HomeMy WebLinkAboutCCMin_76Sep9/Q C,5 MINUTES OF REGULAR COUNCIL MEETING FALCON HEIGHTS, MINNESOTA SEPTEMBER 9, 1976 A regular meeting of the Falcon Heights City Council was called to order by Mayor Warkentien at 7:3l~ p.m. Mayor Warkentien, Councilmen Black, Ecklund and Labalestra. Also PRESENT present were Clerk-Administrator Barnes and Attorney Kenefick. Councilman Steele. ABSENT Moved by Councilman Ecklund, seconded by Councilman Black to approve APPROVAL OF MINUTES the minutes of August 5, 1976, as corrected. Upon a vote being OF AUGUST 5, 1976 taken the following voted "aye°: Mayor Warkentien, Councilmen Black, Ecklund,and Labalestra, and the following voted "nay": None. Motion carreed. Moved by Councilman Black, seconded by Councilman Labalestra to APPROVAL OF MINUTES approve the minutes of August 25, 1976, as corrected. Upon a rote OF AUGUST 25, 1976 being taken the following voted "aye": Mayor Warkentien, Council- men Black and Labalestra, and the following toted "nay": None. Councilman Ecklund abstained as he was not in attendance at the August 25, 1976 meeting. Motion carried. Mayor Warkentien requested Clerk-Administrator Barnes to remove item ITEM REMOVED F80M #6A from the Consent Agenda and place it on the General Agenda as CONSENT AGENDA item #5D. Clerk-Administrator Barnes complied with the request. Moved by Councilman Labalestra,-seconded by Councilman Ecklund to APPROVAL OF CONSENT approve the tiems on th® Consent Agenda as follows: AGENDA 1. Fire Report Nos. 63-65. 2. NFPCA Casualty Report Nos. 62 & 66. 3. Liquor Store Financial States Report, July, 1976. !~. Ramsey County Sheriff's Report, July, 1976. 5. Approval of Rescue Squad Members. 7. General disburseanents in the amount of $~i,1~37.17. 8. Liquor disburse:nenta in the amount of $8,810.39. 9. General payroll in the amount of $3,715.06. 10. Liquor payroll in the amount of $1,716.33• Upon a vote being taken the followinr voted "aye": Mayor Warkentien, Councilman Labalestra, Ecklund and Black, and the following voted "nay": None. Motion carried. Mayor Warkentien acknowledged a petita.on from 5 Larpenteur Avenue PETITION FOR LOWER- residents, requesting that the speed limit on Larpenteur Avenue ING OR ENFORCING between Snelling and Cleveland Avenues, which is presently set at SPEED LIMIT ON !~0 mph, be either reduced or more stringently enforced. LARPENTEUR AVENUE ~o~ Minutes Septeanber 9, 1976 Page 2 Mayor Warkentien instructed Clerk Administrator Barnes to request the LARPENTEUR SPEED Sheriff's patrol to watch for speeders on Larpenteur Arenas without PETITION (CONT.) lessening th,~ir other city duties. He also requested that Clerk-Admin- iatrator Barnes fox~rard a written reply to Mr. and Mrs. Pollard advi.aing them of our intentions and also to inform the Pollards that we previously hale set Up radar on Larpenteur Avenue twice and hale encountered no speed violators at such times. Clerk-Administrator Barnes read a request referred from the Tree Committee by Councilman Steele to permit homeowners to treat bowl®- vard trees at their own expense. Council concurred they have no ob-` Section to homeowners treating City trees at their own expense but expressed concern as to whether the homeowners are aware that most chemical treatments are only experimental and whether homeowners are aware ti~at here is absolutely no benefit in treating an already dis- eased tree. Council expressed concern that homeowners would be losing their in- vestment in a lot of cases because if at~r tree is found to be dis- eased, even after treatment, the City is compelled, by law, to re- move such trees. Moved by Councilman Labalestra, seconded ~ Mayor Warkentien that, after notifying the City Clerk, homeowners will be allowed to treat, by chemical means, any boulevard trees at their own risk and expense, with the understanding that the City may remove any boulevard tree if found diseased, even after treatment. Upon a vote being taken, the following voted "aye°: Mayor Warkentien, Councilmen Labalestra, Black and Ecklund, and the following voted ~~nay~~: None. Motion carried. It was farther noted that the,noti~e to homeowners should be posted and a notice be put in the suburban papers. Mayor Waxicentien PLANTING OF asggested that Councilman Steele conduct an in-depth stucb- on the BOULEVARD TREES question. Mrs. William