d The council may grant a hardship waiver only if i t <br /> J <br /> finds that: <br /> 1) the applicant has demonstrated a hardship by <br /> showing that the property cannot be put to a <br /> reasonable use without the waiver; <br /> 2) the waiver will not affect the integrity of <br /> the planning process and the purpose for <br /> which the ordinance was enacted; <br /> 3) the application is consistent with the <br /> current status of the planning study; <br /> 4) the application is for a use that is a listed <br /> permitted or conditional use in the <br /> applicable zoning district. <br /> e. The council may deny the waiver if it does not <br /> meet the criteria in this section or if it <br /> determines that its approval will negatively <br /> impact the planning study or the future land use <br /> and development in the city. <br /> Subd. 6 Term.
