Mayor Warkentien, Councilmeanbers Black, McGough, Steele and Brown. Also present were Clerk Administrator Barnes, Attorney Kenefick and Engineer Lemberg. None. Councilmember McGough moved, seconded by Councilmember Black to approve the Consent Agenda as follows: 1. Fire & Rescue Reports 7$ thru 82 2. Ramsey ..County Sheriff Report - July 3. Mr. Bob Scarlett, Representative of the Public safety Dept., Metropolitan Council, presented an informational slide presentation regarding the 911 Emerger~y Radio System. In Minnesota, eleven Cities have implemented the 911 sFstem. The 1977 legislature enacted a law requiring implementation of the 911 service in the Metro area by 1982. Accord- ing to the financing recommendations discussed, the monthly charges for the answering point equipment, located most likely, with the Ramsey County Sheriff's Department for Falcon Heights, would be paid for by the unit of govexrmnent that operates the local communications center. The installation charges are capital items and the committee recommends that 9096 of the total of these charges be paid for with State or Federal assistance. Mayor Warkentiea thanked Mr. Scarlett for his time and presentation. Councilmember McGough moved, seconded by Councilmember Brown to MINUTES OF approve the Minutes of August 9, 1978 as amended. Upon a vote being taken the following voted "aye": Mayor Warkentien, Councilorembers Black, McGough, Steele and Brown and the following voted 'nay": None. Motion carried. 12~ ELECTION JUDGES (coat.) Clerk Administrator Barnes submitted for discussion a tree removal KENNETH request received from Kenneth Liedholm, 1700 N. Albert. Council LIEDHOLM TREE action on August q, 1978, granted an 80~ reimbursement based on REIMBUR"~ T $264.00 and extended time to remove the tree. Mr. Liedholm pre- sented a bill in the amount of $532.00 for tree removal. After lengthly discussion, Counciloreorber Steele moved, seconded by Councilmember Black to approve payment, 80% bf $532.00 for tree removal. Clerk Administrator Barnes requested council direct3oa regarding licenses for Falcon Heights Animal Hospital and Falcon Heights Drug, .Cigarette License. Neither license has been applied for. Attorney Kenefick noted h® had been in contact with Mr. Lowell Anderson, Falcon Heights Drug, and had informed him of state statutes pertaining to sale of cigarettes. Council directed Attorney Kenefick to contact the two parties and advise them to apply for their licenses. Engineer Brad Lemberg reported the Findings of the tree surrrey. There were a total of 137 boulevard trees, 76 on the property line and 67 within 1~' of the property line. Rep. Walter Hanson appeared before Council. regarding the Diseased Shade Tree. Program. Residents of Falcon Heights had brought to his attention concern regarding the tree removal plan, in partic- ular those trees located on boulevards. It was the understanding of Rep, Hanson that Falcon Heights had considered certain trees to be "city" trees or boulevard trees, even though some are located on private propertyr or on the property line. Council discussed several problems in the tree removal program and concern was ex- pressed regarding finances of the homeowner and the City of Falcon Heights. Rep. Hanson offered his assistance in providing legislation to ease some of the financial burden of Cities such as Falcon Heights which have a limited talc base. Mayor Warkentien thanked Rep. Clerk Administrator Barnes informed Council a letter of appreciation had been sent in their behalf and that the Council would use the funds for park equipment. Councilmember McGough briefed Council on the damaged storm sewer FULHAI~/FOLWELL at Fulham and Folwell. The storm sewer starts i.n Falcon Heights b'TOItM SEWEEt and ends in Lauderdale, Mr. S~nith~s property abuts the end of the sewer. line, but Lauderdale apparently does not have an ease- ment to the groperty. Th have surrendered the easement, which means we can not go in a"epair the storm sewer without his per- mission, even thongb the lice begins in Falcon Heights. Last spring Mr. 5mi.th threatened to sue Falcon Heights and Lauderdale for water damage because of the break in the line, however, he refuses to allow atayone on his groperty. Councilmember McGough suggested we contact Lauderdale and inform them we will repair the line if they can obtain a