RDGULAR CITY COUNCIL MEETING
AUGUST 22, 1984
A regular meeting of the Falcon Heights City Council was called to order
by Acting Mayor Chestovich at 7:00 p.m.
Acting Mayor Chestovich, Councilmembers Hard, Ciernia and Baldwin. Also
present were Clerk Administrator Barnes and Attorney Gasteazoro.
Mayor Eggert.
Councilmember Hard moved, seconded by Councilmember Baldwin, that the
Consent Agenda be approved as presented. Motion carried unanimously.

Acting Mayor Chestovich moved, seconded by Councilmember Hard, that the
Minutes of August 8, 1984 be approved as presented. Motion carried
unanimously.
Acting Mayor Chestovich presented a request from B and J Midway Floral,
Inc., 1871 W. Larpenteur, to tear down an existing shed and replace it
with a garage. Council briefly discussed screening and whether or not
storage should be allowed on the north portion of the~lot. Acting
Mayor Chestovich moved, seconded by Councilmember Ciernia, that the
request be granted as recommended by the Planning Commis"sion at their
August 20, 1984 meeting with the stipulation that the north 25 feet of
grassed area cannot be used for storage of supplies and equipment
associated with operation of the business. Motion carried unanimously.
William A. Edwards, owner of the apartment building at 1504 W. Larpenteur,
addressed Council requesting a variance from the .portion of the Uniform
Fire Code requiring solid core doors in apartments. He stated that he
objected to the requirement due to the cost of the doors, which he felt
would mandate rent increases Ito his tenants, and the fact that there is
a possibility the legislature will change the law. He also indicated
that St. Paul and Roseville have granted variances.
Kitty Cloud, a resident of the apartment building at 1504 W. Larpenteur,
stated that she felt the new pull alarms which are to be installed will
be pulled by persons walking into the building and would result in false
alarms. She felt that in small buildings the present alarms are audible
throughout the building and it would be better to dial 911. She also
objected the spring lock requirement as persons could be locked out easily
" and expressed concern that costs of the changes would be absorbed by the
tenants.

Al Rubinger, owner of Larpenteur Manor Apartments, 1710, 1720, 1730 and
1740 w. Larpenteur, expressed his opposition to heat detectors in
closets and asked to appear at the last meeting in September to discuss
the matter.
Mike Long, 8?5 S. Howell, St.Paul, an employee of Mr. Edwards, referred to
a letter from Roseville Fire Marshall Bruce Ryden granting a variance on the
solid core door requirement and then read a letter he (Mr. Long) had written
to the St. Paul Dispatch~Pioneer Press ob3ecting to the new code requirements.
He stated that the average response time in St. Paul and Roseville is 2 to'
3 minutes and that Falcon Heights would no doubt have a similar average, and
this should alleviate the need for some of the new requirements.
Howard Goserud, owner of the apartment build ing at 1496 W. Larpenteur,
requested that items be explained more clearly and stated that he had
originally been infoaned by both Fire Chief Renchin and Fire Marshall
Iverson that solid core doors were needed only in hazardous areas and
later was informed that all doors were to solid core.
Warren IIert, owner of the apartment at 1510 W. Larpenteur, stated he
had called the State Fire Marshall and was advised that if the second
level of the building is not six feet above grade it is not considered
to be a three story building.

Mr.~and Mrs. Leonard Carlson, owners of the apartments at 1511 W. LEONARD
Larpenteur and 1680 Arona, wondered where it would all end and CARLSON, 1511
expressed concern that the costs must be passed on to tenants which LARP. 8~ 1680
;results in a turnover of tenants. They felt the hazard is not as great ARONA
in a ten unit building as in big buildings located far from afire department.
Fire Marshall Terry Iverson explained that in determining a three story
building the stories begin at the grade of the street and the code makes
no provision for two and one-half story buildings. He also stated that
since Falcon Heights does not have a ladder truck, fire prevention items
are most important.
A discussion ensued regarding the use of mutual aid, response time (Fire
Marshall Iversen stated Falcon Heights Fire Department average response
time is 5 minutes), testing of solid core and hollow doors, and the
reasons for self closing doors. The discussion was interrupted to hold
the public hearing scheduled for 8:00 p.m.
Acting Mayor Chestovich opened the Public Hearing on Assessment of
Delinquent Sanitary Sewer Charges at 8:00 p.m. There being no one present
wishing to be heard the hearing was closed at 8:01 p.m. Councilmember
Hard moved, seconded by Acting Mayor Chestovich, that Resolution 84-30
be adopted. Motion carried unanimously.

