1. 2016 Truth in Taxation and Budget Presentation
City Administrator Thongvanh presented the factors that goes into the taxes: city,
county, school, and special taxing authority. Taxable market value is what is used to
calculate taxes. The City of Falcon Heights had a 2% increase in home valuation. The
county accounts for 51% of taxes, the city accounts for 24%, school districts account for
17.2%, and special districts account for 7.8%. Falcon Heights has the third lowest tax rate
in the county. Since 2014, the average city portion tax increase on a median value home
is $22 per year. This increase is lower than the increase in 2016. 70% of parcels within
Falcon Heights either had a decrease or a 0% increase in their property taxes. The total
levy is 8.9% which is comprised of 10.2% Ad Valorem levy and -1.3% debt levy. General
fund expenditures are 5.16% higher than the 2016 operating budget.
Helen Foster- 2190 Folwell Ave.:
Her taxes went up 32.2% and a neighbor went up 68%. The value of the home went up
$100,000 without improvements.
City Administrator Thongvanh stated that there is a process with Ramsey County to
appeal home valuation. Typically, they take the value of what homes in the surrounding
area have sold for. Ramsey County doesn’t always adjust valuation of the homes every
year. Increase may be from a three-year period.

Council Member Gustafson stated there is a certain percentage of increases that are
covered by income, and that can be brought up with a tax preparer. There is an
interactive page on the Ramsey County website about when a home gets evaluated.
Chuck Laszewski- 1713 St. Mary’s St.:
When the preliminary levy was set in September, some residents suggested that the city
should reduce the amount of fines collected through police actions. The We Can Do
Better group created a spreadsheet from research on fines. Their suggestion was to cut
the amount of fines that filter into the general fund by a maximum of $15,000. They want
traffic stops only for speeding, suspected drunk driving, and running red lights. If St.
Anthony undergoes a study by the DOJ, they will more than likely enforce less minor
citations, so the city should prepare its budget for fewer funds.
Council Member Fischer stated that this is something that the Task Force can discuss if
they want to move forward.
Council Member Gustafson stated that after September in order to decrease revenue
they would have to increase the levy, but they are only able to either approve the levy or
decrease it after that point. In order to not enforce these fines, that would require
changes in state legislature. In the meantime, when revenues begin to decrease the
Council can work to adjust funds.
City Administrator Thongvanh stated that Chief Mangseth’s statement was that he
would look to the Council for priorities. Police officers take an oath, therefore, they
adhere to state statutes.
John Thompson-
He spoke to Chief Mangseth and was told to wait on the evidence. He waited and wants
the city to end the contract now that Choi has spoken.

2. 2017 PMP Public Hearing and Calling for Improvements
City Engineer Freihammer presented that the pavement project will include Folwell,
Vincent, Northrop, Burton, and Coffman. They will also be doing the pathway on
Roselawn between Fairview and Cleveland. There will be a reclaim, panels will be
replaced, but not all curb and gutter will be replaced. The estimated cost of the street
portion is $750,000. The roads right now range from a 6-43 rating. The trail improvement
is estimated to be $81,000. There will be some drainage improvements included in the
project, this means adding some additional storm sewer components with an estimated
cost of $65,000. Additional storm sewer repairs are estimated at $57,000. The City will be
working on this project with St. Paul Water Utility. They will be replacing cast iron
water mains, and also replacing fire hydrants. The total cost of the project is estimated at
1,496,000, about $900,000 is Falcon Heights’ cost. This will be paid for by street
infrastructure funds, municipal state aid, storm sewer funds, and assessments.
The assessment policy states that corner lots are assessed 100% of the long side and 0%
of the short side of their property. Assessment rate is 40% for residential 60% for

