Johnson <br /> REVIEWED BY: Susan Hoyt, City Administrator <br /> Peter Bachman, City Attorney <br /> EXPLANATION /SUMMARY: <br /> Mr. Mutschler has applied for a business license. He has been <br /> informed of the moratorium on all new business licenses except <br /> for those specifically listed as permitted uses in the commercial <br /> zoning code, in this case B 2. <br /> Mr. Mutschler states that this business is eligible as a <br /> permitted use in the code. After discussions with Mr. Mutschler <br /> about the nature of the proposed business activity, staff <br /> recommends that the license be denied at this time under the <br /> terms of the moratorium for the following reasons: <br /> 1. Mr. Mutschler stated that the business is in general retail <br /> sales of miscellaneous new and used goods purchased from <br /> vendors, trade shows, close -outs and walk -in customers. The <br /> majority of the goods will be used. This makes the business <br /> a secondhand goods dealer. Secondhand goods dealers are not <br /> permitted uses in the B 2 zone. <br /> 2. The planning study will be addressing secondhand stores <br /> and approving a license for this use now would run counter <br /> to the purpose of the study and the intent of the <br /> moratorium. <br /> ATTACHMENTS: <br /> A Statement from Mr. Mutschler <br /> B Moratorium <br /> C B -2 permitted and conditional uses <br /> ACTION REQUESTED: <br /> Deny the business license application. <br />
