Mayor Eggert, Councilmembers Ciernia, Baldwin, Hard, and Chestovich. Also PRESENT present were Clerk Administrator Barnes, Attorney Gasteazoro, Attorney Van de North, and Engineer Schunicht. None. ABSENT Councilmember Chestovich moved, seconded by Councilmember Baldwin, that CONSENT the Consent Agenda be approved as presented. Motion carried unanimously. AGENDA APPROVED 1. Licenses: See Attached List Mayor Eggert moved, seconded by Councilmember Chestovich, that the follow- AGENDA ing item be added to-the agenda: Approval of Plans and Specifications for ADDENDUM the 1984 Sealcoating. Motion carried unanimously. Mayor Eggert moved, seconded by Councilmember Hard, that the Minutes of MINUTES OF June 12, 1984 be approved. Motion carried unanimously. 6/12/84 APPROVED Mayor Eggert reviewed a subdivision request from Carol R. and V. Elving Anderson, 1775 N. Fairview, and then moved that the request be referred V. E. ANDERS- to the Planning Commission, that a Public Hearing on the matter be ON, 1775 N. scheduled for July 25, 1984 at 7:15 P.M, and that the Clerk Administrator FAIRVIEW, SUP be authorized to publish the hearing notice. The motion was seconded by DIVISION RE- Councilmember Baldwin, and upon a vote being taken, carried unanimously. QUEST TO PLANNING COMM. PUBLIC Mayor Eggert informed Council that negotiations between Bullseye and HEARING ON Falcon Heights Service Center owners are deadlocked, and Council will 7/25/84 no doubt need to make a decision soon. Attorney Gasteazoro reported on the negotiating meeting and explained the condemnation process in BULLSEYE UP- the event Council determines such action is necessary. Attorney DATE Van de North. felt it might be wise to obtain a special appraiser who could address the on-going business value of the gas station. Following a discussion regarding the possibility of the City obtaining CITY TO an appraisal of the property since the owners seem to be unwilling to OBTAIN do so, and the possible relocation costs, the City Attorney was directed APPRAISAL OF to obtain information on relocation costs. Mayor Eggert then moved, FALCON seconded by Councilmember Chestovich, that the expenditure of funds SERVICE be authorized for-the purpose of obtaining an appraisal of the business, CENTER such costs ultimately being chargeable to Bullseye's letter of credit. Motion carried unanimously. MINUTES REGULAR CITY COUNCIL MEETING JUNE 27, 1984 PAGE 2 Attorney Gasteazoro explained that the City may now make application CITY OF for Industrial Revenue Bonds and recommended that Council consider making APPLY FOR application for funds available in August. Councilmember Ciernia moved, IRB BONDS seconded by Councilmember Hard, that the City Attorney be authorized to make application on behalf of the City. Motion carried unanimously. Attorney Vande North explained that John Peterson, Good Value Homes, BOULEVARD had been contacted regarding the placement of trees on the boulevards TREES IN in Falcon Woods No. 3 and indicated he would have the trees replanted FALCON on private property. Mr. Peterson will inform his contractors and the WOODS N0. 3 residents of that area that plantings may not be placed on the boulevards UPDATE due to the presence of underground utilities. Mark Haggerty, Attorney for Good Value, stated he would personally assure that the trees will be moved. Attorney Mark Haggerty, representing Grace Lai, owner of the 5 unit GRACE LAI building on Larpenteur at Tatum, explained-that his client is requesting PLATTING platting of the property in order that financing for sale of the units will REQUEST RE- be more available. Mayor Eggert moved, seconded by Councilmember Ciernia, FERRED TO that the request be referred to the Planning Commission. Motion carried PLANNING unanimously. COMMISSION Mayor Eggert moved,- seconded by Councilmember Ciernia, that Tony T. MACKIEW- Mackiewicz, 1443 W. Idaho, be appointed to the new formed Redevelopment ICA APPOINTEE Committee. Motion carried unanimously. It was agreed that each Council- TO REDEVELOP- member would serve on a rotating basis as observer for the Redevelopment MENT COMMITT- Committee and Mayor Eggert volunteered to attend the first meeting on EE June 28th. Councilmember Baldwin moved, seconded by Councilmember Ciernia, that YOUTH SERVICE Council will at budget time review favorably the request from Northwest BUREAU Suburban Youth Service $ureau that the City budget $4,577.00 toward REQUEST FOR the Bureau's 1985 funding. Motion carried unanimously. FUNDS FOR Engineer Schunicht explained that the Lake Overflow Task Force