REGULAR CITY COUNCIL MEETING
NOVEMBER 28, 1979
A regular meeting of the Falcon heights City Council was called to
order at 7:30 p.m. by Mayor Warkentien.
Mayor Warkentien, Councilmembers :;rown and Stone. Also present PRESENT
was Clerk Administrator Barnes.
None. Councilmember Steele arrived rit 7:3R p.m. ABSENT
Councilmember Stone moved, seconded by Councilmember Brown that the CONSENT AGENDA
Consent Agenda be approved as corrected. Motion carried unanimously. APPROVED

Councilmember Brown moved, seconded by Councilmember Stone to approve the MINUTES OF
Minutes of November 7, 1979 as presented. Motion carried unanimously. NOV. 7, 1979
Mayor Warkentien read & request from the Human Rights Commission asking DOROTHY BARNEY
that Dorothy Barney be authorized to attend a seminar on the handicapped TO ATTEND
in Rochester, Minnesota, on behalf of the Human Rights Commission - the HANDICAPPED
cost to be $10.00 for registration plus mileage and meals, if any. Council- SEMINAR
member Brown moved, seconded by Mayor Warkentien that the request be granted.
Motion carried unanimously.

STEELE ARRIVES
Clerk Administrator Barnes informed Council that the warranty has expired
on the IBM typewriter in the City Office and that after checking into SERVICE AGREE-
the matter he felt it would be wise to enter into a service agreement with MENT ON IBM

for a one year period at a cost of $71.50. Motion carried unanimously.

Mayor Warkentien informed Council that approval of the 911 Emergency 911 EMERGENCY

Heights does not respond,.the City's share of the cost would no doubt
be added to the policing contract price. After considerable dis-
cussion Councilmember Steele moved, seconded by Councilmember Stone
that a representative of the Ramsey County 911 Planning Committee
(preferably Don Salverda) be invited to the December 12th Council
Meeting to discuss the matter. Motion carried unanimously. '•
Clerk Administrator Barnes informed Council that Metro Council is re- DELAY TO BE
questing Falcon Heights state a position on the Cable Service Territory ~ REQUESTED ON
but that some communities have asked for a delay. Councilmember Steele CABLE TV
moved, seconded by Councilmember Brown that the Clerk Administrator be DECISION
authorized to request that Falcon Heights be given a delay in making
a decision on the matter. Motion carried unanimously.
Clerk Administrator Barnes asked Council's opinion on the possibility
of changing the December 26th Council Meeting date to December 27,
1979. Motion carried unanimously.
Councilmember Steele moved, seconded by Councilmember Stone that the
meeting scheduled for December 12tYi be changed to December 13, 1979
in order that all members can be present to hear the 911 Emergency
Telephone Service presentation. Motion carried unanimously.
Kenneth J. Wielinski, 1811 Arona, informed Council that the insurance
company for Blacktop Service had contacted him and they will take care
of damage done to his home during the Garden Avenue Project. Mr.
Wielinski also stated that in repairing his driveway the contractor
did not use a fine mix of asphalt (as requested by Engineer Lemberg)
thus causing a rough area on the driveway. Engineer Lemberg had
advised Mr. Wielinski that the matter would be corrected in the spring
of 1980.
Mayor Warkentien reported to Council that he and Engineer Lemberg had
met with Charles Smith,,1605 Fulham, Lauderdale, and that Mr. Smith
has agreed to give Lauderdale a construction easement on his property
in order that the damaged drainage tiles might be repaired.
Clerk Administrator Barnes reported on the Levy Limits Task Force
Committee and suggested that the Councilmembers attend the Metro Area
Levy Limits Meeting to be held on January 9, 1980. At that time a
total presentation will be given regarding the information to be sub-
mitted to the State Legislature.

Mayor Warkentien read a letter from the Northwest Suburban Youth NW SUBURBAN
Service Bureau informing that 5 special education persons from Mounds YOUTH SERVICE
View High School had written various communities asking further support BUREAU
for the Bureau. The teachers apparently did not know that Falcon
Heights had already exceeded the support requested by. the Bureau, and
the City should disregard the request for additional funds.

Clerk Administrator Barnes recommended to Council that Paul Ciernia,
Human Rights Chairperson, be authorized to attend a meeting sponsored
by the Minnesota Deaprtment of_ human Rights regarding the No Fault
Grievance Process. Marion Pocker, representing the Falcon Heights
Human Rights Commission, explained that Paul Ciernia would attend the
meeting to find what is actually involved and if it seems reasonable
to go ahead, other Human Rights Members could volunteer for training
(with Council's approval). Council agreed that Mr. Ciernia should
attend ttie meeting and report back to Council.
Mayor Warkentien informed Council that Attorney Kenefick advised that
he could see no difficulty if the City of Falcon Heights should charge
policing services to the liquor store, providing accurate records are
kept so there would be substantiation if there should be questions
later on. Mayor Warkentien, moved, seconded by Councilmember Steele
that the Clerk Administrator be directed to secure adequate costs of
police protection for the Municipal Liquor Store and that these costs
be charged against the Municipal Liquor Store. Motion carried unani-
mously.

Councilmember Steele expressed concern that the City might be liable WATER PRESSURE

Councilmember Steele inquired about the portion of the Human Rights SECTION 8

Housing which might possibly delay assistance to others in Falcon
Heights who are in need. Marion Pocker agreed that it was a reason-
able concern and that further information should be obtained.
Councilmember Steele moved, seconded by Councilmember Brown that the ADJOURNMENT
meeting be adjourned at 8:58 p.m. Motion carried unanimously.
