LARPENTEUR AVENUE FALCON HEIGHTS, MN 55113 -5594 PHONE (612) 644 -5050 FAX (612) 644 -8675 <br /> 11 May 1993 <br /> MEMO <br /> TO: Mayor and Councilmembers <br /> FROM: Susan Hoyt, City Administrak. <br /> RE: Staff recommendation that the p a ping commission review the <br /> city's commercial development moratorium for additional uses <br /> specified for study (See addendum P 5) <br /> At the city council meeting on May 12, 1993 the council will be <br /> considering a request from the administrator to spend additional <br /> legal and planning fees for the commercial zoning study. <br /> After reviewing the development moratorium, staff is confident <br /> that most uses that require further study are covered within the <br /> moratorium. However, to guarantee that all these uses are <br /> included during the commercial zoning study, staff recommends <br /> that the council refer the development moratorium to the planning <br /> commission to review like any revision in the zoning code. This <br /> will provide an opportunity to determine what, if any uses, <br /> require further specification in the moratorium to guarantee its <br /> intent. <br /> Possible amendments to the moratorium might include <br /> language that identifies "adult uses "stores selling guns <br /> "pawn shops" and "used goods sellers" as uses that require study <br /> so the city can adopt the appropriate ordinances (licensing, <br /> conditions, and /or zoning regulations) to govern these uses. <br /> Currently, the city's ordinances do not provide any licensing or <br /> conditions on adult uses or stores with gun sales. If one of <br /> these establishments opened by qualifying as a "specifically <br /> permitted use the city would lose the opportunity to regulate <br /> its location, and would scramble to enact licensing requirements. <br /> Other cities, like Ramsey put a moratorium on adult uses, and <br /> Richfield adopted an ordinance specifically halting the sale of <br /> "used goods" until the cities could determine under what <br /> conditions these uses should be permitted and /or regulated. <br /> Any amendment to the moratorium is procedural to clarify and <br /> guarantee the intent of the study.
