HomeMy WebLinkAboutCCMin_85Sep16_SpecialMINUTES SPECIAL CITY COUNCIL MEETING/PUBLIC HEARINGS SEPTEMBER 16, 1985 A special meeting of the Falcon Heights City Council was called to order at 7:00 P.M. by Mayor Eggert. Mayor Eggert, Councilmembers Ciernia, Chenoweth, Baldwin, and Hard. Also present were Clerk Administrator Barnes, Attorney Van de North, and Enginee Willis. None. r Mayor Eggert opened the Public Hearing on Assessments for the 1985 Coffman/Larpenteur Street and Utility Improvements at 7:00 P.M., and presented the Affidavits of Publication and Mailing. Read into the record was a letter dated September 3, 1985 from Steven C. Emerson, 2129 W. Larpenteur, requesting that Council consider a 10 year assessment term. Council discussed Mr. Emerson's request and the fact that only Mr. Emerson and Gibbs Farm will be paying over the term designated, the University of Minnesota and University of Minnesota Golf Club have signed agreements that they will pay their assessments up front. There being no one present wishing to be heard, Mayor Eggert closed the hearing at 7:08 P.M. and moved Resolution R-85-55 providing for payments over a ten year period at nine percent interest. Councilmember Hard seconded the motion and upon a vote being taken, .carried unanimously. RESOLUTION R-85-55 A RESOLUTION RELATING TO ADOPTING ASSESSMENTS FOR 1985 COFFMAN/LARPENTEUR STREET AND UTILITY IMPROVEMENTS At 7:15 P.M. Mayor Eggert opened the Public Hearing on Assessments for the 1985 Tatum/Lindig Street and Utility Improvements and presented the Affidavits of Publication and Mailing. Choong-Sihn-Youn, 1742 Tatum Street, questioned the estimated costs of the project and the bid costs. Engineer Willis explained the cost of the project and the amount to be assessed, and that the proposed assessments are the same as given at the other hearing $28.00 per foot for the street, and 7.560 per square foot for storm sewer. Mr. Youn questioned the fact that the assessment has remained the same in spite of the fact that the bid came in approximately $40,000 less that estimated. He also wanted to know if there would be other costs added later. Mayor Eggert explained that the soft costs are included in the proposed assessment and there would be no further charges other than the interest if not prepaid. Mr. Youn asked if Council would be willing to distributed the savings to residents. Mark Ascerno, 1871 Tatum Street, stressed the same point as Mr. Youn, should not the savings be shared with the homeowners. He indicated that at the improvement hearing Council indicated a large part of the cost would be paid with tax increment funds, and for that reason most property owners did not object. He inquired about the interest to be charged and if the term is 10 years if there would be a penalty for prepayment. Mayor Eggert explained that the rate is usually established at one percent over the bond interest rate and the balance may be prepaid at no interest if payment is made in accordance with the dates set forth in the handout. 11G PRESENT ABSENT PUBLIC HEARING ON ASSESSMENTS COFFMAN/ LARPENTEUR IMPROVEMENT AT 7:00 P.M. RESOLUTION R-85-55 PUBLIC HEARING ON TATUM/ LINDIG IMPROVEMENT CHOONG-SIHN YOUN, 1742 TATUM MARK ASCERNO, 1871 TATUM MINUTES SPECIAL CITY COUNCIL MEETING/PUBLIC HEARINGS SEPTEMBER 16, 1985 PAGE 2 Irene Struck, 1805 Tatum Street, questioned the cost of connection to the St. Paul storm sewer system, indicated she was tired of paying for streets, Tatum Street is only 20 years old and should have lasted 35, asked for an accounting of the costs, why there is such a huge cost to homeowners, and expressed concern that some cannot afford it. Mayor Eggert explained that the City is paying the St. Paul connection costs (amount at present unknown), there were construction problems with the present street, as per the Engineer, the assessments are computed based on the City's assessment policy, and that State Statute provides for senior citizens hardship tax deferral. Engineer Willis explained the costs of various parts of the project. George Kilgriff, 1739 Tatum, stated that his questions had been answered, the interest rate was his interest. Leonard Neilsen, 1831 Tatum, asked how the October 16th date for .prepayment was set, to which Mayor Eggert explained that State Statute requires prepayment be made within 30 days of the hearing. There being no others wishing to be heard, Mayor Eggert closed the hearing at 7:54 P.M. Councilmember Chenoweth moved, seconded by Mayor Eggert, that the assessment roll be accepted as presented to be assessed over a ten year period at nine percent interest. Councilmember Ciernia commented on the fact that the total is less than the proposed cost and felt there were three options: (1) assess as proposed, (2) pro-rate - refund 38~ of the cost, or (3) apply the $40,000 as abatement on the assessments. He felt that either of the abatement methods would be appropriate. Councilmember Baldwin also indicated he would favor one of the abatement methods. Mayor Eggert commented on the fact that the assessment policy was adopted in order that everyone in the City would be assessed equally, and felt that street costs should be charged according to the policy. He also stressed the fact that property owners in Falcon Woods 4~2 and 4~3 were charged 7.5C per square foot for storm sewers and was not sure Tatum owners should be treated differently. Councilmember Hard also commented on the fact and Falcon Woods ~~2 and ~~3 were charged 7.5G per square foot.. He also felt that since the City is contributing tax increment funds, the City as a whole is participating and should participate in the savings. Councilmember Chenoweth stated that according to the policy other areas of the City would be charged 90 to 95 percent and the charge to Tatum properties would be considerably less due to the tax increment funds; however, he would consider a reduction if the amount can be agreed upon. Following the discussion, Councilmember Chenoweth withdrew his original motion and Mayor Eggert withdrew his second, after which Councilmember Chenoweth moved, seconded by Councilmember Hard, that Resolution R-85-56 be adopted approving the assessment roll with a reduction in the charge for storm sewer from 7.560 to 5.22 per square foot, the assessment term to be over a ten year period at an interest rate of nine percent. Motion carried unanimously. 11~ IRENE STRUCK, 1805 TATUM GEORGE KILGRIFF, 1739 TATUM LEONARD NEILSEN, 1831 TATUM HEARING CLOSED ASSESSMENT DISCUSSION MINUTES SPECIAL CITY COUNCIL MEETING/PUBLIC HEARINGS SEPTEMBER 16, 1985 PAGE 3 RESOLUTION R-85-56 A RESOLUTION RELATING TO ADOPTING ASSESSMENTS FOR THE 1985 LINDIG/TATUM STREET AND UTILITY IMPROVEMENTS Mayor Eggert commented on the fact that Bullseye Golf, Inc. has indicated they will not reconstruct the alley behind Bullseye Plaza as the City had expected and commented on the fact that the construction of the new Bullseye Building is in worse shape than before. Attorney Van de North stated he had reviewed various documents and letters to the effect that the City contemplated Bullseye repairing the alley as part of the de- velopment and that Bullseye should be advised of that fact. Council concurred that a letter should be drafted informing Dennis Hunt of Bullseye Golf, that the City feels the alley repair is his responsibility, and if the City repairs the alley and assesses the cost it would be more expensive than repairing it as a part of the project. It was decided, however, to order a feasibility and plans and specifications, and schedule the appropriate hearing at this time. Mayor Eggert moved, seconded by Councilmember Ciernia, that Resolution R-85-57 be adopted. Motion carried unanimously. RESOLUTION R-85-57 A RESOLUTION ORDERING THE PREPARATION OF A FEASIBILITY STUDY, PLANS AND SPECIFICATIONS AND AUTHORIZING THE ADVERTISEMENT FOR BIDS THEREON FOR THE IMPROVEMENT OF THE ALLEY NORTH OF LARPENTEUR BETWEEN SNELLING DRIVE AND ARONA STREET Mayor Eggert moved, seconded by Councilmember Ciernia, that Resolution R-85-58 be adopted. Motion carried unanimously. RESOLUTION R-85-58 A RESOLUTION CALLING FOR A PUBLIC HEARING TO CONSIDER IMPROVEMENTS TO THE ALLEY NORTH OF LARPENTEUR BETWEEN SNELLING DRIVE AND ARONA STREET Mayor Eggert and Attorney Van de North will draft a letter to Dennis Hunt explaining this action. Councilmember Ciernia announced that due to work and family re- sponsibilities he will not seek re-election.
