Meeting Date: 12/21/94 <br /> Agenda Item: P 5 <br /> CITY OF FALCON HEIGHTS <br /> REQUEST FOR COUNCIL CONSIDERATION <br /> ITEM DESCRIPTION: Consideration of an amendment to the term of <br /> the commercial development moratorium, Chapter <br /> 5, Section 5.04 <br /> SUBMITTED BY: Susan Hoyt, City Administrator <br /> REVIEWED BY: Planning Commission <br /> Peter Bachman, City Attorney <br /> EXPLANATION /SUMMARY: In March, 1993, the city council adopted an <br /> interim development moratorium on commercial uses that the <br /> council considered to have possible detrimental secondary impacts <br /> on the city's business district and surrounding residential <br /> neighborhoods. In March, 1994 the city council adopted a series <br /> of ordinances governing several of these uses and removed these <br /> commercial uses from the interim moratorium. One use, stores <br /> that sell firearms, remains under the interim development <br /> moratorium which expires on December 31, 1994. <br /> Over the past months staff has collected information related to <br /> statutes and city ordinances controlling the location of this <br /> use. Staff is continuing to gather information from other cities <br /> including zoning regulations and definitions of such stores. <br /> At this time, the planning commission and staff recommend that <br /> the city council amend the ordinance to extend the interim <br /> commercial development moratorium from December 31, 1994 to March <br /> 31, 1995. This extension should provide ample time for the staff <br /> to complete its research and for the planning commission and city <br /> council to complete the process to review and adopt the <br /> appropriate ordinances. <br /> ATTACHMENTS: <br /> A. Proposed amendment to Chapter 5, Section 5.04 <br /> ACTION REQUESTED: Amend ordinance to extend the interim <br /> commercial development moratorium until March 31, 1995. <br />