commercial and multi-family. The estimated rate for residential property is $28 per
linear foot and $42 per linear foot for multi-family/commercial. The final assessment
hearing will be held in October. In February 2017 they would approve bids and aim for a
June construction date.
Neil Waller- 1596 Vincent St.:
The assessment amounts area skewed among properties in the Grove. A large
percentage are paying in the range of $2,000. A few homeowners are paying well over
$4,000. The people that live on corners are being asked to pay the most. Being charged
based on the long side of one’s property does not make sense in the Grove because most
of their edges are round. Residents that live on corner lots do not use the streets and
water systems more than other residents. He is asking the Council to reassess the Grove
residents based on a fairer policy. Currently in Minneapolis and St. Paul residents are
suing the city because they also do not like this standard policy that is in place.
City Engineer Freihammer stated that the assessment portion is only for the street repair,
not water or sewer.
Erric Schiffman-1596 Northrop St.:
He wanted to add that the other options to assessing are averaging the width and length
or to average the costs for all residents. He considers his plot to be a unique situation
since he does not have a double lot or backyard.
City Engineer Freihammer stated for clarification that the front footage of Coffman was
calculated and divided by the number of units.
City Administrator Thongvanh stated that once the Council has the assessment public
hearing, there is a time to appeal for unique situations. He has seen other communities
take a look at the total of the project, and base their calculation on the average frontage
of the properties.
City Engineer Freihammer can speak more to residents on the calculations of the circular
plot sides. Assessments can be appealed at one of two times: when the Council approves
the assessment role and at the assessment hearing.
Clyde:
He just got back from Canonball River in North Dakota. Police are shooting people in
the backs with rubber bullets, turning dogs on them, and using concussion grenades. It
should be seriously considered to end the contract. Thousands are grieving and
pleading for justice. The Council should come to a conclusion on this. Do you want a
police force or peace officers?

3. Outstanding Invoices for City Services
City Administrator Thongvanh presented the annual process for assessing properties
that the city has done work on abating from receiving code violation. There are two
properties being assessed: 1354 California and 1771 Arona. The California assessment is
$275 and the Arona assessment is $2,000. This is based on contracted work to abate the
property.

City Administrator Thongvanh presented that in the 2017 Fee Schedule there are updates to the
sewer and storm sewer charges per property as discussed in budget workshops. The street
sweeper purchase is a piece of equipment that we jointly own with Little Canada. The city is
fulfilling the agreement and purchasing it from them. Lastly, the State Aid Project item is to
approve the Mayor and City Administrator to sign corresponding documents and to have the
ability to negotiate with the state in terms of cost for that project.

The Parks and Recreation Commission’s next meeting will be on January 9th at 6:30pm at City
Hall. Staff is currently doing research for proposed interpretive signage for the Curtiss Field
history of the northwest airport. This will be submitted as part of a grant application to the
Minnesota Historical Society and the Minnesota Legacy Act. The January Parks and Recreation
Commission meeting will discuss 2017 goals. There are Commission openings.
The Task Force met for the first meeting last night. They discussed aspirations, why they got
involved, and what success might look like. They also discussed open meeting laws and
practices. They will meet 2-3 times a month. All information will be on the Falcon Heights

website. He also wants to extend condolences to the family of Virginia Frenzel, a Falcon Heights
resident that passed away.
Mayor Pro Tem Brown Thunder:
NYFS has a senior chore program that includes shoveling sidewalks and driveways.
City Administrator Thongvanh:
He sent out a press release that the Department of Justice (DOJ)-COPS is to announce a
comprehensive review of the St. Anthony Police Department. They will announce this alongside
COPS, Community Oriented Policing Services. This will take place on December 15 at 2:00pm.
Attendance is open to the public.
I. COMMUNITY FORUM:
Tyrone Tarrell- 270 Kent St. St. Paul:
Choi has made his decision, so when will this Council make their decision about St. Anthony
PD? He is here with other board members to ask that the contract be ended.
David Glass-
He is a warrior for social justice and economic development. He wants to ask his friend, Council
Member Brown Thunder, to spend some time thinking about what they are doing. It’s not his
perception that people are being heard. What happens in Falcon Heights affects other
communities. St. Paul Police do an excellent job in community policing. What is happening in
Cannonball isn’t the police, it’s private security. Is this the right contract for the community?
Henry Boucha-
He recently moved back to Minnesota and joined the board of National Coalition against
Racism in Sports and Media. He stands with David and Tyrone about looking into a new Police
Department.
Dierdra Darivick- 211 East 7th St. St. Paul:
A Black man named Frank Baker was attacked by a canine in St. Paul. To hear that you have not
severed your contract with SAPD is abominable. 47% of the people pulled over when driving
through the city were Black, and 7% of Falcon Heights’ population is Black. The world is
watching. The city should sever the contract and sue.
Akil Foluke:
The Council’s demeanor is the same. He tells his friends updates on what’s been happening.
There’s only one way to move forward. It’s going to happen again. Are you paid officials and
you don’t listen to your citizens? Are you going to make a motion to sever the contract?
Council Member Gustafson:
The Council is taking the steps that they can take, and the Council is reviewing Police
Department procedures. The Task Force will be accountable action.
Council Member Fischer:
The criminal justice system is going to respond to the event, and we as a city are going to
respond to the system. We’re responding to the policies of the police department. The

