Also present were Clerk Administrator Barnes, Attorney Kenefick and Engineer Lemberg. None. Councilmember Brown moved, seconded by Councilmember Steele to accept the consent agenda as presented. Motion carried unanimously. Engineer Lemberg reported on the bid opening for Sealcoating east of RESOLUTION Snelling and the Garden Avenue Improvement Project. Councilmember Steele 79-17 moved, seconded by Mayor Warkentien to adopt Resolution 79-17, accepting the bid from Black Top Service Co, Burnsville, Mn. at a cost of $214,696.52 Motion carried unanimously. RESOLUTION N0. 79-17 A RESOLUTION AWARDING THE 1979 SEALCOATING AND GARDEN AVENUE STREET IMPROVEMENT (MSAP 124-105-02) Engineer Lemberg informed Council that he had met with Councilmember McGough and ~larold Nilsen of the Planning Commission in regard to finding a way of providing storm sewer drainage for the northwest area of the City other than going through the University of Minnesota to the St. Anthony Storm Relief System. Councilmember McGough explained that the Comprehensive Plan bein; pr.cpared by the Planning Commission required that the City show a feasible way to complete the storm sewer system in~Falcon Heights. `!'he possibility of bringing the drainage down Larpenteur Ave., crossing just south o1. Hollywood Court, draining into the Idaho-Snelling pond, and installing a lift station was discussed. Councilmember McGough moved, seconded by Councilmember Kurpiewski, that Engineer Lemberg prepare a feasib.il.ity study for a storm sewer for the northwest corner of the City. 'notion carried unanimously. 52 MINUTES OF JUNE 13, 1979 APPROVED NORTHWEST AREA STORM DRAINAGE DISCUSSION Fire Ch:i~•S, :ferry Renchin, appeared before Council to answer some questions AMBULANCE regardin;~~;.~~~scue charges. DISCUSSION (cont.) Fire Ch=ief [tenchin informed Council that the Fire Department would like permission from the Council to respond to calls from their own fire fighters within a two mile radius of City Hall. The reason for this request was due to the fact that 50% of the firemen live outside the City of Falcon IIeights and feel they would like to be serviced by Falcon Heights. Council- member Steele moved, seconded by Cou~ci-lmember McGough, that the Fire and Rescue Department be allowed to go out of the City within a two mile radius of the Fire Station to handle calls for their own personnel and the immediate families of the personnel, without charge and without the Rescue Personnel charging for their services. Motion carried unanimously. Michelle Foster and Pat llady of Rauenhorst Corporation and Fred Harvey of Hewlett-Packard Corporation appeared before Council requesting a building permit for the Hewlett-Packard Building to be built at 2025 W. Larpenteur. Council was informed that the residents adjacent to the property had been provided with plans showing the building and landscaping, and a question- naire regarding the proposed building in order that the residents could have some input. Several completed questionnaires indicated some concern over the proposed automotive service center which is to be included in the building. HEWLETT-PACKARD, APPLIES FOR BUILDING PERMIT Fred Harvey of Hewlett-Packard explained that Hewlett-Packard had recently decided to install service centers in their buildings in order to expedite maintenance of company cars and felt the center would not cause any problems for the nearby neighbors. Gordon Pollard, 1957 W. Larpenteur, expressed concern over drainage and the GORDON POLLARD screening of the parking lot adjacent to his property. This matter is to 1957 W. be worked out between Mr. Pollard and Hewlett-Packard. LARPENTEUR Councilmember McGough stated he felt the concerned citizens should have an opportunity for discussion of the service center since it was not part of the original plan. Councilmember McGough moved, seconded by Councilmember Steele that Hewlett- Packard Corp. be issued a building permit for the original building plan, excluding the service garage addendum. Motion carried unanimously. Councilmember McGough moved, seconded by Councilmember Brown that the proposed service center addendum to the Hewlett-Packard Building be heard at a public hearing to be held at the Regular City Council Meeting of July 11, 1979. Motion carried unanimously. Fred Kueppers, attorney for Mr. and Mrs. Norbert I-Iermes, addressed Council FIRE LANE AT regarding the Fire Lane at 1607 W. Larpenteur (Bullseye). Mr. Kueppers 1607 W. reviewed Council's past actions in determining the Fire Lane, signing, and LARPENTEUR parking and requested Council to permit the Fire Lane to be returned to (BULLSEYE) the original plan providing the lane next to the building and along Larpenteur Avenue. Attorney Kueppers informed Council that Mr. and Mrs. Hermes understand that wherever the Fire Lanes are they must be kept free of snow at their expense, even if it means hauling it away, as they under- stand can be a possibility in the event of heavy snowfall. Upon a vote being taken (cont.) the following voted "aye": Mayor Warkentien, Councilmembers Kurpiewski, Steele and Brown, and the following voted "nay": Councilmember McGough. Motion carried. After a discussion by Council, Councilmember Steele moved, seconded by Councilmember Kurpiewski, that the lane could be placed as was originally planned, next to the Bullseye Golf Building and along Larpenteur Ave. with the following exceptions: 1. That the two northwest and southwest parking spaces be eliminated. 