HomeMy WebLinkAboutCCMin_80Jul16_SpecialMINUTES SPECIAL CITY COUNCIL MEETING JULY 16, 1980 A special meeting of the Falcon Heights City Council was called to order ~~ by Mayor Warkentien at 7:30 p.m. Mayor Warkentien, Councilmembers Steele, Brown, Eggert and Larson. Also PRESENT present were Clerk Administrator Barnes, Attorney Kenefick and Engineer Lemberg. None. ABSENT Councilmember Brown moved, seconded by Councilmember Larson that the CONSENT AGEND?. New Brighton, MN [1 Councilmember Larson moved, seconded by Councilmember Steele that the MINUTES OF Minutes of June 25, 1980 be approved as presented. Upon a vote being JUNE 25, 1980 taken the following voted aye: Mayor Warkentien, Councilmembers Steele APPROVED and Larson and the following voted "nay": None. Councilmembers Brown and Eggert abstained. Motion carried. Mrs. Henry Panowitsch was in attendance requesting a variance of 2~' to build an addition to the existing garage. They had attended the Planning Commission Meeting on July 7, 1980 and at that time the Com- mission voted 4 to 2 that a variance was not necessary. However, due to some confusion as to whether or not a variance is needed the matter was presented to Council. After some discussion Councilmember Larson moved, seconded by Councilmember Brown that a variance be granted allow- ing an addition to the garage 5' from the lot line rather than the re- quired 7'~'. Motion carried unanimously. Paul Ciernia, Human Rights Chairman, introduced Chris Unander represent- ing the Commonwealth Terrace Public Relations Committee. He had re- quested that Ms. Unander present to Council information regarding the VARIANCE GRANTED FOR PANOWITSCH 1907 N. She P g p j gave a brief .history and general COMMONWEALTH information on the management of the Cooperative which has been in TERRACE (cont. operation for 10 years as a Student Management Cooperative). She indicated the Terrace's willingness to cooperate with the City of Falcon Heights and a desire to be a working part of the community. Some discussion was held regarding the number of International Students living in Commonwealth Terrace and the number receiving Section 8 Rent Assistance. Councilmember Steele stated that he felt a percentage of the housing units should be made available for United States citizens based on the percentage of foreign and U. S. students attending the University. Mrs. Thomas Barron, 1905 Arona, was in attendance to request a conditional CONDITIONAL use permit to construct a swimming pool on her property. Engineer Lemberg USE - SWIMMING quoted Ordinace 465 which states that swimming pools will be considered POOL - THOMAS special fixtures and that no swimming pool shall be installed without BARRON, 1905 application to the City Council. Based on the information provided the ARONA Engineer recommended that Council approve the request with the understand- ing that a 6' fence be constructed around the pool and that the plumbing inspector conduct inspections during and after construction. Councilmember Steele moved, seconded by Councilmember Eggert that the conditional use requested by Mrs. Barron be approved subject to plumbing inspection and the erection of a b' wooden fence. Motion carried unani- I mously. John J. Welsch, 1915 Arona, who is a neighbor of the Barrons, presented POOL REQUEST a request to construct a swimming pool at the same time as the Barrons. FROM JOHN Even though the Planning Commission refused to act on the Barron pool WELSCH TO request, the consensus of opinion was that the Welsch application should PLANNING first be presented to the Planning Commission with the proper drawings COMMISSION and neighbor's consent. Thomas Creighton of the firm of LeFevere, Lefler, Pearson_ O'Brien and CABLE TV Drawz, who has been hired by the City of Roseville to organize the North DISCUSSION Suburban Cable Territory and set up the Joint Powers Commission, was present to answer any questions regarding those subjects. Councilmember Eggert informed Council that it was the conclusion of the Citizens Advisory Cable TV Committee that if Cable TV is to be con- sidered for Falcon Heights that joining the North Suburban Territory would give the City the most input into the franchising process. He also indicated that the City-wide Cable TV Survey showed the most interest in home box office and educational programming. During further review on the franchising process and the North Suburban Joint Powers Agreemern Mr. Creighton explained that communities will eventually be reimbursed for expenses incurred during the organization and franchising process. He also assured Council that the Joint Powers Commission will be answerable to the communities involved. A RESOLUTION AUTHORIZING PARTICIPATION IN THE NORTH SUBURBAN CABLE COMMISSION Included in the Resolution is the appointment of Councilmember Eggert as Director and Councilmember Steele as Alternate Director. Upon a vote being taken