germanent easement from him at their expense. Part of the problem suns from the removal of a pine tree. The tree that would have to be removed does not belong to him, nor is it on his property. He states the tree has sentimental value as it was planted by a neighbor boy now deceased. Council directed Attorney Kenefick to contact John Dean, Lauderdale City Attorney, and come up with a workable solution. Eng~.neer Lemberg reported he had met with Clerk Administrator HFkILITT PACKARD Barnes and Mr. Fred Harvey, Facilities Manager of Hewl.itt- Packard. They are going to provide a complete layout of the land, showing parking lots, etc. There will have to be rezoning for that area as they are purchasing parts of tracts which are zoned differently. lhey will return in two weeks with a complete layout for consideration. Bngizteer Lemberg reported he had talked with Mr. & Mrs. Steven ROSELAWN Brandt, 1592 Roselawn Avenue, regarding the temporary easement re- EASEMENT - quired for the bike/walkway. They have stated they do not want BRANDY PROPERTY the bike/walkway on Roselawn. They were afraid their property would go down in valu®. It is possible to change the grade and sloping and not touch their property at all, iF the City would like to continue with the bike/walkway plans proposed in the upgrading of Roselawn Avenue. Engineer Lemberg stated he had given Clerk Administrator Barnes a ZONING MAPS draft copy of the zoning maps. Printing of the maps will be held pending possible changes is zoning in regard to the Haiwlitt-Packard proposal and suggestions by the City Planning Consultant. Copies of the zoning maps will be made available for the Planning Commis- ion~s use. Councilmeaaber McGough reported that $110,000 had been budgeted for TREE PROGRAM the Tree Program in 1977, we spent $511, 7611.011. Clerk Administrator MONEY ~i'NT Barnes applied to the State for reimbursement and received a check in the amount of $8,593.56, leaving a balance of $1a5,520.1~8 spent in the 197? program, which was still over the budget. Councilmemlber McGough stated he had talked with Phil & Gloria Meyer, TATUM STREET who purchased the Labalestra home at Larpenteur and Tatum. If the request is granted Mr. Meyer, it would provide a location for the dirt removed from the park area set aaide for the healing in of trees. Request granted. Councilmember Brown stated she had received three printing cost bids for the printing of 2,500 newsletters. The prices do not include t~-pi~ng, mailing or delivery. For 2,500 newsletters Malone Graphics quoted $157,00, E. W. Honza - $99.75, colored would be ~5 to $10 more, Midwest Quick Print quoted $92.50. Councilmember Brown stated she would pull it together, however, someone else would have to do the typing. Publishing was scheduled for January, 1979. Councilmember Steele discussed with Council suggestiona made by the Park Development Committee. Attorney Kenefick was questioned as to legalities pertaining to citizens being asked to set up a small trust account for Park Development, also, what liability insurance coverage would be needed in the event a wading pool is installed in the park. Attorney Kenefick stated-that the City's present insurance policy would cover any liabilities. Also, Councilmember Steele questioned whether we are obligated to install special equipment for the handicapped in our parks and access to the park building. Engineer Lemberg was requested to check on building accessability. Beep-ball teams are now using the park during the summer. Attorney Kenefick will check probate laws regarding trust funds for Park Development. ~~ TATUM STREET CULVERT {cont.) ~~~ 7~~ PARK DEVELOPMENT Clerk Administrator Barnes requested Council set a public hearing DELINQUENT for delinquent sanitary sewer charges on September 27, 1978 at SANITARY BEWER B:OO P.M.. Mayor Warkentien moved, seconded by Councilmember H1ack. Clerk :Administrator Barnes reported the City of Falcon Heights was re3ected for the application of a Sma11 Cities Grant to help in our storm sewer program. The City's qualification was not high enough, it was 29th on the list. Tabled to Member 13, 1978.. Mayor Warkentien read a notice from AMM regarding the Dept. of Human Resources. They will continue for another year worki.og with the Metro Council on reducing the cost of housing through $oning, by proposing smaller lots.