2. That the signs posted on the building be relocated at a more visable height for motorists and possibly more signs. 3. That at a future date the possibility of closing off the entrance located on the south portion of Lot 11 of the Crossroads (which is an easement) be considered. Upon a vote being taken the following voted "aye": Mayor Warkentien, Council- members Kurpiewski, Steele and Brown and the following voted "nay": Council- member McGough. Motion carried. Bill Huebsch, 1494 Iowa Avenue, who works with the Youth Hockey Program, ICE TIME TO requested permission for Clerk Administrator Barnes to request ice time BE REQUESTED at the Oscar Johnson Arena for the 1979-1980 season. Councilmember Brown moved, seconded by Councilmember Kurpiewski, to authorize the Clerk Admini~ strator to request 28 hours ice time at Oscar Johnson Arena. Motion carried unanimously. Ramsey County Sheriff, Charles Zacharias, addressed Council explaining that RAMSEY COUNTY due to increased gasoline costs it is necessary to charge contractual cities SHERIFF 23~ per mile rather than 20~ as was stated in the contract. Sheriff ZACHARIAS L~-~harias feels the increase is justified and is not in conflict with the contract. Council felt the proposed increase would be in conflict with the contract and that if this increase is allowed, futher increases might follow. Attorney Kenefick informed Council .the prices set forth in the contract are to remain as is until the end of the year, when the contract can then be re-negotiated. The matter was deferred until the July 11, 1979 meetinry in order that Attorney Kenefick might further investigate the contract and also to contact the Ramsey County Attorney. Councilmember McGough requested the Sheriff's Department provide the City with a more detailed description of the police activity in Falcon Heights. Sheriff 7..ackarias agreed to provide the City with the requested information. Clerk Acl~r~inistrator Barnes requested permission to sell 50' of 12" used fire USED FIRE HOSE hose. Councilmember McGough moved, seconded by Councilmember Kurpiewski, to SOLD authorir~.~ the Clerk Administrator to sell 50' of 12" used fire hose to Larson Construct:i_on. Co. at a price of $20.00. Motion carried unanimously. Clerk Administrator Barnes brought Council up to date on the retirement of GEORGE George tn'i_I_lkom, Liquor Store Manager. Clerk Administrator Barnes read a request from Joelle Runkle, 1498 W. California, to close one block of California from Arona to Pascal, on July 8, .1.979 from 4-9 p.m. for a block party. Councilmember McGough moved, seconded by Councilmember Kurpiewski to allow the residents of that areal to close California from Arona to Pascal, July 8, 1979, from 4-9 p.m. for. a block party. Motion carried unanimously. Attorney Kenefick presented for Council's approval Ordinance 4164, prohibiting, drinking in parking lots and public places. Motion carried unanimously. Attorney Kenefick also presented a proposed ordinance to update the existing animal control ordinance. Council requested that Attorney Kenefick rewrite the ordinance to be considered at a later meeting. r' c.~ ORDINANCE 164 PROHIBITING DRINKING IN PARKING LOTS Mayor Warkentien read to Council a letter of resignation from Council- COUNCILMEMBER member Kurpiewski, who is moving out of the community. Mayor Warkentien KURPIEWSKI moved, seconded by Councilmember Steele, to accept the resignation as of RESIGNS June 30, 1979. Upon a vote being taken the following voted "aye": Mayor Warkentien, Councilmembers McGough, Steele and Brown, and the following voted "nay": None. Councilmember Kurpiewski abstained. Motion. carried... Councilmember Steele informed that, in his opinion, the vacancy created should be filled by a representative of Precinct 2 and that the individual should be some one who is not intending to seek office in the November election. Councilmember Steele moved, seconded by Mayor Warkentien, that Charles P. Stone, 1375 W. Idaho, be appointed Councilmember to fill the vacancy caused by Councilmember Kurpiewski's resignation. Motion carried unanimously. Councilmember McGough moved, seconded by Councilmember Kurpiewski, to extend the meeting to 11:15 p.m. Councilmember McGough informed Council that Lido Cafe is interested in moving and would like to build a new building to be financed by in- dustrial revenue bonds. The property to be used would also require rezoning. - , _. __-_ Councilmember Steele moved, seconded by Councilmember McGough, that upon receipt of the request of rezoning the matter be referred to the Planning Commission.
