Also present were Hoyt, Chenoweth and Maurer. ADDENDA TO CONSENT AGENDA Council approved the addition of the following items to the Consent Agenda: F-6, Consider Applying for DNR Tree Planting Grant, and F-7, Drainage Improvement at Pascal and Iowa. MINUTES OF 5/22/91 APPROVED Council approved the Minutes of Nlay 22, 1991 by unanimous consent. ASSESSMENT HEARING ON HAMLINE AVENUE IMPROVEMENTS (LARPENTEUR TO COUNTY ROAD B2) Baldwin opened the Fublic Hearing at 7:05 P.M. and explained that parking on the west side of Hamline may be allowed upon completion of the project, and that direct assessments to the property owners have been reduced due to an amendment to the assessment policy. Maurer explained the amended assessment rates and commented on one error in the amount assessed Knott Enterprises for their corner lot. He also indicated that the proposed change in MSA regulations might allow for striping 3 traffic lanes and one parking lane. Baldwin then asked for comments from those in attendance and since no one wished to be heard, the Public Hearing was closed at 7:13 P.M. Wallin moved adoption of Resolution R-91-35 with the amendment of the assessment to Knott Enterprises. Motion carried unanimously. RESOLUTION R-91-35 A RESOLUTION ADOPTING THE ASSESSMENT FOR THE HAMLINE AVENUE IMPROVEMENT PROJECT CONSENT AGENDA APPROVED Council approved the following Consent Agenda by unanimous consent: 1. Disbursements: a. General Disbursements through 5/21/91, $21,808.80 b. General Disbursements through 5/3/91, $27,743.16 c. General Disbursements through 6/10/91, $20,694.35 d. Payroll 5/16/91 - 5/31/91, $9,723.77 e. Payroll 6/1/91 - 6/15/91, $10,944.36 2. Temporary Part-time Summer Recreation Program Appointments MINUTES JUNE 19, 1991 WAGE 2 3. Engineer's Request to Perform Traffic Counts on Municipal State Aid Streets 4. Request for Partial Payment Estimate #1 for 1991 Street Improvement Project, $107,743.08 5. Licenses (See Attached List) 6. Authorization to Pursue Grant Funds for the City's Tree Planting Program 7. Approval of Drainage Improvement at Pascal ar_d Iowa at a Cost of $4,500.00 REQUESTS FOR CITY PARTICIPATION IN COST OF RENIOVAL OF PRIVATE TREES DENIED Council considered requests from Roger and Cheryl Pittelkow, 1853 Pascal, and Gene Steele, 1776 Arona, that the City participate in the cost of removal of trees on their properties which have the appearance of boulevard trees. Both parties were of the opinion that at sometime in the past the City had remcved/trimmed similar trees as if they were on City property. Council agreed that Resolution R-85-41 which stipulates that any reimbursement for these types of trees would be discontinued as of September 1, 1987, should remain in force. BIDS AWARDED FOR IDAHO/SNELLING PARK SITE IMPROVEMENTS AND PICNIC/WAJZMING SHELTER Carol Huso, Chair of the Parks and Recreation Commission, explained that the Commission would like to move forward with the project and recommended that the bid be awarded as presented. Following a brief discussion Jacobs moved that the picnic/warming shelter bid be awarded to Dahn Construction in the amount of $67,600 and that the site improvements for the project be awarded to Aragoni Bros, in the amount of $62,687, both amounts to be funded from the park capital improvement fund. Motion carried unanimously. GROUND BREAKING FOR IDAHO/SNELLING PARK IMPROVEMENTS TO BE HELD THIRD WEEK IN JULY A ground breaking event for the Park Improvement Project will be scheduled sometime during the third week in July. REQUEST FOR ADOPTION OF ORDINANCE TO REQUIRE A MINIMUM OF 68 DEGREES IN RENTAL HOUSING UNITS TO BE DISCUSSED AT A FUTURE WORKSHOP Council discussed a letter from Diane Duffy, 1710 Larpenteur, requesting that Council consider an ordinance requiring landlords to maintain a minimum of 68 degrees in housing units. Staff was directed to obtain samples of ordinances from other communities for discussion at a workshop meeting. AMENDMENTS TO ASSESSMENT POLICY APPROVED Maurer presented a variety of revisions which had been MINUTES JUNE 19, 1991 PAGE 3 discussed and approved by Council in the past. Upon formal adoption of the revisions they will be incorporated into the City's Assessment Manual. Ciernia moved adoption of Resolution R-91-36 which carried unanimously. RESOLUTION R-91-36 A RESOLUTION AMENDING THE CITY'S