Department of Justice (DOJ) was invited by St. Anthony Police Department to review them, and
he sees that as a bold move. Who does policing better?
Mayor Pro Tem Brown Thunder:
Just because the Council is not giving you the decision you want to hear, doesn’t mean that isn’t
the direction it’s headed in.
John Thompson- St. Paul resident:
He waited for Choi’s decision, and spoke with Chief Mangseth when he said not to judge the
whole department by one officer. The Chief knew that Yanez lied in his police report, and
Falcon Heights needs a fresh start. Get someone else to be the police department. What else do
we have to wait on?
Greg Jackson-
The Council made mention that you created a task force for the purpose of operation and to see
how the police department operates. He happened to be one of the recipients of misconduct. A
St. Anthony officer slammed his head again the hood of a car and was told he could find an
alternative route. The Council has the power to make decisions. The just thing to do is to
dispose of the contract. There is tension building in lieu of this decision being on hold.
Nathaniel Kaleit:
There has been some movement in St. Paul with the police department in the last month. There
was a riot in 1959 in the Rondo neighborhood. At that time people tried to work on a
relationship with the police department to work on trust. The anger built and festered in the
community. St. Paul had task forces and the DOJ review. Did you ever find out if first aid was
offered and if officers are trained in first aid?
Council Member Gustafson:
They are trained in first aid. As far as the details of the incident, that is all tied up in the
investigation right now.
Nathaniel Kaleit:
Is there anything Choi said that touched your emotions? You can demand that the St. Anthony
Police Department fire that officer. He’s on paid leave. Show the community that you value
their humanity and help them to heal.
Council Member Fischer:
He already knew that this was a horribly tragic event when he first heard about it, but he wants
to focus on the Council’s responsibility which is to look at the system of policing. We disagree
with the steps. We as a Council can look at policy of the police department as a whole, but the
Council does not hire individual officers.
Tom Baldwin- 1716 Albert St.:
Since this happened he has been asking the Council to have the police department here to have
an open and honest discussion. Why didn’t the meeting that took place on Sunday, the 11th fall
within the parameters of the lawyer’s legal advice for the Chief to not attend the Council

meeting? The only difference he could see was that there wouldn’t be quorum. He was told that
it was a private meeting yet the public could attend. This was to keep media away.
Chuck Leszewski- 1713 St. Mary’s St.:
The Council said to wait until the investigation is over, but is now changing the rules. The
details that were told by Choi are worse than imagined. First aid was only applied by Roseville
after 3 minutes. Stops made were overwhelmingly skewed to people that are Black. The Chief
claimed that analysis is flawed but does not provide other statistics. You should announce that
you’re ending the contract tonight or the first meeting in January.
Rich Hinrichs- 1483 Larpenteur Ave:
He received a letter about the snow on Larpenteur sidewalks. He sent two emails, but has not
heard any further discussion. Nothing more has been addressed other than more letters. The
amount of snow that gets pushed up from the sidewalk is immense, and the County comes by
multiple times to push it onto the sidewalks. He does professional snow removal and the
amount on the sidewalk is overwhelming to him. He formally asks that the City Council
consider a change in responsibility as Larpenteur is a transit area for buses and needs to be
walkable for people in the community.

