HomeMy WebLinkAboutCCMin_77May26MINUTES REGULAR CITY COUNCIL MEETING CITY OF FALCON HEIGHTS, MINNESOTA 1 MAY 26, 1977 A regular meeting of the Falcon Heights City Council was called to order by Mayor Warkentien at 7:30 pm • °~ 46 Mayor Warkentien, Councilmen Black, Ecklund, Steele PRESENT and Labalestra. Also present were Clerk Administrator Barnes, Engineer Lemberg and Attorney Kenefick None Councilman Labalestra moved and was seconded by Councilman Steele to approve the items on the Consent Agenda as follows: 1. Ramsey County Sheriff's Rep., April, 1977 2. General disbursements in the amount of $23,343.90. 3. Liquor disbursement in the amount of $20,914.58 4. Sinking Fund disbursements in the amount of $7,688.00 5. General payroll (5-16 - 31/77) in the amount of $3,753.90 6. Liquor payroll (5-16 - 31/77) in the amount of $1,817.75 7. Falcon Heights Fire Dept. Rep., Nos. 37,38 and 40 8. Basic Field incident rep., No. 39 Upon a vote being taken the following voted "aye": Mayor Warkentien, Councilmen Black, Ecklund, Steele, and Labalestra. The fallowing voted "nay": None. Motion carried. ABSENT APPROVAL OF CONSENT AGENDA Councilman Steele moved and it was seconded by Councilman APPROVAL OF Labalestra to approve, as submitted, the minutes of MINUTES OF May 12, 1977. Upon a vote being taken the following MAY 12, 1977 voted "aye": Mayor Warkentien, Councilman Black, Ecklund, Steele and Labalestra. The following voted "nay". None. Motion carried. Mr. & Mrs. N. L. Hermes, 1755 St. Mary's Avenue, along APPROVAL OF with their son, Ralph Hermes, appeared before the Council VARIANCE FOR once again to request approval of their variance appli- FENCE FOR cation to erect a 5' cyclone fence on the westerly and N. I. HERMES northerly lot lines of Lot 7 of the Crossroads addition. Councilman Black also noted FENCE FOR that the fence installation was acceptable to the N.I. HERMES residents on the west. Councilman Black moved and it was seconded by Council- man Steele to approve the Variance to install a five foot cyclone fence which is less than 750 opaque. Upon a vote being taken the following voted "aye": Mayor Warkentien, Councilmen Black, Ecklund, Steele and Labalestra. The following voted "nay": None. Motion carried. Mayor Warkentien noted that on Friday, May 20, 1977 APPROVAL OF he had signed the Malt Liquor License #216 for MALT LIQUOR Richard Ball, representing the University of Minn. LICENSE #216 student entertainment organization as an emergency U of M STUDENT ENTERTAINMENT had arisen and the group found it necessary to move there scheduled affair to the Merchandise Mart on the Fairgrounds.. The Fair also approved the use. Mayor Warkentien moved and it was seconded by Councilman Ecklund to approve the license. Upon a vote being taken the following voted "aye": Mayor Warkentien, Councilmen Black, Ecklund, Steele and Labalestra. The following voted "nay": None. Motion carried. Attorney Kenefick read over proposed Ordinance #156 APPROVAL OF which sets a new schedule of fees for licenses and ORDINANCE #156 permits. The purpose of the ordinance is to allow ESTABLISHING the City to change each year by resolution, the LICENSE AND fee amount. PERMIT FEES Councilman Ecklund moved and it was seconded by Councilman Steele to approve Ordinance #156. de- leting the words "Applied for" in line two of Section 4, and to direct Clerk Administrator Barnes to publish the Ordinance in the official newspaper. Upon a vote being taken the following voted "aye": Mayor Warkentien, Councilmen Black, Ecklund, Steele and Labalestra. The following voted "nay": None. Motion carried. Attorney Kenefick read Chapter two of the Ordinances CODIFICATION with his revisions and submitted copies to Council- OF ORDINANCES members for their review. He stated he will have CHAPTER II one or two more chapters ready for the next meeting. ATTORNEY KENEFICK G 1 MINUTES REGULAR COUNCIL MEETING MAY 26, 1977 page 3 Mayor Warkentien opened the public hearing for the Idaho Avenue Curb and Gutter Improvement at 8:00 pm. by directing Clerk Administrator Barnes to read the official notice as published. Clerk Administrator Barnes complied. Engineer Lemberg gave a brief outline as to the scope and cost of the project. Mayor Warkentien then invited comments from Idaho Avenue residents which were as follows: Mr. George Williams, 1341 Idaho Avenue - stated two years ago he installed curbing at a cost of $400.00 and doesn't want new curb and gutters. Also stated there is no standing water near his property. He stated there are only four homes on his block which do not have curbing. Hilding Peterson, 1403 Idaho Avenue - stated he now has