Also present were Clerk Administrator Barnes, Attorney Allen and Engineer Lemberg. Councilmembdr ggert. Hoyt, and (2) Request for a street light in alley ADDED TO between:~Crawford and Larpenteur, Pascal to Holton. AGENDA Councilmember Larson moved, seconded by Councilmember Brown, that the Minutes of May 27, 1981 be approved as presented. Motion carried unani- mously. Attorney Allen noted that the heirs of a Gabriel Aguilar have filed a "Notice of Claim" against the Municipal Liquor Store under the Dram Shop Law. No further information was available. MINUTES OF 5/27/81 APPROVED NOTICE OF CLAIM FILID AGAINST LIQUO STORE Attorney Allen presented for Council's review a draft of a proposed raffle ordinance. The Clerk Administrator suggested that if the ordi- RAFFLE ORDI- nance is adopted publication be postponed until after August 1, 1981 NANCE DEFERRE: in order that only a summary need be published. The matter was deferred until a later meeting. Councilmember Steele moved, seconded by Councilmember Larson that the LIDO CAFE Lido Cafe On-Sale Liquor and Sunday Liquor Licenses be approved for the LIQUOR LICENS the period from: July 1, 1981 to June 30, 1982. Motion carried unanimously. APPROVED Clerk Administrator Barnes requested approval of a salary increase of ALAN BENOIT $50.00 per month for Liquor Store Clerk Alan Benoit (from $750.00 to SALARY IN- $800.00 per month). Mayor Warkentien moved, seconded by Councilmember CREASE Larson, that the increase be granted. Motion carried unanimously. APPROVED 1 MINUTES REGULAR CITY COUNCIL MEETING JUNE 10, 1981 PAGE 2 Clerk Administrator Barnes informed Council that he had attended a meeting LAKE OVERFLOL at Maplewood on June 8, 1981 regarding the lake overflow problem. As of UPDATE that meeting the legal costs to the suburban communities involved was $1,500 Falcon Heights will be obligated to pay 1.1% of the total. Engineer Lemberg explained he had attended a lake overflow meeting with the suburban engineers, Dan Dunford of the St. Paul Sewer Department and Mr. Foerster, representing the Metropolitan Waste Control Commission. Upon questioning Mr. Foerster he admitted that mistakes had been made in the over- flow report and there were lakes that did not have any overflow. Engineer Lemberg had then inquired as to which lakes and was informed that Como and McCarrons did not have any overflow and that Como Lake needs the run off water to keep the lake level up. The Waste Control Commission will now include Ramsey County in the study as the County does pump into some lakes. At 8:00 p.m. Mayor Warkentien opened the Public Hearing on vacation of the walkway between 1740 and 1746 Holton running through to Albert. Residents Mrs. H. G. Ewan, 1749 Albert, Mrs. John O'Keefe, 1743 Albert, Mr. and Mrs. T. A. Salminen, 1740 Holton, Paul Baehr, 1746 Holton and Hans Schirrmeister, 1779 Tatum were in attendance. Mayor Warkentien read the Affidavits of Posting and Publication aad the Notice of Public Hearing. Mayor Warkentien invited comments from the residents whereupon Mr. Salminen stated his opinion had been stated several times previously, Mrs. O'Keefe's letter objecting to establishing an alley was read, and Mr. Baehr stated he did not want the walkway used as a through alley. Some discussion followed regarding surfacing of the area as driveways and Attorney Allen stated that the vacation does not determine which way the property would go and only a court can make a sure opinion on the matter or the residents could work out the division among themselves. Following the discussion Councilmember Steele moved, seconded by Council- member Larson that Resolution 81-7 be adopted vacating the walkway between 1740 and 1746 Holton running through to Albert. Motion carried unanimously. RESOLUTION 81-7 A RESOLUTION VACATING THE WALKWAY EASEMENT FROM ALBERT TO HOLTON STREET i The Clerk Administrator was directed to file the Resolution with the County Auditor. Councilmember Steele informed Council that Mrs. Tyson, 1457 W. Hoyt, had contacted him regarding a recently planted::Hackberry tree which has not leafed out and exhibited a branch which Mrs. Tyson had given him. He felt that perhaps the tree is not dead but only slow to leaf out, as is common with that variety. Councilmember Steele suggested that the tree be checked to determine whether or not it is alive and have the City Horticulturist either write Mrs. Tyson or call on her personally and explain the slow sprouting process of the Hackberry variety. Council- member Steele inquired as to the state of the spring tree planting this year and was informed by Clerk Administrator Barnes that approximately 70 trees have been planted this spring and the approximate loss~of trees planted in 1980 is 10%. RESOLUTION 81-7 SPRING TREE PLANTING DISCUSSION MINUTES ~ REGULAR CITY COUNCIL MEETING JUNE 10, 1981 PAGE 3 Mayor Warkentien read a request for placement of a street light in the un- REQUEST FOR used alley between Crawford and Larpenteur, Pascal and Holton. The Cleric LIGHT IN Administrator informed that he had checked the area and there are existing ALLEY BETWEEN street lights at Pascal and Crawford and at Pascal and Larpenteur and he CRAWFORD & would not recommend the City placing an additional light. Following a LARPENTEUR, short discussion Council directed the Clerk Administrator to inform the PASCAL & residents that Council feels the area has sufficient light but the home- HOLTON owners could arrange to have Northern States Power install a security DENIED light at the expense of the homeowners. Ramsey County Engineer Kenneth Weltzin addressed Council regarding CHANGE ORDERS Change Orders 3 and 4 on the Roselawn Avenue Construction Project, 3 AND 4 ON which Change Orders were previously rejected by Council. Mr. Weltzin ROSELAWN AVE. explained that since Ramsey County had not charged the City for any CONSTRUCTION engineering fees (saving the City $14,230.50) and the cost of the City's PROJECT share of the total project was $11,000 less than anticipated, he did APPROVID not feel the County's request that Roseville and Falcon Heights assist in the payment of the costs involved in the necessary changes were un- reasonable. During the ensuing discussion both Councilmember Brown and Engineer Lemberg stated they had originally opposed payment of the additional $1,485.16 (for the Change Orders) on the principal of the matter (ie: the errors necessitating Change Orders 3 and 4 were County Engineering errors). Engineer Lemberg presented to Council the Feasibility Study Considering FEASIBILITY Existing Building Remodeling versus the Construction of a New Community STUDY ON Building and requested acceptance of the report. Councilmember Brown CITY HALL moved, seconded by Councilmember Larson, that the report be accented RENOVATION/ for study, an in depth discussion to be held at the first meeting in NEW CONSTRUCT July.
