MS4 Presentation Timothy Pittman, Public Works Director The Municipal Separate Storm Sewer Systems is required by the MPCA every year. The system helps regulate large construction sites in major metropolitan areas. The EPA and MPCA oversee them and must develop storm water prevention programs. The permit holder is required to submit a Storm Water Pollution Prevention Program (SWPPP) that incorporates best management practices (BMPs). MS4 in urban areas are required to obtain a storm water permit. Falcon Heights is considered an urbanized area. Although the U of M and State Fair are in Falcon Heights, they are permitted separately and have their own MS4. The six control measures are: public education and outreach, public involvement and participation, illicit discharge, detection and elimination, construction site runoff control, post- construction runoff control, and pollution prevention and good housekeeping. The progresses to date are: 1. Newsletters and flyers to residents 2. Developed a storm sewer map 3. Implemented the construction site runoff control measures 4. Enforced the construction site runoff on the SE Corner 5. Inspected 100% of outfalls 6. Implemented de-icing material controls 7. Implemented storm drain system cleaning and rehabilitation of catch basins 8. Reconstructed the Curtiss Field Pond 9. Implemented vehicle maintenance program 10. Purchased a street sweeper with the City of Little Canada. This means more street sweeper for the city. 11. Straight salt for road melt 12. Storm sewer system cleaning program 13. Added additional underground storage 1 of 32 2 | Page The 2019 goals are to continue utility billing, educational flyers, and newsletters to residents, sweep streets more often, repair catch basins, and monitor underground containment structure at Curtiss Field Park. Proclamation - Restoration and Unity Days Mayor Gustafson July 6 will be a combination of Restoration Day and Cultivating a Caring Community - “Healing and Understanding” event. The event will start at 6:30pm and the speakers are Valerie Castile and John Thompson. Hawa Samatar will not join us due to her new schedule. Councilmember Leehy will find the third speaker for the event. Council Member Leehy After the panel event, there will be a candlelight vigil. On July 7, the Castile family will host the BBQ again this year. The family will provide hotdogs and hamburgers. Guests are encouraged to bring something to share and there will be music and games. The BBQ event starts at 5:30pm on City Hall greenspace. Mayor Gustafson Moved, Approved 4-0 G: POLICY ITEMS: H. INFORMATION/ANNOUNCEMENTS: Council Member Miazga • Environment Commission continues to do a remarkable job. They have over 20 initiatives such as the native plant ordinance draft. I think it will come up in the fall workshop. • Mayor Gustafson is receiving an award on behalf of the city by the League of Minnesota Cities for all the work we have done so far this year. I want to thank former Mayor Lindstrom for his commitments and making the city reach this goal. 2 of 32 3 | Page • According to the Roseville Review, the City of Roseville will regulate street parking this year during the fair. • I want to thank Farook Meah for all his service on the Environment Commission. He is a remarkable person and very intelligent. He is committed to the environment and the community and will be missed. • There is an upcoming election and there might be 2-3 seats open. If anyone is interested, the filling period is July 30 through August 13. The filing location will be at Ramsey County elections office on Plato Boulevard. Council Member Leehy • No updates. Council Member Harris • Planning Commission did not meet last night due to lack of quorum. Mayor Gustafson • Community Engagement Commission met last Monday. We are looking at add additional events for the fall and winter season. In addition, they are promoting the Neighborhood Liaison program and try to figure out which block is lacking. • Night to Unite is on Tuesday, August 6. The registration is now open and the deadline is July 19. If you want to request the fire department, city council, barricades, and play kit, please register at the city website or city hall. If you want to request the police department, you will have to register at https://www.surveymonkey.com/r/NTU2019. • Coffee with a Cop was last Thursday at Falcon Heights Town Square. It was a nice gathering. • I will be attending the League of Minnesota Cities annual meeting. The city is being award for Green Step Cities - Step Five and it will be Falcon Heights’ second time. In addition, former mayor Peter Lindstrom will be at the meeting. • Ice Cream Social and Hot dog with a Deputy is on Thursday, July 18, at Community Park. It is from 5pm - 8pm and a free event. City Administrator Thongvanh • The Ramsey County Sheriff’s Office has sent me a preliminary budget for the 2020 budgets, which the council will have to review. In addition, we are getting into the budget season, and I was able to reduce some of the budget items from $62,000 increase for the year 2020 to about $16,000. Which was equated to about a 5.45% increase to about instead, about a $16,000 increase, which accounts about 1.4% of the budget for police services. The 2018 reconciliation, we were able to get a little bit more money back than the anticipated $40,000. This will help the budget. • The city applied for the Good Neighbor Fund where it focuses on “Cultivating a Caring Community” and was awarded $6,685. The funds will go towards building a shed and storing sports equipment at Curtiss Field. This means residents can have access to this equipment. It will also go towards Rec on the Go program, which is a free program at Curtiss Field. The funds will help provide snacks and water for the program. Lastly, we will host a community read-a-thon where elementary students will visit the senior 3 of 32 4 | Page housings and read books. The city is still trying to figure out the logistics of the program. • The next Cultivating a Caring Community event will be on Tuesday, November 18th. The theme is “Grey Area Thinking,” and the guest speaker is Ellie Krug. • Public Works crew has been repairing the Community Park Building. They found a leak and are trying to fix it and restore the pavement back to ADA compliance. Council Member Miazga sent a picture of the windows and they are looking into it. • City Council Workshop is rescheduled to Wednesday, July 17th. The next city council regular meeting is on Wednesday, July 10, and Councilmember Miazga will be absent. I. COMMUNITY FORUM: J. She later became one of the few attorneys nationally to try jury cases in separate genders. From 2011 to 2016, she served as the executive director of Call for Justice, LLC, a Minneapolis legal nonprofit that was conferred an American Bar Association award for innovatively increasing legal access. The author of Getting to Ellen: A Memoir about Love, Honesty and Gender Change (2013), Ellie has presented on diversity and inclusion to governmental entities, court systems, Fortune 100 companies, law firms, nonprofits, and colleges/universities on nearly 800 occasions. A hopeless idealist, Ellie has presented her human inclusivity training, “Gray Area Thinking®” across North America. Engagement: Ellen (Ellie) Krug (hereinafter “Speaker”), will appear and present in Falcon Heights, MN on Monday, November 18, 2019 from 6:00 to 8:00 p.m. The subject matter of the presentation will be “Gray Area Thinking®” human inclusivity training. This training will be referred to as “the Event.” 2. Sponsor for the Event: The Sponsor for the Event is the City of Falcon Heights, MN. The Sponsor will be responsible for: (1) creating and adhering to the Speaker’s schedule; and (2) copying and distributing any handout/materials for the Event. 3. Honorarium and Expenses: a. Fee: Provided that there is no charge to attendees for attending the Event, HIW will waive its standard fee ($2950.00) for the Event. b. Expenses: HIW shall charge no expenses for the Event. c. Cancellation Fee: If Sponsor cancels the Event, subject to the contingency set forth in Section 4, it shall pay HIW a cancellation fee of $750.00. 4. Force Majeure: Either party may cancel this agreement without further obligation if the Event become impractical due to Speaker’s illness or due to weather, accidents, strikes, riots, or other conditions beyond the control of either party. 5. Photographing and Videotaping of the Event: Sponsor may take photographs during Speaker’s presentation at the Event; in such case, one or more photographs shall be shared for free with HIW at HIW’s option. Sponsor may not film or videotape the Event for future use without an added fee and executed Limited License Agreement. In the case where the parties agree on filming/videotaping, a free copy of the film format will be shared with HIW for its own use, such as for marketing or other purposes. 6. Use of Names: Sponsor agrees that HIW may use Sponsor’s name as a representative client in HIW’s marketing or other promotional materials. HIW agrees that Sponsor may use HIW’s or Ellie Krug’s names in materials that promote or demonstrate Sponsor’s commitment to diversity or inclusivity. 7. Sale of Books: Speaker is an author and shall be entitled to sell copies of her memoir, Getting to Ellen: A Memoir about Love, Honesty and Gender Change, following the Event. Speaker shall be entitled to all proceeds from such sales. If Sponsor desires to purchase in bulk copies (ten or more copies) of Speaker’s memoir as a “perk” for attendees, the cost of the memoir will be discounted to $15.50/copy plus the cost of bulk shipping. 8. Continuing Education Credits: Sponsor may apply for Continuing Legal Education credit or Continuing Education Unit credits using the Event as a basis for such credit. However, because HIW does not control the credit grantiing authority of any entity or agency, it cannot guarantee that such credit will be conferred. Sponsor shall be responsible for completing all CLE or CEU paperwork/applications. 9. Entire Agreement: This agreement constitutes the entire agreement between Human Inspiration Works, LLC and the Sponsor. Sponsor acknowledges that 31 of 32 2 Speaker shall not be presenting legal advice and that Speaker is not retained for legal representation of any kind. To the extent there are modifications to this agreement, they shall not be binding unless they are in writing executed by both parties and labeled “Addendum.” This agreement may be signed in counterparts with either original or scanned signatures or a combination thereof. 10. Governing Law and Legal Fees: This agreement shall be construed in accordance with Minnesota law. In the event of a litigated dispute, the prevailing party shall be entitled to legal fees, costs and expenses payable by the party that is deemed in breach or at fault. Litigation to enforce the terms of this agreement shall only be instituted in the Fourth Judicial District of Minnesota.