the Resolution was adopted unanimously. Attorney Kenefick presented Resolution 80-18 which he had drafted for Council's consideration. After a short discussion Mayor Warkentien moved, seconded by Councilmember Steele that Resolution 80-18 be adopted. A RESOLUTION PROPOSING AN 8% INCREASE OVER THE RESOLUTION BASE AUTHORIZED BY PRIOR LAW AND AN ADDITIONAL 80-18 PROPOSEI 10% ONE TIME INCREASE AUTHORIZED BY LAWS, 1980, LEVY LIMIT CHAPTER 607, ACTICLE II, SECTION 21 INCREASE Upon a vote being taken the following voted "aye": Mayor Warkentien, Councilmembers Steele, Brown, Eggert and Larson, and the following voted "nay": None. Motion carried. Mayor Warkentien presented for Council's approval the following Fire BROUILLETTE & Department applicants: ZUST JOIN ' FIRE DEPT. 1. Steven A. Brouillette, 1710 W. Larpenteur, Falcon Heights 2. Jeffrey L. Zust, 2026 Brewster, Apt. 2, St. Paul Councilmember Brown moved, seconded by Councilmember Larson, that both of the applicants be approved subject to completion of a physical and the 1 year probation period. Motion carried unanimously. Mayor Warkentien read a request from the Mayors of Brooklyn Park and REQUEST FOR Eagan requesting financial support on drafting a drug paraphernalia FUNDS FOR ordinance. Councilmember Eggert moved, seconded by Mayor Warkentien DRUG PARAPHER- that the matter be referred to the City Attorney for his opinion. NALIA ORD. Motion carried unanimously. REFERRED TO ATTORNEY Mayor Warkentien presented for approval a request to authorize payment of $40.00 to Shirley Sethna, 2147 Hoyt, to cover reimbursement of the $40.00 PAYMENT non-resident fee paid to the City of Roseville for enrollment of her TO SETHNA son in the Roseville Mentally Retarded Day Camp. Council had previous- FOR RETARDED ly agreed that rather than donating a sum of money to the Roseville DAY CAMP FEE Day Camp any financial assistance to Falcon Heights citizens would be considered on an individual basis. Mayor Warkentien moved, seconded by Councilmember Steele that the payment of $40.00 be authorized. Motion carried unanimously. Engineer Lemberg informed that he had on several occasions checked the ALLAN MARTIN ~ driveway at the Allan Martin residence (1802 Arona) which was not re- DRIVEWAY MINUTES SPECIAL CITY COUNCIL MEETING JULY 16, 1980 PAGE 5 paired to Mr. Martin's satisfaction following the Garden Avenue Im- provement Project. The Engineer had contacted Black Top Service, the contractor in charge of the Garden Avenue Project, and was quoted a price of $792.00 to repair the driveway. It was Mr. Lemberg's suggestion that Mr. Martin share in the cost of the repair (50%). Councilmember Steele moved, seconded by Mayor Warkentien that the Engineer be author- ized to negotiate with Mr. Martin for 50% of the cost or less. Motion carried unanimously. Mr. Lemberg also reported on the complaints received regarding the cracks in the curb on Garden Avenue. The contractor has suggested a reduction in the cost of the project in the amount of $8.00 per lineal foot of cracked curbing. Engineer Lemberg recommended that if Council should agree to this type of adjustment, that the price be set at $12.00 per lineal foot. He also suggested that the credit be given on the seal- coating portion of the project in order that the MSA portion would not be affected. Councilmember Larson moved, seconded by Councilmember Eggert that the City Engineer be authorized to draft a letter to Black Top Service asking that a credit of $12.00 per lineal foot be allowed for each curb section tahich is cracked. Motion carried unanimously. Mayor Warkentien informed Council that in order to comply with the post/footing details on the proposed park picnic pavilion (require- ments set up by the University of Minnesota) the cost would be in- creased by $250.00. There was a discussion regarding the use of asphalt shingles rather than cedar shingles in order to keep in line with the amount approved for construction of the building. Janet Brown, Chairperson of the Park Development Committee, stated that she had contacted her Committee members and That they preferred ,~ the cedar roof Shingles for aesthetic reasons. Council reached the decision that asphalt shingles would be more durable and require less maintenance. Councilmember Steele moved, seconded by Mayor Warkentien to adopt the revised plan for the 20' x 24' picnic pavilion providing for 36~~ textured asphalt shingles (Timberline or similar wood appearing shingles, to be selected by Janet Brown) at a cost of $4,350.00. Motion carried unanimously. ~J ALLAN MARTIN DRIVEWAY (cont SETTLEMENT PROPOSED ON CRACKED CURB & GUTTER ON GARDEN AVE. REVISED PLANS FOR PICNIC PAVILION ACCEPTED Councilmember Eggert moved, seconded by Councilmember Brown that the $2,000 PAY- City expend $2,000.00 for the Cable TV Joint Powers Commission to cover MENT TO CABLE initial costs, said fee to be reimbursed by the successful bidder.
