Also rresent were Clerk- Administrator Barnes, Engineer Lemberg;, and Attorney Kenefick. Councilman Ecklund. Councilman Black moved, seconded by Councilman Steele, to approve the minutes of December 12, 1974, as corrected. Motion carried. Councilman Steele moved, seconded by Councilman Labalestra, to approve the minutes of January g, 1975 as corrected. Motion carried. Attorney Kenefick presented proposed Ordinance Tdo. 138 amending Ordinance VETO. 64 establishing Planned Unit Development Districts in Falcon Heights. Attorney Kenefick noted that the only real changes in this ordinance would be the length of time permitting the people to build from approval of their plans to final approval, and the second change would be the sequence of appearances .before the various committees, in regard to the preliminary draft. Councilman Labalestra stated that he felt this ordinance was very well written and commended Attorney Kenefick on it. Motion carried. Attorney Kenefick presented to the Council his proposed draft of Ordinance 139, Commercial Parking Lot Piaintenance. The Council discussed the proposed ordinance in regard to commer- cial parking lots for three or more cars, amount of blacktop and construction necessary, whether or not building permits would be needed, possible violations and fines, snow removal, right-of-ways, and that if the property owners do not comply with this ordinance after it is passed, that the City cai11 have the right to bring them into compliance. Councilman Labalestra stated INTO. 139 that he liked the way it was written, but suggested, as CGTJTINUED a commercial parking lot owner, that maintenance fees are expensive. Councilman Steele moved, seconded by Councilman Labalestra, to bring this ordinance up at the next meeting of February 13, 1975. Motion carried. Attorney Kenefick presented to the Council proposed Ordinance 1~0 that would adopt the Minnesota Chapter 609 Mrisdemeanor Ordinance for Falcon Heights. He noted that this would cover such misdemeanors as bad checks, assult, petty theft, etc., and that he recommends such an ordinance for Falcon Heights. Motion carried. Mayor Warkentien read a letter from Pat Buschmann, in HOUSITJG regard to the Human Rights Commission meeting of January AS,:~ISTATdCE 22, 1975 concerning the Metro Housing Bulletin, Section 8 PROGRAP~': referring to Housing Assistance Payment Programs. A DISCUSSICTJ discussion was held by the Council in respect to this. M`:ayor Warkentien noted that Falcon Heights may have to surrender its right of control. Pat Buschmann disagreed with this, stating that there are no rights to surrender. She ~.lso noted that TJancy Reeves should be contacted about this, and suggested that the funds Falcon Heights might need could be applied for, as the TZetro council would act on this. She noted that Nancy Reeves could do as much or as little as Falcon Heights would request, upon the implimentation of this program, but that s'ne would need information on the auart!r.ents. She also noted that an inspection of the apartments would be required, and that publication of this would be needed. The Council noted that the i''letro Council would process the applications, however, Pat Buschmann stated that the MIuman Rights Commisso~~, would keep a list of the people needing assistance. Councilman Black wanted to know what people would do if they Vad limited funds, would they have to rent subject to a certain provision? Pat Buschmann stated that the person in question ~ti*ould pay only 25~ of their income for rent, and that this proposal would cover the rest. mhe Housing Bulletin was then read, and the latest rent rates were noted. Councilman Steele suggested that the landlords that would participate would be the ones with the vacancies. Mayor Warkentien wanted to know if a eerson's net worth would be considered, as well as the monthly income for the project. Pat Buschmann stated that this was so, however, that with the elderly people it might prove to be a problem. The Council then noted that the end of February would be the last time to file for this program. T~Iayor vdarkentien stated that he does not want to give the Metro Council more authority than they already have. Councilman Steele moved, seconded by T:ayor ~~darkentien, to table the matter until a later date. T~~otion carried. Engineer Lemberg; stated that he had been in contact with T~iidwest Planning, and indicated that there are some areas under Title I where money is available under an act of 197 Federal un.ding.~. T-Te noted that street, storm sewer, and park planning were included in the fund proposal, but that application would have to be made by hebruary 1, 1975. Engineer Lemberg also noted that this is the only program available for Falcon Heights of this type. Clerk-~ldrnin- istrato_r ~~urnes noted that there is not enough time for this, and that by January 15, 1975 it should have been worked on. Councilman Black move', seconded by Councilman .Labalestra, to approve the I~Tayor's appointment of Dr. A. J. Schwantes to the Planning Commission. Tiotion carried. The letter from Representative ileil Dieterich in regard to the regent appointment for the University of T~Iinnesota was noted, and his request for any nominations from Falcon ITeights was discussed. Also, his request for any bills that the Council would desire to have introduced to the legislature was discussed. The Council had no nominations, for either request, and Clerk-Administrator Barnes was directed to write a letter to Representative Dieterich to this effect. Mayor Tdarkentien read Teary Hartup's ,etter from the League of Women Voters in regard to their "Fan the Can'' Resolution, and the statistics involved. Councilman Labalestra moved, seconded by T~iayor trdarT~entien, C.t~'i.TCELLED to approve the cancellation of check number 6480 to T~iinnesota CHECK Fire, Inc. in the amount of k141.00 due to duplicate payment. Motion carried. Councilman Flack noted that Shakey's Pizza wanted to locate STiAKEY'S in Falcc~ti ?eights, and that a meeting would be held T•-Tonday, PIZZA January 27, 1975 in regard to this. Councilman Blac.~ also noted that there seemed to be no problems uaith this, and that this would be reported on at the next meeting. Engineer Lemberg discussed a letter with .respect to the ST. P1~UL St. Paul Sewer Department on the St. Anthony Storm drainage SEZ:~E:'~ DEPT. facilities. He noted that they are in the process of con- LETT~~Fi structing a tunnel, and noted that Lauderdale and the Fair Board have taken no action on the subject. Councilman Labalestra stated that the Falcon ?Heights businessmen are very concerned about the City Blight Ordinance and the enforcement of that ordinance. 1 The Council noted that T~Tr. Ralph Yellen of Ralph B. Yellen and Associates, Auditor for the Falcon Heights Liduor Store, passed away suddenly. The Council noted a letter fxom the State of T~Zinnesota had been received in regard to T~'orthern States Power and their rate increase of 16 per cent, and that a public hearing would be set up at a later date. The Council noted a letter from the Metropolitan Secaer Board in regard to the new name designated: T~Tetropolitan Iaaste Control Commission. Jarl's letter in regard JAAL LETTEP to her complaint and disagreement with the °'large lettering" on the east side of the Falcon Heights Community Play round Building. The Council discussed her rea.uest to have t~e lI letterin removed, but Engineer Lemberg suggested that no action 'pe taken until spring with the reasoning that the temperatures are now too locv to permit the paint to adhere properly. The Council decided to take no action on this matter until later on in the spring. P~iayor ~f~arkentien read the population change estimate from the T~Zetropolitan Council and John Boland in regard to Falcon Heights for the years to c~mc=. Mayor ~aarkentien also read various information in regard to the ?~iCentennial. Councilman Steele moved, seconded by Councilman Black, to adjourn the meeting at 11:00 p.m. T-Zotion carried.
