Also present were PRESENT Clerk Administrator Barnes and Engineer Lemberg. Mayor Warkentien and Councilmember Larson. Councilmember Eggert moved, seconded by Acting Mayor Brown, that the Consent Agenda be approved as presented. Motion carried unanimously. 1. Lauderdale Fire Report 4iL-00481 2. Councilmember Eggert moved, seconded by Councilmember Steele, that the Minutes of April 8, 1981 be approved as presented. Motion carried unanimously. Acting Mayor Brown presented for Council's consideration a request from Flower City to display bedding plants outside the store from May 1 to June 7, 1981. Frank Ellering, Manager of Flower City, was in attendance to answer any questions. After a short discussion Council- member Steele moved, seconded by Councilmember Eggert, that Flower City be permitted to display bedding plants outside from May 1 to June 7, 1981 with the stipulation that the display not exceed further than the parking area and does not impede traffic flow. Motion carried unanimously. MINUTES OF 4/8/81 APPROVED FLOWER CITY TO DISPLAY PLANTS OUT- SIDE FROM 5/1 - 6/7 1981 MINUTES REGULAR CITY COUNCIL MEETING APRIL 22, 1981 PAGE 2 !~ A lenghthy discussion was held regarding the City's rejection of Change Orders 3 and 4 on the Roselawn Avenue Project. (The Change Orders were made necessary by errors on the part of Ramsey County.) Ramsey County is still requesting that Falcon Heights pay for Change Orders 3 and 4 plus the final payment for the Project. Councilmember Eggert moved, seconded by Councilmember Steele that payment be denied on Change Orders 3 and 4. Motion carried unanimously. ej ROSELAWN AVE CHANGE ORDER; 3 AND 4 DENIED Councilmember Steele moved, seconded by Councilmember Eggert that a final FINAL PAYMEN' . payment of $165, 488.19 be made to Ramsey County for the Roselawn Project ON ROSELAWN (the balance after Change Order 3 and 4 costs are deducted). Motion AVE. APPROVE] carried unanimously.. Engineer Lemberg presented to Council the bids received for the 1981 Sealcoating Project (all alleys in the City and the University Grove Streets) as follows: (1) Allied Blacktop - $21,317.00, (2) Pine Bend Paving - $22,248.30, (3) Bituminous Roadways - $18,663.43, and (4) Black Top Service Co. - $16,753.60. Councilmember Steele moved, seconded by Councilmember Eggert, that Resolution 8i-5 be adopted awarding the 1981 Sealcoating Contract to Black Top Service Co. at a price of $16,753.60. Motion carried unanimously. RESOLUTION 81-5 f~ A RESOLUTION AWARDING THE 1981 SEALCOATING - ALLEYS AND UNIVERSITY GROVE STREETS 1981 SEAL COATING BIDS PRESENTED RESOLUTION 81-5 Acting Mayor Brown presented to Council a letter from Patricia Ferrieri, P. FERRIERI 1580 Fulham, appealing a $1.00 late penalty on her sewer charge on the APPEAL FOR basis that she did not receive the statement. After a short discussion CANCELLATION Councilmember Steele moved, seconded by Councilmember Eggert, that the OF $1.00 request to cancel the $1.00 penalty be denied. Motion carried unani- PENALTY mously. DENIED Clerk Administrator Barnes explained that the widow of Fireman Henry Dachtera has made claim for benefits under the Peace Officers Benefit Statute MS 352E and the matter is going to court. Since the Clerk Administrator and Fire Chief Renchin may be required to testify, Clerk Administrator Barnes requested that the information be referred to the City Attorney for review and advice. Councilmember Steele moved, second- ed by Acting Mayor Brown, that the matter be given to Attorney Allen for review and that Attorney Allen discuss the case with former City Attorney Kenefick, who originally handled the matter. Motion carried unanimously. Clerk Administrator Barnes presented for Council's approval a request for payment of two Collins Electric bills ($489.61 and $802.80) for repair of street lights in the University Grove area. Councilmember Steele moved, seconded by Acting Mayor Brown, that the Collins Electric bills be paid with the stipulation that the amount be assessed to the University Grove homeowners. Motion carried unanimously. Clerk Administrator Barnes requested authorization to issue a check in the amount of $118.00 to Fireman James Vainovskis to replace lost check X11197. Acting Mayor Brown moved, seconded by Councilmember Eggert that the request be granted. Motion carried unanimously. DACHTERA CAS: REFERRED TO CITY ATTORNE' PAYMENT OF COLLINS ELECTRIC BILE APPROVED - TO BE ASSESS TO GROVE HOMEOWNERS LOST CHECK ~~11197 TO BE REPLACID l' 1 MINUTES . REGULAR CITY COUNCIL MEETING APRIL 22, 1981 PAGE 3 Engineer Lemberg presented the following cost estimates for surfacing ESTIMATES as an alley, the walkway between 1740 and 1746 Holton running to Albert: ON SURFACING WALKWAY - Alternate A - to construct a residential driveway alley that would 1740 & 1746 only support personal vehicles, $15,421. HOLTON Alternate B - to construct a normal alley that would accomodate garbage trucks, delivery trucks and other heavy vehicles, $37,878. Following the discussion Council accepted the Engineer's report and dir- ected the Clerk Administrator to notify all four property owners involved and request a reply from them before May 8, 1981. Acting Mayor Brown informed Council that Fireman David Pearson has been FIREMAN notified that the electrocardiogram given in the course of his required D. PEARSON physical shows some abnormalities and the physician will not give final PHYSICAL approval for work as afire fighter until Fireman Pearson consults a REPORT cardiologist and has that physician's approval. Council directed the Clerk Administrator to advise Chief Renchin that Fireman Pearson is disqualified until complete medical approval is presented. Clerk Administrator Barnes informed Council that the proposed Amusement/ PROPOSED Admissions Tax Bill will be heard April 23, 1981 before the House Tax AMUSEMENT TAX Sub-committee, and requested Council's opinion on who should give the BILL TO BE presentation. After a discussion Council recommended that the Clerk HEARD 4/23/81 Administrator and Councilmember Larson (who is Legislative Liaison) work out a plan and jointly present the material. Clerk Administrator Barnes presented the First Quarter 1981 Municipal 1ST QUARTER Court Prosecution Report. Councilmember Eggert moved, seconded by PROSECUTOR'S Councilmember Brown, that the report be accepted as presented. Motion REPORT carried unanimously.