Item Review of Elected Official Out-of-State Travel Policy
Description
In 2005, the Minnesota State Legislature passed a requirement that cities adopt a
policy that regulates out-of-state travel by elected officials. The Falcon Heights City
Council adopted the attached policy on November 9, 2005. One provision of the
statute is that the policy be reviewed annually by the City council.

Item Appointment of Acting Mayor
Description
Periodically, the Mayor’s absence requires that official duties (such as signing official
documents, running City Council meetings, etc.) need to be conducted in a timely
manner. Past practice has been to rotate this position among the various City Council
Members. The 2016 Acting Mayor was Council Member Joe Brown Thunder.
The Mayor still retains the right to name other Council Members as Acting Mayor
when planned absences are anticipated, but the formal designation of an Acting
Mayor allows for continuity of operations in the case of an emergency or unplanned
absence.

Description
The business mileage reimbursement rate allowed by the IRS is 53.5 cents per mile
effective January 1, 2017. This is a .5 cent per mile decrease in the mileage rate
allowed by the IRS in 2016.

Item 2017 NYFS Cooperative Service Agreement
Description
For many years now, the City of Falcon Heights has been a partner with Northeast
Youth and Family Services (NYFS). Some of the services they provide include
senior chore services and diversion programs for youth in various law enforcement
cases. Each year the City allocates money in the general fund to help pay for these
services.
Attached is the 2017 Agreement that NYFS is asking all of their partner cities to
approve.
Budget Impact 2017 Contribution of $9,017 which is accounted for in the 2017 Budget. This is a one
(1%) percent increase from 2016’s contribution of $8,927.

Item Accepting Plans and Specifications and Ordering Advertisement for Bids for the
2017 Pavement Management Project
Description
On December 14, 2016, a public improvement hearing was held for the 2017 PMP.
Following the hearing, the City Council ordered the improvement and preparation
of plans and specifications of the proposed project. The next step in the process is for
the City Council to approve plans and specifications and authorize the
advertisement for bids.
State statute requires a City Council resolution approving plans and specifications
and ordering the advertisement for bids for all public improvements to be assessed.
Since a portion of the costs for the proposed project will be assessed to benefiting
properties, the adoption of this resolution is required.
The following is a brief summary of proposed improvements. The following streets
have been identified to be considered for improvements in 2015:

◦ Vincent St, from Hoyt Ave to Folwell Ave
◦ Northrup Ave, from Hoyt Ave to Folwell Ave
◦ Burton St, from Hoyt Ave to Folwell Ave
◦ Coffman St, From Hoyt Ave to Larpenteur Ave
Street Improvements:
The recommended improvements for the streets were based on existing conditions
of the pavement. All of the streets are proposed for bituminous reclamation.
Bituminous reclamation (or reclaim) involves grinding the existing asphalt surface
and underlying aggregate base together, which creates a new uniform roadway base
material. Some of the reclaimed material is then removed in order to meet the
existing curb and gutter grades. The new base will be graded and compacted in
preparation for 4-inches of new bituminous pavement.
All of the roadways will be repaved to match the existing roadway widths. Existing
curb and gutter will remain in place, with the exception of isolated areas that need
repairs to replace damaged or sunken curb.
All sidewalk curb ramps will be upgraded to meet latest American with Disabilities
Act (ADA) standards as part of the project.

