HomeMy WebLinkAboutCCMin_81Feb11MINUTES ~ ~~' REGULAR CITY COUNCIL MEETING FEBRUARY 11,1981 A regular meeting of the Falcon Heights City Council was called to order by Mayor Warkentien at 7:30 p.m. Mayor Warkentien, Councilmembers Steele, Brown, Eggert and Larson. Also PRESENT present were Clerk Administrator Barnes, Attorney Allen and Engineer Lemberg. None. ABSENT Councilmember Eggert moved, seconded by Councilmember Brown, that the CONSENT Consent Agenda be approved as presented. Motion carried unanimously. AGENDA APPROVED 1. Councilmember Eggert moved, seconded by Councilmember Steele, that the MINUTES OF Minutes of January 28, 1981 be approved as presented. Upon a vote being JANUARY 28, taken the following voted "aye": Mayor Warkentien, Councilmembers Steele, 1981 Brown and Eggert, and the following voted "nay": None. Councilmember Larson abstained. Motion carried. Engineer Lemberg explained to Council the Supplemental Agreements on the reconstruction of Roselawn Ave., between Fairview and Cleveland, and the following action was taken: Councilmember Steele moved, seconded by Councilmember Eggert, that Supplemental Agreement #4 be returned to Ramsey County for a break- down due to the fact that the County Engineer misinterpreted the plans. Motion carried unanimously. ROSELAWN AVE CHANGE ORDERS MINUTES REGULAR CITY COUNCIL MEETING FEBRUARY 11, 1981 PAGE 2 Councilmember Steele moved, seconded by Councilmember Eggert, that Supplemental Agreement 463 be denied as it is the result of a staking error by the County. Motion carried unanimously. Mayor Warkentien moved, seconded by Councilmember Eggert, that Supplemental Agreement 462, decreasing the contract price in the amount of $346.62, be accepted. Motion carried unanimously. Fire Department Members Joseph Bianchi and Craig Schauffert were in attendance to present the Fire Department Relief Association's proposed by-law amendment. Following the discussion Councilmember Eggert moved, seconded by Councilmember Brown, that the by-law amendment be approved with the first sentence amended to read as follows: "Upon Fireman's death, in or out of the line of duty, the surviving spouse receives the amount of pension due at that time, or in payments acceptable to the surviving spouse and the Association, according to the vested rights of the fireman as of the date of death." Motion carried unanimously. Mayor Warkentien presented for Council's approval a request from the Fire Department to extend the term of duty of Joseph Bianchi and Donald Pantzar. Councilmember Eggert moved, seconded by Councilmember Brown, that Council authorize the extension of the term of duty of Firemen Bianchi and Pantzar with a maximum retirement age of 65 years, or re- tirement by choice, disability or death. Motion carried unanimously. Councilmember Brown moved, seconded by Councilmember Larson, that Fire Department Applicant David Pearson, 1192 Garden Avenue, be approved subject to the required physical and the one year probation period. Motion carried unanimously. Attorney Allen reported that he had reviewed some of the criminal ord- inances including the Parks Ordinance and Nuisance Ordinance 4620, as requested by Council at the January 28, 1981 meeting, and presented for Council's consideration a proposed ordinance adopting a criminal code for the City of Falcon Heights. Following a lenghty discussion Council concurred that before taking any final action, a copy of the proposed ordinance be sent to the City's Prosecuting Attorney for his review and comments. Discussion of the proposed Swimming Pool Ordinance was deferred in order that Councilmember Larson might review the previous action by the Plan- ning Commission. Attorney Allen presented proposed Ordinance X178 relating to the Build- ing Code and fees for the City. Councilmember Eggert moved, seconded by Councilmember Larson, that the Ordinance X178 be adopted as presented by the Attorney. Motion carried unanimously. DEFERRED ORDINANCE N0. 