No. 0 -94 -06 <br /> CITY OF FALCON HEIGHTS <br /> O R D I N A N C E <br /> Date: 3 -23 -94 <br /> AN ORDINANCE AMENDING CHAPTER 5, SECTION 1.03 OF THE CITY CODE <br /> RELATING TO REGULATION OF SPECIFIC BUSINESSES AND PRODUCTS <br /> BY ADDING REGULATING AND LICENSING OF THERAPEUTIC MASSAGE <br /> ENTERPRISES AND PRECIOUS METAL DEALERS <br /> THE CITY COUNCIL OF THE CITY OF FALCON HEIGHTS HEREBY ORDAINS AS <br /> FOLLOWS: <br /> Section 5 -1.03 of the city code is hereby amended to add the <br /> regulation and licensing of the following businesses: <br /> 1. Section 5 -1.03. Regulation of Specific Businesses and <br /> Products <br /> E. Therapeutic Massage Enterprises. <br /> 1. Purpose. The purpose of this Division of the City <br /> Code is to prohibit massage businesses and services to <br /> the public except those licensed as therapeutic massage <br /> enterprises pursuant to this section. The licensing <br /> regulations prescribed herein are necessary in order to <br /> prevent criminal activity and to protect the health and <br /> welfare of the community. The purpose of this Section <br /> is not to impose restrictions or limitations on the <br /> freedom of protected speech or expression. <br /> 2. Findings of the City Council. The city council of <br /> the City of Falcon Heights makes the following findings <br /> regarding the need to license therapeutic massage <br /> enterprises and therapists and to prohibit all other <br /> types of massage businesses and services to the public: <br /> a. Persons who have bonafide and standardized <br /> training in therapeutic massage, health, and <br /> hygiene can provide a legitimate and necessary <br /> service to the general public. <br /> b. Health and sanitation regulations governing <br /> therapeutic massage enterprises and therapists can <br /> minimize the risk of the spread of communicable <br /> diseases and can promote overall health and <br /> sanitation. <br /> 1 <br />