Pathway Improvements:
The existing pathway on Roselawn Avenue between Cleveland and Fairview is
deteriorated and needs improvement. The recommended improvement is to reclaim
the existing pavement, regrade, and repave the pathway in its existing location.
Parking modifications:
NO parking changes are associated with this project.
Storm Drainage and Storm Water Quality Improvements:
In order to address street flooding that has occurred around 2137 Folwell, storm
sewer modifications will occur. Additional catch basins will be installed to provide
more inlet capacity and the pipe downstream will be upsized from 12 inch RCP to
24” RCP.
Other storm drainage system improvements are relatively minor and include
maintenance on selected storm sewer manholes and catch basins.
Sanitary Sewer System Improvements:
The sanitary sewer system improvements are relatively minor and include
maintenance on selected manholes. The majority of the sanitary sewer was lined
previously.
Water System Improvements:
The water system is owned and operated by St. Paul Regional Water Services. They
will be replacing any old cast iron watermain with new 8-inch ductile iron
watermain as part of the project. New hydrants will also be installed. All costs of the
watermain and any additional street or curb work associated with the watermain
work will be paid by SPRWS.
Budget Impact This project has the following financial implications for the city and property
owners along the streets being considered for maintenance:
• Assessments levied in accordance with the City’s assessment policy.
• Use of Municipal State Aid (MSA) and street infrastructure funds to pay the
City’s portion of the project.
• Expenditure of utility fund dollars to pay for repairs needed to the existing
utility system.

RESOLUTION APPROVING PLANS AND SPECIFICATIONS AND ORDERING ADVERTISEMENT FOR BIDS FOR THE 2017 PAVEMENT MANAGEMENT PROJECT WHEREAS, pursuant to resolution of the City Council adopted December 14, 2016, the City
of Roseville Engineering Department has prepared plans and specifications for the improvement of the following streets: ◦ Folwell Ave, from Fulham St to Hoyt Ave

The City Administrator shall prepare and cause to be inserted in the Roseville Review, the official newspaper, and on QuestCDN an advertisement for bids upon the making of such improvement under such approved plans and specifications. The advertisement shall be published as required by law, shall specify the work to be done, shall state the date and time that the bids will be received by the City Administrator and City Engineer at which time they will be publicly opened in Falcon Heights City Hall by the City Engineer, will then be tabulated, and will subsequently be considered

