PRESENT Also present were Clerk-Administrator Barnes, Engineer Leaaberg and Attorney Kenefick. None. ABSENT Moved by Councilman Steele, seconded by Councilman Ecklund to approve APPROVAL OF the minutes of October 28, 1976, as corrected. Upon a vote being MINUTES OF taken the following voted "aye": Mayor Warkentien, Councilmen Black, OCTOBER 28, 1976 Ecklund, Steele and Labalestra and the following voted "nay": None. Motion carried. Moved by Councilman Labalestra, seconded by Councilman Steele to approve the ite:as on the Consent Agenda as follows: 1. Basic Field Incident Reports, Nos. 85 and 86. 2. Basic Casualty Report, No. 81~. 3. Building Inspector's Report, October, 1976. t~. Approval of Licenses A. Sale of Christmas Trees #3bo Hermes Floral Compar~r 2001 Larpenteur Avenue W. Falcon Heights, Minnesota 55113 1 5. General disbursements in the amount of $12,106.18. 6. Liquor disbursements in the amount of $7,892.7l~. Upon a vote being taken the following voted "aye": Mayor Warkentien, Councilman Black, Ecklund, Steele and Labalestra and the following voted "nay": None. Motion carried. APPROVAL OF CON- SENT AGENDA Councilman Steele expressed concern that the minutes of October 28, CITY POLICY ON 1976, meeting did not reflect the Council's position on expending PRIVATE PROP- public funds for work done on private property. Council concurred that ERTY WORK DONE under no circumstances should the City give approval to citizens who BY CITY CON- wish to utilize the services of the contractor hired by the City for TRACTORS --- accomplishing apublic project. If private citizens wish to have work STEELS done on their private property by the contactor for the City, they must enter into an individual contract with the contractor. Minutes ~ ~ 5 Special Council Meeting November 10, 1976 page 2 Councilman Steele moved and it was seconded by Councilman Ecklund RESOLUTION 76-37 to approve Resolution 76-37 as follows: RESOLUTION 76-37 A RESOLUTION STATING THAT THE CITY OF FALCON HEIGHTS SHALL NOT EXPEND PUBLIC FUNDS FOR ANY WORK ON PRIVATE PROPERTY During the accomplishment of a public project, the City of Falcon Heights shall not expend public funds for at~y work on private prop- erty. The property owner shall contract separately with the contrac- tor if such work is desired and shall be totally responsible for pay- ing the contractor. The City shall not negotiate with the contractor or assist the property owner in arty way in accoplishing this private work. Upon a vote being taken the following voted "aye": Mayor Warkentien, Councilmen S1.ack, Ecklund, Steele and Labalestra and the following voted "nay": None. Motion carried. Chet Saunders, 1786 Tatum and Hans Schirrmeister, 1779 Tatum appeared REIMBURSEMENTS before Council to request a reimbursement for the removal of their FOR CULVERT culverts. R,~pppL H . SCHIRRMEI STER Engineer Lemberg stated the cost of removal of the culverts was AND C. SAUNDERS approximately $100.00 each. Councilman Ecklund noted that in the past it has been the Council's policy to derma payment for removal of culverts. Councilman Steele moved and it was seconded by CouncilmazBlack to reimburse Hans Schirrmeister and Chet Saunders $100.00 each for re- moval of their culverts. Upon a vote being taken the following voted "aye": Mayor Warkentien, CounciLnen E1ack and Steele and the follow- ing voted "nay": Councilmen Ecklund and Labalestra. Motion carried. Mrs. Jana Able, 2099 ti+1..Hoyt appeared before Council to inform them HAZARDOUS DRIVING of what she felt was a hazardous condition at the intersection of SITUATION ON Folwell and Hoyt Avenue. She stated that because of all the cars HOYT AND FOLWELL parked in the area, the intersection is blind, especially when going MS. JANE AHLE south on Folwell and trying