178 MINUTES REGULAR CITY COUNCIL MEETING FEBRUARY 11, 1981 PAGE 3 ~.l Mayor Warkentien moved, seconded by Councilmember Steele, that Council LIQUOR grant the request of Yellen and Associates, Accountants for the Aiunicipal STORE Liquor Store, to increase the fees from $250.00 to $275.00 per month and ACCOUNTING an additional $100.00 for preparing the year-end financial statements and FEES closing the books. Motion carried unanimously. INCREASED Mayor Warkentien moved, seconded by Councilmember Brown, that Council authorize payment of $2,538.13 to Bonestroo and Associates for engineering fees through December, 1980. Motion carried unanimously. Attorney Allen reported that, in his opinion, the Section 8 Housing Non-ia~igrant Student Alien Amendmendment is now in effect. However, in view of the contract the City has with Metro HRA, it would be a breach of contract if the City attempted to reject or refuse to process an application. The Attorney suggested that each Section 8 applicant might be presented with a copy of the new law and the applicant directed to contact Metro HRA if there are questions. Councilmember Eggert moved, seconded by Mayor Warkentien, that the document be drafted and presented to Section 8 applicants as suggested. Motion carried unanimously. Mayor Warkentien informed Council it would not be necessary to discuss the proposed legislation regarding suburban court locations as the proposal has been dropped for the present time. Councilmember Brown reported that the Recreation Advisory Committee met February 10, 1981 for an organizational meeting, choosing Don Brown as Chairperson and Maxine Harkness as Secretary. Councilmember Brown reported that she had attended the District 623 Community Schools Advisory Committee Meeting and that with the closing of Fairview Junior High .School it will become the Community Center. Councilmember Larson reported that she had met with District 12 of St. Paul and was presented with a copy of the District 12 Plan which is on file at the Falcon Heights City Office. Mayor Warkentien reported that he, Clerk Administrator Barnes and Councilmember Brown had met with Barbara Lukermann, President of the University Grove Homeowners Association, regarding the possibility of constructing a new City Hall at Coffman and Larpenteur. Ms. Lukermann suggested that a complete package be prepared in order that she could present it to the Grove residents. The Clerk Administrator informed Council that he had been contacted by Towle Realty and Don Hermes regarding a proposed Planned Unit Development on the Hermes and Hawkins properties and indicated a willing- ness to sell the City a portion of the land bordering on Larpenteur. Council seemed to be of the opinion that the price would be exhorbitant. A lengthy discussion ensued after which it was decided to assemble any information Ms. Lukermann considers necessary and pursue the possible acquisition of University property. BONESTRO0 & ASSOC. ADVISQ< REPORT COMMUNITY SCHOOLS REPORT DISTRICT 12 PLAN CITY HALL DISUCSSION MINUTES {{ ~ REGULAR CITY COUNCIL MEETING - _f.~i FEBRUARY 11, 1981 PAGE 4 Mayor Warkentien presented a letter from Talley Educational Services, JOB CORPS Inc. of Seattle Washington (the firm which will operate the Minnesota UPDATE Job Corps Center) requesting that a representative from Falcon Heights be appointed to the Job Corps Community Advisory Council. Mayor Warkentien will contact John Labalestra and request that he consider being the representative from Falcon Heights. Mayor Warkentien presented an invitation to participate in the Callaghan and MondaleForums on February 26, 1981 and February 17, 1981. CALLAGHAN - MONDALE FORUMS Mayor Warkentien announced that the National League of Cities Congress- ional-City Conference will be held February 28, 1981 through March 3, NATIONAL 1981 in Washington, D.C. and inquired if any Councilmembers were LEAGUE OF interested in attending. None were able to attend. CITIES CONE. Clerk Administrator Barnes noted the M.S.A. Fund Report for 1981 as MSA FUND follows: REPORT Maintenance Account$3,600 for Streets Construction Account $52,038 Mr. Barnes explained that after the cost of upgrading Roselawn Avenue there will be a balance of $9,500 in the account. Clerk Administrator Barnes reviewed proposed bills which were listed PROPOSED in the 1981 Proposed Legislation Bulletln_~~2.: LEGISLATION REVIEW During Councilmember Eggert's update on Cable TV he requested that all Councilmembers study the information which was provided regarding Cable CABLE TV TV ownership options in order that the matter may be discussed at the UPDATE February 25, 1981 meeting. Clerk Administrator Barnes informed that all communities involved in the LAKE COMO Lake Como overflow problem have responded negatively to St. Paul's OVERFLOW proposals for funding.