P. McGuigan asked Council about stv~ reanoval and was STUMP REAlDVAL told ~ Clerk-Administrator Barnes that all stumps in the City should be reanoved by this fall. Mayor Warkentien suggested that Clerk-Administrator Barnes look into MICROPHONES microphone prices with the intention of purchasing three additional microphones for the Council chambers. Aa requested by C1erk•Admi.nistrator Barnes, the City received two STREET SIQrNS - bids on the neiw signs to be placed on the City streets under the BIDS RECEIVED Federal Sign Safety Act. The bids received were as follows: Earl F. Anderson (Lyle Sign Co. ) for $2,1.29.21 Gopher Stamp and Die Compayy for $2,387.10 The difference b®tween the two bide was $1.2.11. Cook, doing business ad[ Greenleaf Landscape Maintenance and that on the face of it, the license appli- cants and the insured are not the same entity, but that what probably happend was, that after they obtained the insurance certificate, the? probably incorporated and then made their license application under Green Leaf Tree Service, Inc. Attorney Kenefick syggested the license application be conditionally approved until Clerk-Administrate for Barnes can ver3.fy that it is the same entity and get a reasonable explaination for the disparity dust to make sure the insurance is in the name of the actual applicant and it isn't some other entity they are doing business-under. Moved ~ Councilman Black, seconded b? Councilman Ecklund to approve Tree Trimming License #358 for Green Leaf Tree Berries, Inc. on th e condition that Clerk-Administrator Barnes verify the applicant and the insured are one is the same organization. Attorney KeneficY read the proposed Wine Ordinance to the Council. He stated it is esseAt ally the same as the on-sale liquor license ordinance. Moved by Councilman Labaleetra, seconded by Mayor Warkentien to approve Wine Ordinance #153 with the fee being set at $1,850.00 per y®ar and directed the Cl.erkAc~ninistrator to publish the or- dinance in the official City neWapaper. ORDINANCE N0. 153 AN ORDINANCE REGULATING THE SALE AND CONSt1M1'TION OF WINE IN CERTAIN ESTAffi.ISHMEATTS IN CONJUDICTION WITH THE SALE OF FOOD; AND PROVIDING PENALTIES FOR VIOLATION ZIIEREOF: Upon a vote being taken the following voted "aye": Mayor Warkentien, Councilmen Black, Ecklund and Labalestra, and the following voted "ter": None. Tha only authority in the Ordinance is for wine. At~y beer above 3.2~ would require an on-sale liquor licens®. Attorney Kenefick also stipulated that a corporation can be licensed. The .Ordinance also grants the City the authority to charge a~ investigation fee. Mayor Warkentine read a notice from Clerk-Administrator Barnes to the APPOINT Council in regard to nominees for assistant Fire Chief. The tally was OF ASSISTANT as follows: Jerry Baden - 6 votes, Bob Luey - 9 votes and Leo Lindig - FIRE CHIEF' !~ votes . Moved by Mayor Warkentien, secondeld by Councilman Labalestra to appoint Bob Luey as assistant Fire Chief, replacing the Late Henry Dachtera. Upon a vote being taken the following voted "ayes': Mayor Warkentien, Councilmen Black and Labalestra, and the following voted "nay": None. Councilman Ecklund abstained as he is an active volunteer fireman. Motion carried. Fire Chief Jerry Renchin appeared before Council to request permission to use $61)0.00 of the monies received for State Fair Fire services for headgear and restoration of the fire station floor in the bay area. Mayor Warkentien and Attorney Kenefick Bested that Mr. Renchin inform State Fair officials that the check sho'1d be made payable to the City of Falcon Heights and be deposited in the General Fund. Moved by Councilman Labalestra, seconded by Mayor Warkentien to approp- riate an amount not to exceed $600.00 for neiw headgear and restoration of the Fire Station floor. Upon a vote being taken the following voted "aye": Mayor Warkentien, Councilmen B.Lack, Ecklund and Labalestra, and the following voted "nay": None. Motion carried. Chief Reachin informed Council that the older fire truck would probably not pass the next inspection and Council should make provisions to set aside at least $25,000.00 per year for the next two years in anticiaption of the need for a neMr track. FIRE EQUIPMENT NEEDED CHIEF' RENCHIN Chief Renchin expressed concern that if the truck does not pass inspec- tion