HomeMy WebLinkAboutCCMin_77Feb9_SpecialMINUTES SPECIAL COUNCIL MEETING CITY OF FALCON HEIGHTS, MINNESOTA ~ FEBRUARY 9, 1977 ~• ~ ~ ~. 1 A special meeting of the Falcon Heights City Council was called to order by Mayor Warkentien at 7:30 p.m. Mayor Warkentien, Councilmen Black, Ecklund, Steele and Labalestra. Also PRESENT present were Clerk-Administrator Barnes, Attorney Kenefick and Engineer Lemberg. None. ABSENT Councilman Steele moved and it was seconded by Councilman Labalestra to APPROVAL OF MIN approve, as corrected, the minutes of January 27, 1977. Upon a vote being UTES OF 1/27/77 taken the following voted "aye": Mayor Warkentien, Councilmen Black, Ecklund, Steele and Labalestra and the following voted "nay": None. Motion carried. Councilman Labalestra moved and it was seconded by Councilman .31ack to approve the items on the Consent Agenda as follows: 1. Falcon Heights Fire Department Reports, Nos. 6 and 7. 2. General disbursements in the amount of $l~,927.l~0. 3. Liquor disbursements in the amount of $13.30.90. ~.. Liquor payroll (1/16-31/77) in the amount of $2,015.75. Upon a vote being taken the following voted "aye": Mayor Warkentien, Councilmen Black, Ecklund, Steele and Labalestra and the following voted "nay": None. Motion carried. Mr. Doug Ritter, representing the Suburban Sun newspaper, appeared before Council to recommend that the City purchase 2 pages of advertising in.. he Falcon Heights Community Directory, which is published by the Sun. Mr. Ritter suggested the City purchase the second and third white pages for civic information. He showed Council the Roseville and Corib area directories as examples of the type of c~vic information usually printed on these pages. Mr. Ritter quoted a price of $250.00 for the first page and $150.00 for the second page for a total of $100.00, Council felt the advertisement would be beneficial and a handy ref erence for the citizens of Falcon Heights. Councilman Steele moved and it was seconded by Councilman Black to pur- chase two pages (pages 2 and 3) in the Sun's Falcon Heights Community Directory for presentation of civitG information, at a cost of $l~00.00. The contents of the pages are to be determined by Mayor Warkentien and Clerk-Administrator Barnes. Upon a vote being taken the following voted "aye": Mayor Warkentien, Councilmen Black, Ecklund, Steele and Labalestra and the following voted "nay": None. Motion carried. APPROVAL OF CONSENT AGENDA PURCHASE OF TWO PAGES OF CIVIC INFORMATION AD- VERTISING IN THE SUN COMMUNITY DIRECTORY I~INUTEs SPECIAL COUNCIL P'lEETING FEBRUARY 9, 1977 page 2 "~ Council reviewed the qualifications of the three applicants for the APPOINTMENT OF position of City Horticulturist. The three applicants were Dr. Gustad CITY HORTICUL- Hard, City Horticulturist for Falcon Heights for the past 16 years, TURIST FOR 1977 Dr. David W. French, Plant Pathologist at the University of Minnesota and George Munzenrider, Horticulturist of Sunfish Lake. Council discussed at lengtdl the City's current system and methods of re- moval of Dutch Elm diseased trees. It was noted by Councilmembers and the Administrative staff that many complaints had been made, by citizens and the Administrative staff itself, concerning many seemingly unnecessary delays in the present system. It was noted that after citizens reported a tree with suspected Dutch Elm disease, many times there were long delays before inspection, marking and removal notification. After further discussion, Councilman Labalestra moved and it was seconded by Councilman Black to appoint Dr. David W. French as City Horticulturist for the year of 1977. Upon a vote being taken the following voted "aye": Councilmen Black, Ecklund, Steele and Labalestra and the following voted "nay": Mayor Warkentien. Motion carried. Council discussed Attorney Kenefick's letter in regard to "snow fences". Since some homeowners have kept their snow fences erected in their front yards after being notified they were in violation of section l~.7 of Ordinance 6L~, it has become necessary for a definition of the term. Some homeowners have argued that since snow fences are of a temporary nature, they need not comply with section l~.7. Attorney Kenefick found that even though snow fences might be of a temporary nature, they would be considered a "structure" under the ordinance and all setback requirements would have to be followed. Council directed Clerk-Administrator 3arnes to write a letter to resi- dents concerned and inform them of Attorney Kenefick's findings and also let them know they may apply for a Variance to erect their snow fences. Mayor Warkentien read a resolution opposing