 <br /> TOTAL 79.10 <br /> The city has not reimbursed costs that residents, property owners <br /> or other parties incur for distributing materials to residents, <br /> the planning commission and /or city council. Although the city <br /> will reproduce any material for the commission and council as <br /> requested by an interested party at no charge. In this case, if <br /> the property owner at 1433 West Idaho had requested a variance <br /> without a building permit, the Kings might still have incurred <br /> these costs in order to object to the variance prior to approval <br /> and construction. The city also does not reimburse for late fees <br /> on sewer bills or assessments that residents state they never <br /> received in the mail. <br /> In this case, the city is not responsible for costs that the <br /> property owners independently assumed (typing, copying, <br /> appraiser's opinions, legal fees) because it took prompt action <br /> in requiring the property owner of 1433 West Idaho to stop work <br /> and apply for the necessary variances. Any reimbursement from <br /> the city would be a shift in precedent for reimbursing such <br /> claims and may be interpreted as being responsible for costs <br /> independently initiated by these property owners. Any <br /> reimbursement should state that the city is not liable for these <br /> costs. <br /> ATTACHMENTS: <br /> A Reimbursement request from the Kings, 1427 West Idaho <br /> ACTION REQUESTED: <br /> Deny request for reimbursement of typing and copying costs. <br />
