Page 2 <br /> 3. That based upon all the evidence in the record, it is clear <br /> that a portion of the proposed business of the applicant <br /> regularly involves the purchase and sale of used goods on <br /> the premises. <br /> 4. That the city administrator is charged under city code <br /> Section 9- 15.01, Subd. 3, with interpreting the zoning code and <br /> has found that the applicant's use is a secondhand goods <br /> store and is not a use which is specifically listed as a <br /> permitted use in the B -2 zoning district. <br /> 5. That the city administrator's interpretation of the code is <br /> reasonable and in accordance with the city council's intent. <br /> In addition, the city administrator's interpretation is in <br /> accord with the city's purpose in adopting the moratorium, i.e., to <br /> protect and preserve the status quo during the pendency of the <br /> planning study. <br /> 6. That the applicant's proposed business is a secondhand goods <br /> store within the meaning of Minn. Stat. §471.925 and is not a <br /> permitted use in the B -2 zoning district. <br /> 7. That the operation of the proposed business does not comply <br /> with the city's zoning code as required by Section 5 -1.02 for the <br /> issuance of a business license. <br /> 8. That secondhand goods stores are one of the uses specifically <br /> being studied in the city's planning study to determine <br /> whether and under what conditions, if any, secondhand goods <br /> stores may be permitted in the city. <br /> 9. That the city's zoning study is proceeding promptly and the <br /> moratorium will be lifted as soon as possible. <br /> 10. That secondhand goods stores possibly have different impacts on <br /> the city and surrounding neighborhood than the uses which are <br /> specifically listed as permitted uses in the B -2 zoning district, <br /> including such impacts as increased need and costs for additional <br /> police services because of the increased possibility of customers <br /> bringing stolen merchandise to the store and other issues which <br /> are being studied in the ongoing planning study. <br />
