INTRODUCTION <br /> Mr. Tom Brace and Mrs. Gunta Brace, the property owners of 1433 <br /> West Idaho, are applying for all necessary variances for a nearly <br /> completed 988 square foot garage. The circumstances surrounding <br /> this request are unique because a building permit was issued for <br /> the garage construction, and the construction proceeded until the <br /> city determined that the building did not conform to the zoning <br /> code. This report outlines 1) the factual background leading to <br /> this request, 2) the property owners' reasons for the request, 3) <br /> additional information relevant to the request, 4) alternative <br /> actions to consider as requested and 5) legal requirements and <br /> findings. <br /> II. BACKGROUND <br /> A. Building permit <br /> On September 28, 1992 the building official approved a <br /> building permit to the property owner, Mr. Tom Brace, for <br /> the construction of a 988 square foot garage, two feet from <br /> the west property line and one foot from the rear lot line, <br /> to be constructed in the configuration in attachment A.
