HomeMy WebLinkAboutCCMin_83Jun22ssi MINUTES REGULAR CITY COUNCIL MEETING JUNE 22, 1983 A regular meeting of the Falcon Heights City Council was called to order at 7s30 P.M. by Mayor Warkentien. Mayor Warkentien, Councilmembers Ciernia, Chestovich, Eggert and Larson. Also present were Clerk Administrator Barnes, Attorney Van de North and Engineer Sehunicht. None. Mayor Warkentien moved, seconded by Councilmember Chestovich that the Consent Agenda b® approved as presented. Motion carried unanimously. 1. Mutual Aid Drill Reports (2) 2. Councilmember Chestovich moved, seconded b'9 Councilmember Larson, that the Minutes of June 8, 1983, be approved as presented. Motion carried unanimously. Engineer Schunicht presented the results of the bids received for the Falcon Woods No. 3 Utility and Street Improvements. He explained that nine bids were received and gave a tabulation of the five lowest bids as followss (1) Austin P. Keller Construction, $361~,1t61~.00, (2) Mueller Pipeliners $365,719.l~0, (3) Orfei & Sons, Ina., $3?2,22t~.33, (lt) Nordland Associates, Inc., $385,385.00, and (5) Northdale Construct- ion Company $107,367.50. He then explained that if Hewlett Packard does cot proceed with the purchase of the Hermes property, it xi11 be necessary to delete some of the ponding from the contract and for that reason he recommended that Council table awarding the bid until July 6 3.u order to allow additional discussions with Hewlett~ackard, Hermes and Austin Keller Construction. John Peterson, Good Value Hcmes, felt that prolonging the awarding of bide would be of no advantage as a change order could be made either before or after the bid is awarded. His organization is most amdous to have the pro3ect started as the Good Value development has already had several delays. Counoil discussed at length whether or not to schedule a special meeting the first week in July for finalizing the matter or to adopt a resolution awarding the bid to Austin Keller Corporation. KELLER CONSTRt~CTION THR CANTRACT FOR UTILITIES AND STRRRT Il~'ROVEMENTS SN FALCON WOODS N0. 3 AND ADJACENT PARCELS Attorney Yen de North informed Council that the agreement between the City and Bullseye Golf, Inc. has been signed by Dennis Hunt, the owner of Bu1lse~re and is now in force. Council discussed the contract for professional planning services of Howard Dahlgren Associates for the development/improvement oP the Larpenteur/welling area. After. reviewing the document, Mayr~r Warkentien asked if Don arittner, Chaixman of the Citiasns Advisory Committee, had aqy ob3ections to which Mr. Qrittner replied that he felt the agreement could cover Options A, B and C as previously discussed by Council and Bullseye. Attorney Yen de North recommended that in the termination clause of the agreement, there be a stipulation that at~y of the documents prepared during the term of the contract xould remdaia the property of the City. Counailmeaaber Larson moved, seconded by Council- member Eggert, that the contract be approved with the reccrmnended stipulation in the termination clause. Notion carried unanimously. Clerk Administrator Barnes presented information on radar for the squad car and re~aommended purchase of the same at a price of $883.25 to be paid from the squad car capital improvement fund. He ea~ained that the Deputies patrolling Falcon Heights are of the opinion that it would help reduce speedix~ on Larpenteur, Hemline, Cleveland, which have been problem areas so far as excessive speed is concerned. Council- merabers Eggert and Chestovich both expressed concern that the squad might be used only in certain areas (streets with speeding problems) and not for patrolling the entire City. Councilmember Cierni.a felt that if radar is used to alleviate the problem without being a detriment to the rest of the City he would not object to thepurchase. After further discussion, Mayor Wsrkeatien moved, seconded by Councilmember Eggert, that the Clerk Administrator be authori$ed tc> purchase the radar at a cost of $883.25, the amount to be taken from the squad car capital improveuent fund. Upon a vote being taken, the following voted in favor thereof: Mayor Warkentien, CounciLaeaabers Ciernia, B$gert and Larson, and the following voted against the same: CounciLnember Chestovich for the reason given above. Motion carried. Fiscal Consultant Chenoweth evcplaiaed proposed Resolution 83-20 s~alating to Municipal State Aid Bond repayment on the Albert Street Improvement. Ceuncilmember Chestovich indicated she was not comfortable adopting a resolution uh3.eh she has not reviewed and asked that the matter be deferred to the July 13th meeting. Clerk Administrator Barnes informed that the resolution was prepared by the City Engineer and the content would not be changed in re-typing, the only changes would be to show the motion, second and vote. Motion carried unanimously. RESOLUTION 83-20 RESOLUTION 83-2O ~~ i RESOLUTION REQUESTING THE COI~IiSSTONSR OF HIGHWAYS TO AUTHORIZB PAYMENT OF A PORTION OF BOND SAID IN THE AMOUNT OF $75,000.00, PRII~IPAL PLUS INTSRBST, FROM THE RI9GULAR CONSTRUCTION FUND FOR ABDERT STREET IN THE CITZ OF FALCON HEIGHTS 1 Fiscal Consultant Chenoweth presented the approximate amount of the FISCAL bond issue for improvements in Falaon Woods No. 3 and adjacent parcels