REGULAR CITY COUNCIL MEETING
JUNE 28, 1978
A regular City Council meeting of the City of Falcon Heights
was called to order by Mayor Warkentien at 7:30 p.m.
Mayor Warkentien, .Councilmembers McGough, Steele and Brown
Also Present were Clerk Administrator Barnes, Attorney
John Kenefick and Engineer Brad Lemberg.
Councilmember Black was on vacation.
Alan Rolek, 2745 Fillmore, Minneapolis, was introduced to
Council, June 28, 1978 by Clerk Administrator Barnes as
the new bookkeeper hired for the City of Falcon Heights.
Mayor Warkentien moved, seconded by Councilmember McGough
to approve the employment application of Mr. Rolek at
$700 per month. Upon a vote being taken the following
voted "aye" Mayor Warkentien, Councilmembers McGough, Steele
and Brown and the following voted "nay": None. Motion
carried.
Councilmember McGough moved, seconded by Councilmember
Brown to approve the Consent Agenda as submitted. Upon
a vote being taken the following voted "aye": Mayor
Warkentien, Councilmembers McGough, Steele and Brown and
the following voted "nay: None. Motion carried.

Councilmember Steele moved, seconded by Councilmember Brown MINUTES OF
to approve the Minutes of June 14, 1978 as amended. Upon JUNE 14, 1978
a vote being taken the following voted "aye": Mayor Warkentien
Councilmembers McGough, Steele and Brown and the following
voted "nay": None. Motion carried.
Mayor Warkentien read and presented to Dr. A.J. Schwantes
a certificate of appreciation for serving on the Planning
Commission from January 14, 1966 to December 21, 1977.
Dr. Schwantes thanked the council for the certificate and
expressed his enjoyment in working with the City Council
in the past years.
Councilmember .Steele moved, seconded by Councilmember McGough
to authorize the Clerk Administrator to cancel check number
10959 dated December 30, 1977 in the amount of $180.00
payable to William H. Burke as a duplicate payment had
been made for reimbursement for tree removal. Upon a vote
being taken the following voted "aye": Mayor Warkentien,
Councilmembers McGough, Steele and Brown and the following
voted "nay": None. Motion carried.

Councilmember McGough moved, seconded by Councilmember
Steele to refer the Conditional Use request of Robert E.
Yahnke- 1776 Simpson to erect a utility shed on the rear
of his lot to the Planning Commission. Upon a vote being
taken the following voted "aye": Mayor Warkentien, Council-
members McGough, Steele and Brown and the following voted
"nay": None. Motion carried.
Mayor Warkentien presented for discussion the membership
dues of the Association of Metropolitan Municipalities. in
the amount of $801 per year, beginning June 1, 1978 thru
May 31, 1979, for the City of Falcon Heights. After
reasonable discussion, Clerk Administrator Barnes informed
council he had attended a meeting June 28, 1978 of the
membership and related that he has the support of the
members to lobby for a Bill to consider a state subsidy in
lieu of taxes for tax exempt property such as the State
Fairgrounds and the University Farm Campus which at the
present time the City of Falcon Heights does not receive.
It not only would benefit Falcon Heights, which is 2/3
of the area is tax exempt, but other communities with
tax exempt property. Clerk recommended we continue our
membership. Recommendation approved.
Mayor Warkentien moved, seconded by Councilmember Brown
to authorize the Clerk Administrator to submit the City
of Falcon Heights membership dues in the amount of $801
for the year starting June 1, 1978 thru May 31, 1979, to
continue our membership in the Association of Metropolitan
Municipalities. Upon a vote being taken the following
voted "aye": Mayor Warkentien, Councilmembers McGough,
Steele and Brown the following voted "nay": None. Motion
carried.
Council discussed the request of Mr. James Rutzick, owner
and operator of Roc-A-Fellas, Inc. at 1543 Larpenteur
Avenue to permit them to designate a smoking and light
refreshment area in their place of business so that
they can requlate these activities more readily than is
the case now, as patrons must go out doors. A letter
from Capt. Spencer of the Ramsey County Sheriff's Dept.
was read indicating if council permitted the indoor area,
it would cause less congestion outside the place.
Councilmember McGough moved, seconded by Councilmember
Brown to authorize Mr. James Rutzick to set aside a
designated area for smoking and light refreshments. Upon
a vote being taken the following voted "aye": Mayor
Warkentien, Councilmembers McGough and Brown and the
following voted "nay": Councilmember Steele. Motion
carried.

