T?avvkins Estate~R,osehill ?ursery has been cane ;lied. :Further, them are no other contractual arran~_Te,nerts to sell the p~~oport;r to ~'~merican Shelter Corporation at this time. The .state has not ?ermulated any future development plans for the property. Attorney Swanson advised that if the project were financed by general obligation bonds, under state lav: i.f 20 percent is assessed of the cost, i_t would. be necessary to levy a ta.x for the bal.a.nce of the debt sezYvi ce on the bonds. AT The special assessment income plus the tax levy e ach year should amount to S~~'•` 105 percent of the debt service each year. In levying a tax levy for the ~'I- issuance of the bonds, under state l.aw the tax levy ca.n be cancelled if' at C1E any time ad.~iti.c.;nal spocial assessments should be levied. If 20 percent OB of the total costs are levied up front, the balance could be deferrad as BO to other parcels that are benefitted. These sr~ecial assessments could be levs_ed at a later date either during the term of the bond issue er beyond if the bonds are retired. The reason for the tax levy throughout the City is that it is required by 1_avr if the bonds are issued in the manner suggested; that is, the general obligation bonds. Councilmember Cierni.a asked if the `":.350,000 connection costs to the City of St. Paul ?~:rould be reduced if only the City mall. and I~ewlett-Packard were connected. Engineer ~chunicht advised that it could ,e anproximatoly half the proposed crarges anc? that 'ne would contact St. "au1 regarding t he matter. Ciernia asked if the 13.567 mill is expected to remain unchanged for several years and Clerk Administrator Barnes advised that i_t would. he also asked if Hewlett-Packard w ould receive ary benefit from the storm sewer connection and he was advised that them vrould be a positive benef.i.t. Hewlett-Packard is in agreement with the project. Engineer Lemberg felt that this year tivoulc be a good construction year since bids 'rave come in 25 to 30 percent lower than anticipated. Due to the fact that state aid to cities has beer, cut seven percent and there vrill be further cuts not yet established, Clerk Administrator isarnes requested Council to autT_ori.ze him to advise staff that a thirteen percent cut will b e necessary ir, all exz~enditures--other than salaries--retoractive to January 1, 1982. This could affectr,urchase of equipment ~rrhich -as budgeted, cut backs on services, park motiving and general ecorom~zing. Councilmember Eggert was of the opinirn that the cuts mentioned ti^,~ ould pct amount to X60,000, the amount of possible state aid. reductions. Council- merlber Eggert also felt that any major items or services to be cut should be brought to the Council. P~Zayor ~':arkentien moved that the C1_erk Administrator be authorized to advise staff that there must be a thirteen percent cut in the 1.982 purchases and that this be cor_sidered an administrative procedure to be administered by him with the eyception of major items, particularly service iterls, which s'r~ould be brought to the Councils attention. All. major items vrill be shownen the consent agenda. Councilmember Larson. seconded the motion. rotior. carried unanimously. Councilmember Larson advised the Council of sire Chief Fenchin~s concern regarding the recent disturbance by the bystanders who vrere ~^ratchin~; the street reddens. The .Eire Chief ti:ould not have resronded unless it ti^yotald have been an accid.e-r~t, an injury or a fire becala.se they are neither equipped nor trained to handle a riot. He felt the .Eire Department would be in a very vulnerable nosi_tion because when the _fire trucks run out of v+rater, there would be no^ other r~^otecti on. Councilmember T,arson moved that the .{ire Department of the City of Falcon Heights not be required to respond tc a riot situation unless it was specifically .for a fire, an accident or injuries. Councilmember Ciernia seconded the'!<<otion. He also felt that the Ramsey County Sheriff should be asked what their rolicy is on requesting Fire Department support ~:or non-fire or rescue emergencies. Councilmember Ciernia asked Attorney Swanson if the police department could direct fire depa.ri;ment~ participation in certain circtunstances, and Attorney ;wanscn advised that the police ca.n direct citizen participation bu.t the police department has no jurisi.dcti_on to direct activities of the Fire Department and cannot require the }Fire Department to assist in maintaining law and order. Council. felt the request was hard to address be-,cause it is hard to sort out the activities of the Fire ~;epartmert. Councilmember Ciernia .felt that the Council should support written restrictions to be included-in the ~,ire~~epari-•rnent by-laws.