bituminous curbing. He read a state- ment written by the Harry Larson's of 1396. The ,arson's wrote they were against the proposed project. Mr. Peterson stated his feelings were the same as the parsons. Merlin A. Ahlberg - 1340 Idaho - stated he sees no need for the improvement and has no problem with standing water. Norm Johnson - 1368 Idaho - stated he is not in favor of the project. He stated there is no drainage problem. Michael Maxwell - 1427 Idaho - he stated he is in favor of the project. He stated that he does have a problem with standing water. Mrs. Ralph K. Morris - 1412 Idaho - she said she likes the countrified look and is not in favor of the project. She stated the City should assess for new trees instead. Mrs. Henrietta Thom - 1402 Idaho - she agrees with Mrs. Morris and does not want the project. David Anderson - 1512 W. Arona - suggests new sod on boulevard between sidewalk and curb. ~ 48 PUBLIC HEARING IDAHO AVE. CURB ~ GUTTER IMPROVEMENT Attorney Kenefick advised council they could not go over the proposed estimated figure. George Kilgore - 1494 Idaho - wants curb and gutter, he said only three houses would be effected to have the whole boulevard sodded in his block. Paul Berg - 1522 W. Idaho - he mentioned there were five against out of eight in his block. He feels it is not necessary at this point. 1 Councilman Steele was excused from the meeting at 9:48 pm. Mayor Warkentien moved and it was seconded by John Labalestra, ordering the curb and gutter improvement on Idaho Avenue from Arona to Pascal and direct the Engineer to draw up plans and specifications. Upon a vote being taken the following voted "aye": Mayor Warkentien, Councilmen Black, Ecklund and Labalestra. The following voted "nay": None. Absent: Steele. Motion carried. Mayor Warkentien thanked all for coming and their orderly presentation. Attorney Kenefick submitted to Council a proposed ordinance establishing user strength charges for industrial users in the City of Falcon Heights and the method of collecting the costs. He informed Council that Mando Photo chemical discharges into the sewer is being monitored. Council directed Attorney Kenefick to prepare a final draft and submitt it to Council on June 9. Clerk Administrator Barnes was directed to inform Mando of the proposed ordinance and invite them to attend the next meeting. INDUSTRIAL USER STRENGTH (CHARGE SEWER) Clement Lehmen, proprietor of Falcon Lanes appeared ORDINANCE 156 before the Council and objected to the fee schedule in Ordinance 156, which was previously adopted. The City Council advised Mr. Lehmen that all communities have simular fee schedules and some of them with a greater fee. MINUTES REGULAR COUNCIL MEETING MAY 26, 1977 page. 5 Clerk Administrator Barnes reported to the Council the letter he received from Ramsey County Engineer informing the City that the storm sewer lift station on Larpenteur east of Hamline was in need of repair and to inform us there was a cost sharing between the City of Falcon Heights, Roseville and Ramsey County. Clerk Administrator Barnes reported to the Council he has employed Mary Rukavina, 1659 Mapleknoll, as park attendent for the Falcon Heights Community Ctr. during the hours of 6 - 10 pm, seven days a week at $2.75 per hour. Council Labalestra moved and Mayor Warkentien seconded. Upon a vote taken the following voted "aye": Mayor Warkentien, Councilmen Black, Ecklund and Labalestra. .The following voted "nay": None Absent - Steele. Motion carried. Mayor. Warkentien appointed Councilmen Labalestra and Ecklund to assist Clerk Administrator Barnes in the interviewing of prospective girls for the secre- tarial position. Clerk Administrator Barnes advised Council he had the phamplets on "40 Ways to Protect Your Homer', which had been purchased by Lidos, in addition to a stamp showing "Distributed by Human Rights Commission, City of Falcon Heights". Council requested that Clerk Administrator Barnes write a letter of thanks to Lido's Cafe for the phamplets. Councilman Black moved and was seconded by Councilman Ecklund. Upon a vote being taken the following voted "aye": Mayor Warkentien, Council- men Black, Ecklund and Labalestra. The following voted "nay": None Absent: Steele. Motion carried. Mayor Warkentien moved and was seconded by Council- man Ecklund, to authorize Clerk Administrator Barnes to request a hearing on the application request of Milton Cohen requesting a reduction on the assessed valuation of certain properties located at Larpenteur and Snelling. Upon a vote being taken the following voted "aye" Mayor Warkentien, Councilmen Black, Ecklund and Labalestra. The following voted "nay" None.