Fire Marshall Iverson explained that variances on the solid core doors can
be granted if hazardous areas of the entire building are provided with a
sprinkler system. He requested that if there is to be s delay in complying
with the required changes, apartment owners write a letter of intent
explaining the reason for the delay.
Attorney Gasteazoro stated that the apartment owners have received a 30
day notice to comply and can be issued a citation after 30 days. If there
is to be a delay, a letter of intent is to be sent indicating the intent to
comply within a reasonable time. A specific time must be indicated and when
that time is over, legal action could be taken. She explained that the law
stipulates that every municipality must adopt the Uniform Fire Code or some
other code as stringent as the UFC, and the City Ordinance No. 88 provides
that the Fire Chief may modify the code but any modifications must be passed
on by the State Fire Marshall's office. Attorney Gasteazoro was of the
opinion that the variance should not be granted as the City could be enjoined
in a law suit if the lack of the required fire protection items resulted in
a death. Council concurred that the Gity would be remiss if the law is not
enforced and requested apartment owners work with the Fire Chief and Fire
Marshall to comply with the law.
Joyce Gimmestad, owner of B and J Floral, Inc., 1871 W. Larpenteur,
requested to be heard regarding her concerns regarding a stipulation
made by the Planning Commission at their August 10th meeting which
required that the existing structure and debris on her property be
removed prior to :the new garage being erected. Mrs. Gimmestad explained
that this would cause a hardship as she would have no place to store the
items in the existing building while the replacement is being constructed.
Council granted a period of two weeks to xemove the old building and debris
following the construction of the new structure.
Acting Mayor Chestovich moved, seconded by Councilmember Cieraia, that the
request from the Knights of Columbus Nazareth Council No. 4021, for the
Falcan Heights Ambulance to provide emergency and first-aid coverage for
the Marathon for Non-Public Education on October 6, 1984 be granted.
Motion carried unanimously.
Clerk Administrator Barnes presented a letter dated August 21, 1984 from
Engineer Schunicht recommending that Austin P. Keller Construction Co.
be paid =20,670.58 for the utilities in Falcon Woods No. 3, the retainage
being reduced to 1%. Clerk Administrator Barnes was of the opinion that
196 was not sufficient and recommended that an amount of ;7,000 be retained
rather than X3,585.18 (196). Following a short discussion Councilmember
Ciernia moved, seconded by Acting Mayor Chestovich, that $7,000 be retained
and an amount of =17,225.76 be paid to Austin P. Keller Construction Co.
Motion carried unanimously.
Councilmember Ciernia commented on a discussion at the August 8, 1984
Council meeting regarding whether or not Council committed to sale of
the liquor store. Heathen read from the minutes of the meeting of June 12,
1984 indicating that the sale of the liquor store and a~equisition of the
gas station vas to remain under consideration.

Attorney Gasteazoro reported that she had received a call from Bob Collins BULLSEYE
of Bullseye Golf indicating that Bullseye has purchased Falcon Service pUR~,S~
Center, and that financing for the proposed building project has been FALCON
obtained. Attorney Gastea.zoro indicated that the development agreement SERVICE
should be finalized in a week or two. CENTER
Councilmember Hard moved, seconded by Councilmember Ciernia, that the ADJOURNMENT
meeting be adjourned at 9:02 p.m. Motion carried unanimously.