ASSESSMENT POLICY PROPOSED RESOLUTION AMENDING ASSESSMENT POLICY TO ALLOW DEFERRAL OF PRINCIPAL AND INTREST FOR FINANCIAL HARDSHIP Council discussed the proposed amendment of the assessment policy to allow deferral of principal and interest for financial hardship, after which Wallin moved adoption of Resolution R-91-37 including language specifying that the annual gross income from all sources shall be 50 percent or less than the latest median income. Motion carried unanimously. RESOLUTION R-91-37 A RESOLUTION AMENDING THE CITY'S ASSESSMENT POLICY RELATING TO HARDSHIP DEFERRALS APPROVAL OF DEFERRAL OF PRINCIPAL AND INTEREST ON ASSESSMENT AGAINST THE PROPERTY AT 1739 N. FRY Council briefly discussed the request from Viola Gulden, 1739 N. Fry, for deferral of principal and interest for the 1991 Street Improvement assessment after which Gehrz moved adoption of Resolution R-91-38. Motion carried unanimously. RESOLUTION R-91-38 A RESOLUTION APPROVING DEFERRAL OF BOTH PRINCIPAL AND INTEREST WITH COMPOUNDING OF INTEREST ON THE SAME (1739 N. FRY ST.) PROPOSED RESOLUTION URGING RAMSEY COUNTY TO ADOPT THE LOCAL OPTION SALES TAX Council discussed issues relating to the sales tax which was adopted by the State Legislature at the last session. Both Ciernia and Baldwin presented additional language to be included in the proposed resolution after which Wallin moved adoption of Resolution R-91-39 including the additions. Motion carried unanimously. RESOLUTION R-91-39 A RESOLUTION OF THE CITY OF FALCON HEIGHTS URGING COUNTY ADOPTION OF LOCAL OPTION SALES TAX RESCUE SQUAD TO PROVIDE RESCUE SUPPORT TO THE SPECIAL OLYMPICS AT FAIRGROUNDS MINUTES. JUNE 19, 1991 PAGE 4 Council unanimously granted approval of the Rescue Squad's ~ ~~ request that they be allowed to provide rescue support to the Special Olympics at the Fairgrounds, July 17 - July 27. FIRE DEPARTMENT TO USE OLD IDAHO/SNELLING PARK BUILDING FOR A SMOKE DRILL Hoyt explained that the Department has requested permission to conduct a smoke drill in the present park building which will shortly be demolished to make way for the new structure and noted that the "Smoke Fluid" used for training has no odor nor does it leave soot. Council granted the request with conditions which would avoid neighborhood confusion and disruptions and stipulates that the drills cannot adversly impact the park project which is due to start in the near future. DAVID KRIESEL APPOINTED CITY PLUMBING INSPECTOR Council approved the appointment of David Kriesel as City Plumbing Inspector as recommended by Hoyt. PROPOSED ORDINANCE BAND7ING SALE OF TOBACCO PRODUCTS FROM VENDING MACHINES AND SELF SERVICE OF INDIVIDUAL PACKAGES Council discussed the ordinance proposed by the Mayor's Commission Against Drugs which is aimed at reducing or eliminating the availability of tobacco products from possession and use by juveniles. Council reviewed an Ordinance prepared by City Staff which would incorporate into the present City Code sections banning smoking materials being sold from vending machines and requiring businesses to sell all smoking materials from behind the sales counter and prohibiting self service of individual or single packages. Gehrz suggested that tobacco license fees be researched as there might be more enforcement costs connected with the new regulations. Wallin moved adoption of Ordinance 0-91-9 to become effective January 1, 1992 which carried unanimously. ORDINANCE 0-91-9 AN ORDINANCE AMENDING SECTION 5-3-01 OF THE CITY CODE RELATING TO REGULATION OF TOBACCO RELATED PRODUCTS INFORMATIONAL ITEMS NOTED The following informational items were noted: 1. May Police Report 2. Larpenteur Ave. Water Pressure 3. Notification of Building Inspector Service for Minnesota State Fair 3. Solid waste Commission Minutes of May 2, 1991 8:30 P.M. - PUBLIC HEARING ON AMENDING SECTIONS OF THE CODE RELATING TO OFF STREET PARKING AND DRIVEWAYS Baldwin opened the Public Hearing at 8:30 P.M. and stressed the MINUTES JUNE 19,1991 PAGE 5 ~ 5 :r .importance of having this particular ordinance in place as many property owners are having new driveways installed in conjunction with the street projects. He then asked for comments from persons wishing to be heard. There being no responses, the hearing was closed at 8:33 P.M. Wallin moved adoption of Ordinance 0-91-10 which carried unanimously.