has 1985 prepared recommendations on solving the overflow problem as set forth OVERFLOW in a letter from Roseville Public Works Director, Charles Honchell (letter UPDATE dated June 22, 1984). The matter will be presented at the Mayor's Task Force Meeting of July 27, 1984. Engineer Schunicht presented the plans and specifications for the 1984 PLANS AND sealcoating (west of Snelling). Following a discussion regarding whether SPECIFICATION. or not to include blacktopping of the walkway to the park and a walk- FOR 1984 way in the easement south of Falcon Woods 3, Mayor Eggert moved, seconded SEALCOATING by Councilmember Ciernia, that the plans and specifications be approved TO INCLUDE and that both the walkways be included in the bid as alternates, such WALKWAYS bids to be opened at 10:00 A.M., June 25, 1984. Motion carried unanimously. At 8:00 P.M. Mayor Eggert opened the Public Hearing on the Proposed Street PUBLIC Assessment Policy and reviewed the reasons for considering such a policy. HEARING ON Following a presentation by Attorney Van de North and Engineer Schunicht, PROPOSED Council discussed the policy at length after-which the following recommend- ASSESSMENT POLICY AT 8:00 P.M. MINUTES REGULAR CITY COUNCIL MEETING ~ '~' ~!: JUNE 27, 1984 PAGE 3 ations were made:- (1) Section 7, Subdivision 1, the costs be paid 50% from HEARING the general fund and 50% assessed,-(2) Section 8, Subdivision 2, read 10% (cont.) to be paid from the general fund and 90% assessed, (3) Section 8, Subdivision 3, change to read: Alley Construction and Reconstruction and Curb and Gutters on Residential Streets. The cost of construction and reconstruction of alleys, curbs and gutters on residential streets shall be assessed 100%, Section 8, Subdivision 4, delete Sidewalks and Bicycle Paths, Section 10 to be reworded changing the word "shall" to "may" and ending the statement after "project costs", deleting the remainder of the statement. All Councilmembers agreed in principle to the recommendations. Council then discussed Section 11, "Deferment of Special Assessments for Senior Citizens" after which the City Attorney was asked to obtain inform- ation regarding the income guidelines-for low income deferment for senior citizens. The matter will lie discussed further at a continuation of the hearing. There being no one wishing to be heard, Councilmember Hard moved, seconded HEARING by Councilmember Baldwin, that the hearing be continued to July 25, 1984, CONTINUED at 7:45 P.M. Motion carried unanimously. TO 7/25/84 Following a short discussion, Council decided for the 1984 season to continue PRESENT with the diseased tree reimbursement policy used in 1983 and to discuss 1984 DISEASED reimbursement policies at budget time. TREE REIMB. POLICY TO BE Councilmember Hard then requested that Council consider purchasing a large port-CONTINUED able projection screen for the Council Chambers. He felt it would be con- venient for Council use and also for rental purposes. Council directed the PRICES TO BE Clerk Administrator to obtain prices on a 10' by 10' screen. OBTAINED ON The "needs list" prepared by the Park and Recreation Commission was deferred PROJECTION SCREEN until the July 11th meeting and Council requested that the Park and Recre- ation Commission prioritize-the list. PARK ITEM DEFERRED TO COUNCIL INFORMATION: 7/11/84 Councilmember Hard informed Council that the Fire Department is quite concerned that the Sheriff's Department is considering transfer of several Deputies policing Falcon Heights. He explained that two of the Deputies had given much of their own time preparing the new squad car for use and they are now to be transferred. .Clerk. Administrator Barnes will schedule a meeting with Commander Spencer of the Sheriff's Department to discuss the matter. Councilmember Ciernia commented on the successful League Convention in Duluth. Councilmember Bladwin explained that cars are parking on Garden Avenue adjacent to the entrance and exist at the Learning Center and children on bicycles exit into the street and cannot be seen by passing motorists due to the parked cars. Council discussed the possibility of banning parking within 30 feet of the driveways and directed the Clerk Administrator to write a letter to Jim Klassen, Community School Services Director, in- forming him of the problem and that the matter will be discussed at the July 11, 1984 meeting. Mayor Eggert presented an update on the search for a computer. Mayor Eggert moved, seconded by Councilmember Baldwin, that the meeting be ADJOURNMENT adjourned at 9:50 P.M.