CONSULTANT as between $125,000 and $1175,000, and recommended selling the bonds around August 1, 1983. He also stated that the City should act very soon on finalising the Tax Increment Financing Plan which will assist in paying off the bonds. Council discussed the June 1.l1, 1983 letter from James W. Maenner, Trust Real Estate Officer, First Bank Minneapolis, regarding settl®ent on the subdivision park dedication requirement imposed upon the Ch+erles Hawkins Estate on April 20, 1983. Discussion centered on the ~a]ue of the prnperty, who would pay for the appraisers to place a value oa the land, and the cost of an appraisal. CounciLmaaber Larson felt the land would not be easy to market since it has three different zones and a buQrer could not be assured that the City would approve a coning change if requested. Councilmember Cheatovich asked if the three appraiser+s names could be subrmi,tted and the cost of the appraisal split between the City and the Estate. Attorney Van de North informed that if the Estate ware forced tc> as appraisal, that the City would have to bear a portion of the burden of the appraisal. After further discussion, Councilme:mber Ciernia moved, seconded by Council- member Chestovich, that the Clerk Administrator present the names of three appraisers to the Estate and that the cost of the appraisal be negotiated, the City not to pay Hare than 5O percent. Upon a vote being taker:, the following voted in favor thereof: Councilmember$ Cieraia, Chestovich, Eggert and Larson, and the following voted against the same: Mayor Warksntien. Motion carried. Councilmember Ciernia reviswod previous discussions and action taken by Council and the Planning Commission in regard to the rezoning re- quest for the retaainder of the Hawkins property. He stated that the Planning Commission does not know how to deal with the present zoning on the property and they have requested Council guidance in the form of objective criteria on how to evaluate proposals for rezoning of the property. Council.member Giernia felt that it is Councills obligation to provide guidance and direction tc> the C~reaission. Councilmember Eggert stated that if the property is rezoned to B-lA, the City would lose control as long as the interested party conforms to B-].A but if the property is left in such a way that rezoning must be requested by the interested party, the City could set up specific requirements to be Pu1fi11ed in order to make the zoning change. Councilmember Larson felt the P1.anni.rzg Ganmission is trying to make good planning decisions and are be3.ng handicapped by not being given Council guidance. After a lengthy discussion, Mayor Warkentien suggested each Councilmember bring written recommendations for establishing criteria to discuss at the next Council meeting. Councilmember Cieraia commented on the Planning Commissionts concern PLANNING regarding their relationship to the Citizens Advisory Committee since COMl~SSION/ the Advisory Committee preferred to communicate with the Mayor rather ADFISORY than the Planning Commission. The Planning Commission feels they COMi~TTEE should be involved in the planning process and formal communications RELATIONSHIP since their charter is planning for the City. Don Grittner, Chairman of the Advisory Committee, stated the Committee felt that since the Mayor had appointed the Committee, communication should be through him, but had no objection to xorking with the Planning Commission and there was no intent tcf bypass thane. Mr. Grinner had discussed the matter xith the Planning Commission Chairman Al Stefanson. Mr. Grittner will furnish the Planning Commission minutes of a11. Advisory Committee meetings and h® also invited Mr. 3tefanson to attend at~,y of the meetings. Attorney Fan de North presented an update on the prnblems at 1722 UPDATE ON Pascal. The Prosecuting Attorney has requested photographs of the 1722 PASCAL conditions at that residence and specific license plate numbers oa PROBLEMS cars so that evidence can be assembled to prosecute the matter in court. Attorney Fan de North will contact the Prosecuting Attorney to determine a course of action. The Prosecutor's Statement for May, 1983 was noted. Councilmember PROSECUTORt3 Eggert suggested that future reports be included as part of the STA'PEMENT consent agenda and Council concurred. NOTED Couacilmember Ciernia reviewed history regarding the ~~bike trail~~ BII~E TRAIL on the vacant Falcon Heights Church lot. The Church, as well as ON CHIkiCH LOT neighboring residents are having problems with upkeep and have REF'FIiRED TO requested that the City consider sponsoring the track area as part .PARK & RBC. of the recreation program. Councilmeanber Ciernia recoamnended that COMMISSION the matter be referred to the Park and Recreation Commission for discussion. Cauncilmanber Larson inquired as to whether or not the City could use private property to which Attorney Fan de North replied that a contractual agreement would have to be developed. Clerk Administrator Barnes informed that there are approximately 20 20 TREES trees on the Good Falue property which must be removed or destroyed FROM GOOD and asked if Council would be interested in having the trees balled FALIJE and planted on City boulevards at a cost of about $50.00 per tree.