Mr. ~ Mrs. John Webster, 1850 N. Snelling Drive
appeared before council and requested the council take
some action against their neighbor at 1860 North Snelling
Drive, namely the Stanley Rydell's. Attorney Kenefick
reviewed with council the Webster's problem with their
neighbor and recommended the council permit him to write
a letter to the Rydell's that this type of conduct is in
violation of the City nuisance ordinance and state statute
and if this doesn't cause the harassment to stop, he
would advise the Webster's to sign complaints. A lengthly
discussion was held in regards to the problem. The council
suggested the request be referred to the Human Rights
Commission for investigation to determine whether it falls
in the commissions jurisdiction or is a civil matter for
the Webster's to determine what action they desire to take.

Councilmember Brown suggested to council the city should CITY NEWS-
put a newsletter together for citizens on a quarterly or LETTER
monthly basis and questioned whether we should hire some-
one to deliver them. Clerk Administrator Barnes will put
together a cost proposal for the council to review.
Council discussed the ambulance request of the Fire
Department to operate an ambulance in the City. It is
required to publish the fact that the City is applying
for a license.
Mayor Warkentien moved the City not apply for the
ambulance license. Motion died for lack of a second.
Terry Iverson from the Fire Department appeared before
council and answered questions in respect to ambulance
operation costs and the license application and the
Fire Departments desire for~an ambulance in relation to
better services.
Mayor Warkentien stipulated he felt the services we now
give are adequate at the present time.
Councilmember McGough moved, seconded by Councilmember
Steele to authorize the Fire Chief to publish the notice
of the City Falcon Heights intent to apply for an
ambulance license, but not approval of purchase of an
ambulance. Upon a vote being taken the following voted
"aye": Mayor Warkentien, Councilmembers McGough, Steele
and Brown and the following voted "nay": None. Motion
carried.

Councilmember McGough reported on the refuse container COHEN
built behind the buildings on Cohen property, 1550 West PROPERTY
Larpenteur. Councilmember McGough stated it is of REFUSE
sound construction, but is not appealing. Atty Kenefick CONTAINER
was requested to check the container to determine if
Mr. Cohen had violated any ordinances.
Engineer Lemberg informed council he checked the washout FOLLWELL
on Folwell caused by the last rain fall. The cave in BLVD. WASH-
was due to a broken culvert. He suggested the University OUT
should be responsible for the construction of the line and
repair it at their cost.
Engineer Lemberg also reviewed with council the drainage DRAINAGE
problem at Hollywood Court. He maintains the drainage PROBLEM -
from the Grain Terminal parking lot is creating to great HOLLYWOOD
a drainage flow, thereby creating flooding problems. He COURT
suggests we discuss the problem with GTA and also the
need of the St Anthony Storm Drainage project.
Councilmember Brown suggested .the council authorize a FLOATING
floating holiday for City employees for one day a year HOLIDAY
subject to approval of the Clerk Administrator. AUTHORIZATION
Councilmember Brown moved, seconded by Councilmember.
Steele to approve a floating holiday for all full time
employees... Upon a vote being taken the following voted
"aye": Mayor Warkentien, Councilmembers McGough, Steele
and Brown and the following voted "nay": None. Motion
carried..
Councilmember Steele moved, seconded by Mayor Warkentien ADJOURNMENT
to adjourn at 9:58 p. m. Upon a vote being taken the
following voted "aye": Mayor Warkentien, Coucilmembers
McGough, Steele and Brown and the following voted "nay":
None. Motion carried.
