Ms. Susan Hoyt <br /> July 2, 1993 <br /> Page 2 <br /> There are quite a few other provisions in the Agreement which <br /> obligate the City to incorporate language in sub contracts or to <br /> administer the contract in a particular manner. The key point is <br /> that whoever administers this contract on behalf of the city must <br /> read the contract in detail and should follow all of the procedures <br /> and requirements set forth in the contract. Some of those <br /> requirements are as follows: <br /> Part I, paragraph 12B: Requires the city to incorporate <br /> specified language regarding potential conflicts of <br /> interest in every subcontract. <br /> Part II, paragraph 1: Requires the city to comply with <br /> certain administrative requirements and with specific <br /> federal regulations and federal OMB circulars. <br /> Part II, paragraph 2: Requires compliance with certain <br /> federal procedures relating to bonding, insurance and <br /> procurement standards on projects over $10,000. <br /> Part II, paragraph 2(B): Requires "Anti- Kickback" <br /> language in all contracts and subgrants for construction. <br /> Part II, paragraph 4D(3): Requires the city to provide <br /> training and employment opportunities for lower income <br /> residents in accordance with the Ramsey County Section <br /> 3 plan. It also requires that the section 3 clause, <br /> attached to the Agreement, be incorporated in all <br /> contracts between the city and contractors and <br /> subcontractors. <br /> Part II,. paragraph 4(F): Requires the city to include <br /> certain non- discrimination provisions in all contracts <br /> or purchase orders and requires notice to labor unions <br /> of such provisions. <br /> Part II, paragraph 5: Requires that all project <br /> contractors pay wage rates in accordance with the Davis- <br /> Bacon Act. This requirement does not apply to <br /> rehabilitation of residential property designed for <br /> residential use by fewer than eight families. <br /> Part II, paragraph 20: By signing the Agreement, Falcon <br /> Heights is certifying that it has adopted and is <br /> enforcing a policy prohibiting use of excessive force by <br /> law enforcement agencies within its jurisdiction. <br />
