No <br /> person shall sell a tobacco related product to any <br /> person under eighteen years of age. Any person <br /> convicted of violating this section shall pay a fine <br /> of $25 for the first violation payable to the court. <br /> Any person convicted of violating this section twice <br /> within a 12 month period shall pay a fine not to <br /> exceed $100 payable to the court. Any person <br /> convicted of violating this section more than twice <br /> within a 12 month period shall be guilty of a <br /> misdemeanor.]]]] <br /> 6. Administrative Fine, Suspension, or Revocation. <br /> Any violation of the restrictions attached to a <br /> tobacco product license shall be cause for a <br /> suspension or revocation of such license pursuant to <br /> the provisions of Section 5 -1.02B of the Falcon <br /> Heights Municipal Code. The first violation shall <br /> result in a fine of $200 to the license holder payable <br /> to the city. Failure to pay within thirty days from <br /> the date of the invoice shall result in a two day <br /> license suspension. A second violation within 12 <br /> months shall result in a fine of $500 payable to the <br /> city and result in a 5 day license suspension. <br /> Failure to pay the fine within 30 days from the date <br /> of the invoice shall result in a 10 day license <br /> suspension. A third violation within 12 months shall <br /> result in a license revocation. Licensees whose <br /> licenses have been revoked °hall ma not be eligible <br /> for another tobacco product license for one year <br /> from the date of license revocation. The city council <br /> may attach reasonable conditions to the reinstatement <br /> of a suspended or revoked license including the <br /> condition that the licensee and /or the licensee's <br /> employees complete, at licensee's expense, a training <br /> program, approved by the city administrator, which <br /> includes instruction on appropriate procedures for <br /> determining the age of customers and the effects of <br /> tobacco usage.]]]] <br />