standards the City would be put in a higher fire rating. Mayor Warkentien instructed Clerk-Administrator Barnes to get and approx- imation from the insurance compax~r on the possible ;rate.. increase. RESCUE CAPTAIN Chief Renchin informed Council that Craig Dachtera was elected Co-Cap FIRE RELIEF fain of the Rescue Squad and Cra3.e Schauffert took over as Secretary SECREATRY of the Fire Relief Association. Chief Reachin stated that the fire inspection of the City is done now FIRE INSP$CTION until the heating season starts. COMPLETED Mayor Warkentien informed Council that Mrs. Ruth D~achtera has accepted APPOINTM@iT OF her appointment as Civil Defense Director for the remainder of the year, RUTH DACHTERA replacing her late husband. A letter frcm Engineer Lemberg was read by Clerk-Administrator Barnes. MSA STREET Engineer Lemberg stated in his letter that due to the grades of the PROJECT stmt and the Haters of the 3.z:tersection of Crawford and Asbury it is $700 ADS necessary to carry the surface water runoff on the north side oP Craw- ford to the seat to Arrana to be picked up at the storm sewer. Because the intersection of Asbury and Crawford is a "T" intersection, it is necessary to cai'x'y a very shallow sxale across this area. To avoid future drainage and maintenance problems, Engineer Lemberg recommended that a ~~ wide concrete gutter be carried across this in- tersection at the north gutter line of Crawford. This would provide a permenant sKale that would not erode or develop "bird baths" or chuck holes as would the exist3.ng bittmlinous swale. Price. of this addition would be X700.00. Moved by Councilman Ecklund, seconded by Councilman Black to approve the Chax:ge Order in the amount of $700.00 to C. S. McCrossaa Company. Upon a vote being taken the following voted "aye"z Mayor Warkentien, Councilmen Black, Ecklund and Labalestra, and the following voted "nay": None. Motion carried. The certificate of appreciation to Geraldine Jenkins was approved CIItTIFICATS OF and signed by Mayor Warkentien. APPRECIATION JERRY JENKINS The check to the Minnesota League of Municipalities, held and MINNESOTA LEAGUE deferred for discussion last meeting was discussed by Council. OF MUNICIPALITIE Clerk-Administrator Barnes stated we get worthwhile information from the League. Attorney Kenefick and Councilman Ecklund stated ttd t the annual June meeting is very good and that the Legislative Bulletin is a great reference Moved by Councilman Black, seconded by Councilman Ecklund to con- tinue the City's membership in the Minnesota League of Municipalities. Upon a vote being taken the following voted "aye": Councilmen Slack, Ecklund and Labalestra and the following voted "nay": Mayor Warkentien. Motion carried. Clerk-Administrator Barnes informed Council that volunteer fireman ROQUEST 7.'0 PARK H. F. Smeby had requested permission to park his ammonia tanker in the AMMONIA TRUCK CitT lot, one night a week. Council instracted the Clerk-Administrator IN CITY LOT to ~tify Mr. Saaeby that the request was denied. MEETING Clerk-Administrator Barnes also noted there has a Ramsey County League RAMSEY COUNTY of Local GoTerr~ents meeting at Shorerigw on September ~5, 1976, at LEAGUE OF LOCAL 7:30 p.m. GOVERNML~TTS Council decided to hale a budget meeting at 8:00 p.m.~ Saturday, BUDGET MEETING September 18, 1976. Clerk-Administrator Barnes will post a public notice announcing the meeting. Councilman Black noted that the Conditional Use Request of Mr. Charles COMMENTS ON CON Soderberg had gone to the Planning Commission for the second time. DITIONAL USE FOF He expressed concern that the disposition of this particular item was SIr:IJERBERG TOWER being held up becau~ae of incorrect procedures. Councilman Labalest,~3a inquired as to what is being done about the COMMENTS ON potholes in the Cohen parking lot. Clerk-Administrator Barnes in- COI+S PARKING formed Council that Total Asphalt Company would begin work on the lot LOT next week. Mayor Warkea~tien noted that the Northwestern Youth Services Bureau NORTfiWESTERN was off to a good start. They here acquired the medical building YOU~I SERVICES next to Perkins by the Rose Car Wash. Mayor Warkentien not®d that CONIl~NTS the City of Roseville~s Federal Funds will be used in assisting the Northwestern Youth Services Bureau in meeting rent payments.
