The garage is also visible from 1427 West Idaho. It is 22 <br /> feet from the east property line. <br /> The visual impact on the properties to the north of 1433 <br /> West Idaho (along the alley) is diminished due to distance <br /> and the location of their own garages along the alley. <br /> C. Notification and response from neighboring property <br /> owners <br /> The city notified five property owners regarding the request <br /> for a variance. These were the two adjacent property owners <br /> and three property owners on the northside of the alley. <br /> The property owners at 1427 West Idaho, Mr. and Mrs. King, <br /> originally questioned the size of the garage prior to the <br /> stop work order. Mrs. King has verbally expressed her <br /> frustration with the structure to the staff on at least <br /> three occasions. The Kings provided a written statement <br /> with their concerns to the planning commission on 11/23/92 <br /> and again on 1/16/93 (Attachment E). Mrs. King considers <br /> the current garage to detract from her property value. On <br /> January 19, 1993 she provided planning commissioners with an <br /> appraiser's opinion from Appraisal Research Associates, Ltd. <br /> that states the King property has suffered a loss of at <br /> least 5 percent of its value (Attachment F). <br /> The adjacent property owners at 1437 West Idaho, Mr. and <br /> Mrs. Callahan, did not contact the city about the size of <br /> the garage. (Mr. Callahan had the building inspector make <br /> sure that a property stake was not covered during <br /> construction.) When the administrator talked to him about <br /> the non conforming garage on November 18, 1992 he said that <br /> he had no problem with his neighbor. He did not express any <br /> further opinion at that time. <br /> As part of Mr. Brace's application for a variance, Mr. Brace <br /> submitted a petition that he personally circulated among his <br /> neighbors. The petition states that those signing it "are <br /> aware that the detached garage is oversized and the <br /> undersigned accept the present configuration of the garage" <br /> (Attachment G). The petition lists signatures from owners <br /> of seven properties along the alley (Attachment D). The <br /> signatures of Mr. and Mrs. Callahan at 1437 West Idaho <br /> appear on the petition. Mr. and Mrs. King at 1427 West <br /> Idaho did not sign the petition. <br /> As of this writing, no property owners notified of the <br /> planning commission meeting on January 25, 1993 contacted <br /> city staff with the exception of Mrs. King who requested <br /> planning commissioners' addresses. <br /> 5 <br />
