NDUM A .:i `U. <br /> Meeting Date: 5/12/93 <br /> Agenda Item: P 5 <br /> CITY OF FALCON HEIGHTS <br /> REQUEST FOR COUNCIL CONSIDERATION <br /> ITEM DESCRIPTION: Referral of the development moratorium <br /> (Chapter 5, Section 5) to the planning <br /> commission for review and possible amendments <br /> SUBMITTED BY: Susan Hoyt, City Administrator <br /> REVIEWED BY: Peter Bachman, City Attorney (discussed) <br /> EXPLANATION /SUMMARY: <br /> Most uses that may have secondary impacts that the city is <br /> studying for inclusion and /or regulations through its ordinances <br /> fall within the current development moratorium on the commercial <br /> district. However, it would be useful to have the planning <br /> commission review the city's development moratorium to guarantee <br /> that any uses that the city may wish to study for secondary <br /> impacts and /or further regulation through local ordinances are <br /> included in the development moratorium. (For example the City of <br /> Ramsey put a moratorium on "adult uses" until the location and <br /> licensing requirements were determined. There may be some <br /> licensing requirements conditions that the city may legally <br /> attach to a store selling guns.) <br /> This planning commission review will include any uses identified <br /> by the consultant and staff for secondary impacts and further <br /> regulations. It will not delay either aspect of the commercial <br /> zoning study. The review will be handled like an amendment to <br /> the zoning code that requires a notice in the legal paper. This <br /> could be combined with the next planning commission meeting that <br /> addresses the revised commercial zoning codes currently being <br /> done by Fred Hoisington (special early June meeting <br /> Planning commission members endorsed the idea of the additional <br /> legal and planning fees for the commercial study as well as the <br /> two -tier approach to the study. <br /> ACTION REQUESTED: <br /> Refer the commercial development moratorium (Chapter 5 Section 5) <br /> to the planning commission for review and for its recommendation <br /> on any amendments to further clarify what uses it covers. <br />
