REGULAR CITY COUNCIL MEETING
MINUTES OF APRIL 14, 1999
The meeting was called to order at 7:00 P.M. by acting mayor Sam Jacobs.
Present: Jacobs, Gibson Talbot, Hustad, Kuettel, Hoyt
Absent: Gehrz
COMMUNITY FORUM
Members of a local boy scout troop were introduced during the Community Forum. Steve St.
George, the troopmaster, Jake St. George, Ryan Lill and Adam Pribyl attended the meeting to
work on their "citizen in the community" badge.
The minutes of the March 24, 1999 meeting were approved.
Councilmember Hustad requested that a legislative update be added to the policy agenda. The
council agreed to this addendum to the agenda.

Councilmember Kuettel moved approval of the consent agenda. The motion passed unanimously.

4. Consideration of a drug free workplace policy in conjunction with receipt of MCAD

POLICY AGENDA
Consideration of the pending assessment for the Falcon Heights United Church of Christ
properties at 1795 Holton Avenue.
Administrator Hoyt explained that officials from the Falcon Heights United Church of Christ
were requesting that the pending assessment for the street reconstruction work on their property
be extended over a fifteen year period. This request was instead of the planned ten year
assessment period because the assessment amount of $38,013.68 taxes the church's general
operating budget. Church officials also requested that the payments be in equal installments as
much as possible. The proposed fifteen year repayment period would charge the same interest
over time as other property owners. The city would not be out any money. Councilmember
Hustad moved approval of a fifteen year repayment period for the pending street assessment to
• the Falcon Heights United Church of Christ. The motion passed unanimously.

Re uest to participate in the Como/St. Anthony Park Fall Clean-up Dak
Acting Mayor Jacobs explained that Falcon Heights had the opportunity to participate in the
annual Como/St. Anthony Park fall clean up day that is held on the Minnesota State Fairgrounds.
Administrator Hoyt said that the activity provided residents with the opportunity to get rid of stuff
they've been accumulating. Over fifty per cern of the items were recycled as part of the clean up
day. Users of the service were charged entry to the site and some items were charged for
recycling. In addition, the city was being asked to contribute $1,500 for administrative charges.
St. Paul also used city revenue to pay for some of the costs of the service. Councilmember
Kuettel noted that the city had a clean up day several years ago, but found that it was very
expensive for the number of users. In addition, she said that the ability to collect and recycle
goods was not available at that time. Councilmember Gibson Talbot moved approval of the
$1,500 from the solid waste fund for participating in the annual fall clean up day.
Legislative update.
• Councilmember Hustad reported on two items at the legislature that he felt the city council
should respond to because both items dealt with loss of local control, specifically in land use
issues. The first was the vote by both the house and senate eliminating cities' right to amortize
non-conforming land uses over time as a way to eliminate them after their financial investment
was expended. The second was the vote by the house to pre-empt cities authority to determine
the locations of firearms dealers and shooting ranges in cities through zoning. Effectively,
eliminating the cities right to determine the appropriate places for these uses within their city
limits. After some discussion by all councilmembers, Councilmember Hustad moved to have the
city administrator draft a very strong letter for the. mayor's signature that would articulate the
council's concern over these two actions that threaten the city's ability to use its elected officials
to make decisions about land use. The motion passed unanimously.
The meeting was adjourned at 7:40 PM.
