No. 0 -94 -08 <br /> CITY OF FALCON HEIGHTS <br /> O R D I N A N C E <br /> Date 3 -23 -94 <br /> AN ORDINANCE AMENDING SECTIONS 5 -5.01, 5 -5.02 AND 5 -5.04 OF THE <br /> CITY CODE RELATING TO AN INTERIM DEVELOPMENT <br /> MORATORIUM ON COMMERCIAL ZONING DISTRICTS <br /> THE CITY COUNCIL OF THE CITY OF FALCON HEIGHTS HEREBY ORDAINS AS <br /> FOLLOWS: <br /> 1. Section 5 -5.01 (B) is amended to read as follows: <br /> B. Findings and Purpose. In 1991 the city council adopted <br /> a comprehensive plan for the city. The Metropolitan Council <br /> approved that plan in April, 1992. A recommendation in the <br /> city's comprehensive plan included studying andrevising the <br /> city's commercial districts to conform to theplan and <br /> address future needs. In October, 1992, the citycouncil <br /> contracted with the Hoisington Group, Inc. to carryout a <br /> planning study on all the city's commercial zones, to <br /> evaluate and recommend changes in the commercial zoning <br /> designations, to work with the property owners to determine <br /> future needs and to make recommendations to the planning <br /> commission and city council for revising the commercial <br /> zoning code provisions. The Hoisington Group, Inc. and the <br /> city completed a study of the city's commercial zones. <br /> After the completion of the planning study, the city adopted <br /> related planning studies, zoning and licensing provisions as <br /> necessary to address these uses with the exception of stores <br /> selling firearms or ammunition. Staff is continuing to do a <br /> planning study on stores that sell firearms or ammunition <br /> and their relationship to the city's commercial and <br /> residential districts. <br /> The city council has concluded that the granting of any <br /> permits or development approval, as specifically set forth <br /> in Subd. 3, could destroy or impair the integrity of the <br /> planning process and that a development moratorium is <br /> necessary to preserve the status quo pending completion of <br /> the planning study on stores that sell firearms and <br /> ammunition. <br /> It is the intention of the city council to protect the <br /> described planning process and the health, safety and <br /> welfare of its citizens by adopting an interim ordinance for <br /> a reasonable period of time during the time period of the <br /> study, planning and implementation activities. <br />