the proposed Ramsey County Municipal Court change. He noted we have received a number of other similar resolutions from surrounding communities. Councilman Ecklund stated that the Ramsey County League of Local Governments was also in opposition to the legislation. Councilman Steele moved and it was seconded by Mayor Warkentien to authorize Clerk-Administrator Barnes to draf t a resolution stating that the City of Falcon Heights is in opposition to legislation altering the Ramsey County Municipal Court System and to send copies of the resolution to every Ramsey County legislator and all individual members of the Ramsey County League of Municipalities. DISCUSSION ON SNOW FENCES - VARIENCE REQUIRED RESOLUTION 77-6 OPPOSING LEGIS- LATION ALTERING THE RAMSEY COUNTY MUNICIPAL COURT SYSTEM Upon a vote being taken the following voted "aye": Mayor Warkentien, Councilmen Black, Ecklund, Steele and Labalestra and the following voted "nay": None. Motion carried. MINUTES SPECIAL COUNCIL MEETING FEBRUARY 9, 1977 page 3 .~ Engineer Lemberg remarked that there should be some way that MSA funds could be used for other than State Aid designated streets. He stated he would like to see some proposed legislation permitting the unused funds to be used for trees, sewers, etc. Councilman Steele moved and it was seconded by Mayor Warkentien to direct Engineer Lemberg and Attorney Kenefick to draft a proposal for a bill, to be directed to Senator Neil Dieterich, permitting municipalities to use MSA funds for other than streets. Upon a vote being taken the following voted "aye": Mayor Warkentien, Councilmen Black, Ecklund, Steele and Labalestra and the following voted "nay": None. notion carried. Mayor Warkentien moved and it was seconded by Councilman Ecklund to approve the City Treasurer bond for Clerk-Administrator Barnes from Safeco Insurance Company in the amount of $10,000.00. Upon a vote being taken the foolooing voted "aye": Mayor Warkentien, Councilmen 31ack, Ecklund, Steele and Labalestra and the following voted "nay": None. Motion carried. Engineer Lemberg noted he had received a map outlining the future (to 1981) Ramsey County road construction layouts. He stated there is no proposed County road construction for Falcon Heights. Councilman Steele reported the Tree Committee met last night for the first time since October. There were nine members present for the updating and briefing on the spring program. The committee discussed the current legislative bills to reimburse homeowners for planting trees, the three year lignasan treatment program existing in the University Grove area and the Tree Memorial Fund. DRAFTING OF PRO- POSED LEGISLATION FOR OTHER USES OF MSA FUNDS APPROVAL OF BOND FOR CLERK-ADP~N- ISTRATOR BARNES COUNTY ROAD CON- STRUCTION LAYOUT MAP FOR 1976-1981 TREE COMMITTEE REPORT Councilman Labalestra also mentioned he was anticipating a doctor's DOCTOR'S REPORT report on the physical condition of Liquor Store Manager, George Willkom ON GEO. Vd~ILLKOr1 so Council can bye informed what limitations, of any, there will be on his management capabilities. Clerk-Administrator Barnes read Resolution 77-153 of the Ramsey County Commissioners, stating that approval of the 1977 Law Enforcement Services Agreement between Falcon Heights and Ramsey County Sheriffs Department is subject to receipt of correspondence from the County Risk Manager indicating that any compensation for injury sustained while on duty shall be paid by the contracting municipality. Clerk-Administrator 3arnes stated he felt we were already paying for the same thing in the contract and he would check it out further. RAMSEY COUNTY LAYd ENFORCEMENT INJURY CO1JlPENSATION Mayor Warkentien read a notice of the January 22nd Legislature's meeting LEGISLATURE'S MTG. in the Permanent Gallery Collection of the Minnesota riuseum of Art. There will be a briefing on key legislative issues from 1:30 to t~:30 p.m. and a reception from 5:00 to 7:30 p.m. Councilman Labalestra told Council that Yellen and Associates will have Y~,LEN & ASSOC. the Liquor Store year end report ready by the 17th of February. Chief Renchin would like automatic door openers and had requested the quote. The quote is as follows: Two (2) 1/3 hp. 130v electric openers w/radio control for $850.00 and Two (2) l/3 hp. 150v electric openers w/timing devices for $750.00 Clerk-Administrator Barnes noted we have not budgeted for these items. Council reviewed numerous chapters of the proposed codification of REVIE4u' OF CODIFI- Ordinances and recommended they be further condensed and at least three CATION OF CITY chapters to be reviewed by Attorney Kenefick for his suggestions.