to turn on to Hoyt. At present, parking in the area is restricted to 2 hours during the hours of 8:00 a.m. until l~:00 p.m. Mrs. Able feels that marry of the parked cars are in violation of the present ordinance. She also stated that she felt something should be done immediately as it will be more dangerous when it snows. Council instructed Clerk-Administrator Barnes to sudy the situation and with the assistance of the Ramsey County Sheriff Department, see what can be done to alleviate the problem. Florence Chambers, Secretary of the Falcon Heights Human Rights REPORT ON THE Commission appeared before Council with a report on the District 7 DISTRICT 7 conference which she attended along with Nancy Kareken and Bill HUMAN RIGHTS Chenoweth. CONFERENCE Minutes Special Council Meeting November 10, 1976 Page 3 Mrs. Chambers informed Council that the conference emphasized the need for educating the public in the areas of Revenue Sharing, Civil Rights and Fair Housing. Mrs. Chambers will be submitting a detailed written report on the conference. Mayor Warkentien read a request from Mr. Gertrude Johnson, 1l~15 Hoyt Avenue to pay for her sewer bill from Maplewood Sewer and Water, in the amount of $586.00 for work done on the repair of her sanitary sewer line. Mrs. Johnson felt the City was responsible for the bill. Clerk-Administrator Barnes stated that Mrs. Johnson's sanitary sewer line has been connected for at least 27 years and that it has been the City's policy not to pay sanitary sewer bills as that is consid- ered private property. Mayor Warkentien moved and it was seconded by Councilman Black to deny pa3nnent on the basis of City policy that work don on sanitary sewer lines from the home to the main line in the street is considered to be work done on private property and is the responsibility of the home- owner. Upon a vote being taken the following voted "aye": Mayor Warkentien, Councilmen Black, Ecklund, Steele and Labalestra and the following voted "nay": None. Motion carried. HUMAN RIGHTS CONFERENCE (CONY) REQUEST OF M~.S. GERTRUDE JOHNSON TO HAVE THE CITY PAY FOR WORK DONE ON HER SANITARY SEWER LINE Mayor Warkentien presented the application for position of Volunteer APPROVAL OF Fireman of David Lee King, 1607 Hollywood Court. Upon a vote being APPLICATION OF taken the following voted "aye":, subject to six months probation and VOLUNTEER FIREMAN passing a physical examination: Mayor Warkentien, Councilmen Black, DAVID LEE KING Ecklund, Steele and Labalestra and the following voted "nay": None. Motion carried. Council discussed the possibility that the physical examination for FIREMhfiT'S firemen was not thorough enough and instructed Clerk-Administrator PHYSICAL EXAMIN- Barnes to have Chief Renchin check on Roseville's requireanents. ATION REQUIRE- Councilman Labalestra offered to check with his mother as she is in MENTS charge of physicals for Group Health. Councilman Ecklund moved and it was seconded by Councilman Black to RESOLUTION 76-36 approve Resolution 76-36 as follows: REAPPORTIONMENT OF ASSESSMENTS RESOLUTION 76-36 POTHEN HOMESITES A RESOLUTION REQUESTING ~ COUNTY AUDITOR TO REAPPOR- TION THE ASSESSMENTS ON THE POTHEN HOMESITES ADDITION Upon a vote being taken the following voted "aye": Mayor Warkentien, Councilmen Black, Ecklund, Steele and Labalestra and the following voted "nay": None. Motion carried. Upon a BICENTENNIAL vote being taken the following voted "aye": Mayor Warkentien, COMNDrTTEE MFM- Councilmen Black, Ecklund, Steele and Labalestra and the following SRS voted "nay": None. Motion carried. Mayor Warkentien mentioned that the Kiwanis Club would be shortly KIWANIS CLUB be mailing a check, in the amount of $300.00, directly to Diane Kelsey DONATION FORTH- for the Park Development Committee.
