DRAFT RESOLUTION GRANTING VARIANCE <br /> FOR UNIVERSITY GROVE SUBDIVISION NUMBER 2 <br /> On February 22, 1993 the Falcon Heights planning commission <br /> recommended the following variances for University Grove <br /> Subdivision Number 2, consisting of 2151, 2161, 2173, 2148, 2154, <br /> 2160 2170 Folwell Avenue and 2141, 2147 2153 Hoyt Avenue, for <br /> approval by the city council: <br /> Minor collector street right of way. Chapter 9, Section <br /> 17.04, Subdivision 2. <br /> A variance of 10 feet for Folwell Avenue to permit a 50 foot <br /> right of way. <br /> Drainage utility easements. Chapter 9, Section 17.04, <br /> Subdivision 4. <br /> A variance to allow no drainage or utility easements along <br /> the platted lots of this subdivision. <br /> The planning commission adopted the following findings for <br /> granting the variances for University Grove Subdivision Number 2: <br /> a. That the variance will not be detrimental to the public <br /> welfare; <br /> b. That the granting of the variance will not <br /> substantially diminish or impair property values or <br /> improvements in the area; <br /> c. That the granting of the variance is necessary for the <br /> preservation and enjoyment of substantial property <br /> rights by re- establishing previous property lines and <br /> right of ways; <br /> d. That the variance will not impair an adequate supply of <br /> light and air to adjacent property; <br /> e. That the variance will not impair the orderly use of <br /> the public streets; <br /> f. That the variance will not increase the danger of fire <br /> or endanger the public safety; <br /> g. That the legal boundary history of the tract is such <br /> that strict adherence to the letter of the Chapter <br /> would result in undue hardship to the owner. <br />