General Water main Plan Notes:
1.Water facilities shall be installed according to the latest version of SPRWS Standards for the Installation of Water Mains.
2. Only SPRWS staff are permitted to operate valves on the existing water system.
3.All water main and water service pipe less than 12” in diameter or less shall have a minimum cover of 8.0'.
4. Sidewalks, pavements, ducts and appurtenant structures shall not be undermined unless a support system or another method of protection is provided.
5. All water valve boxes within the construction area must be exposed & accessible to SPRWS throughout construction.
6. All class 52 and 53 ductile iron pipe shall be zinc coated and manufactured with no asphaltic seal coating applied to the inside cement mortar lining. The Contractor shall anticipate
extended lead times for manufacture and delivery of custom pipe orders.
7. Pipe stored onsite shall be capped or otherwise sealed on both ends. Pipe shall be kept off of the ground surface by use of blocking or other means.
8. All pipe shall be wrapped with V-BIO enhance polyethylene encasement and taped in accordance with AWWA C105.
9. Contractor shall notify SPRWS a minimum of two weeks in advance to request a shut-off of the water system to allow sufficient time to notify and coordinate shut-off with affected
customers. In general, shut-offs shall be limited to 8 hours unless otherwise authorized by the Engineer.
10. A four-sided trench box (plywood not acceptable) is required on all excavations deeper than 5 feet where inspection is to be performed by SPRWS. Back filling around trench box is
required to prevent shifting of the box & to egress in or out of the box with use of ladder. Ladders are required inside the trench box and must extend 3 feet above the surface of the
trench.
11. Contractor is required to use a trench box with 2 shored sides, minimum length of 24'. The inside width of trench box shall not exceed 6 ft. when installing water main 12” and
smaller, or 8 ft. inside width when installing water main larger than 12”. No extra compensation shall be paid for over excavating the trench beyond 1 ft. either side of the trench box,
including for additional backfill material.
12. Services may not be re-tapped on water main until the main has passed all testing including pressure, bacteria, and conductivity. Service re-taps may start immediately after each
section has passed all required testing.
13. Lead service replacements shall be from the water main to property line. No exceptions shall be made for the presence of existing utilities. No additional payment will be made to thecontractor for working around existing utilities.
14. When placing valves on the water system, whether located along new water main or cut into existing water main, the Contractor shall install sufficient restraining measures such that
once water pressure is applied behind the closed valve, the Contractor may safely work near it without risk of joints separating in the system and without the need for a second shutdown.
15. The Contractor shall be prepared to encounter oversized cast iron pipe within the existing water system. When connecting to existing oversized pipe, the Contractor shall use full
body C-110 ductile iron solid sleeves uniformly machined on the inside to fit the oversized pipe. Grinding of the existing pipe in the field to make the connection will not be allowed.
16. Contractor shall remove all foreign matter or dirt from the inside of the pipe before it is lowered into the trench and keep the pipe clean by approved means during and after laying. A
cap, plug or other water tight seal shall be placed on the end of the pipe at the end of each day to prevent water or other contaminants from entering it.
17. Contractor shall use restraining gaskets restraining slip joint pipe. See standard plate D-11 for min. lengths of restrained pipe required for tees, bends, and dead ends.
18. The SPRWS inspector will collect and submit samples for bacteriological testing. Bacterial testing must follow AWWA C651 5.1.2. Water samples will be collected at temporary test
ports or air vents as shown on the plan. Samples will be drawn at 200 ft. intervals. Temporary test ports shall be cut off at the main after use. This work shall be paid under item 2504.602
Water Utility Hole.
19. SPRWS requires the use of hydrants with a bury depth of 9.0'. Where the connecting main is shallower than 8', offsets will be constructed on the hydrant lead to achieve 9.0' of bury
depth.
20. Placement of imported backfill material shall be determined by the Engineer. Contractor will not be paid for backfill material placed without the expressed authorization of the
Engineer.
Temporary Water
1. Temporary water systems will be provided by SPRWS for existing water services supplied by mains planned for replacement within the project corridor.
2. Contractor shall excavate and prepare pipe for SPRWS to perform tie-in of temporary water for services 1.5” or larger. Tie-in excavations shall be paid under bid item 2504.602 Water
Utility Hole. Contractor must comply with SPRWS Trench Excavation Policy. A four-sided trench box (plywood not acceptable) is required on all excavations deeper than 5 feet when
work is performed by SPRWS personnel. Back filling around trench box is required to prevent shifting of the box & to egress in or out of the box with use of ladder. Ladders are required
inside the trench box and must extend 3 feet above the surface of the trench.
3. Excavated tie-ins will be coordinated with each customer to minimize impact to water service. Excavations may be scheduled on nights and weekends.
4. The Contractor must provide a detailed schedule at the start of the project so that temporary water can be planned accordingly. Contractor shall notify SPRWS of any changes to the

GENERAL SWPPP NOTES FOR CONSTRUCTION ACTIVITY
1. THE GENERAL CONTRACTOR IS RESPONSIBLE TO COMPLY WITH ALL ASPECTS OF THE NPDES
CONSTRUCTION STORMWATER PERMIT AT ALL TIMES UNTIL THE NOTICE OF TERMINATION (NOT)
HAS BEEN FILED WITH THE MPCA. THE CONTRACTOR WILL DEVELOP A CHAIN OF COMMAND
WITH ALL OPERATORS ON THE SITE TO ENSURE THAT THE SWPPP WILL BE IMPLEMENTED AND
STAY IN EFFECT UNTIL THE CONSTRUCTION PROJECT IS COMPLETE, THE ENTIRE
SITE HAS UNDERGONE FINAL STABILIZATION, AND A NOTICE OF TERMINATION <NOTI HAS BEEN
SUBMITTED TO THE MPCA.
2. THE CONTRACTOR WILL PREPARE A WRITTEN, NOT ORAL, WEEKLY SCHEDULE OF PROPOSED
EROSION CONTROL ACTIVITIES FOR THE PROJECT ENGINEERS APPROVAL AS PER MNDOT SPEC.

3. THE CONTRACTOR WILL PREPARE AND SUBMIT A SITE PLAN FOR THE ENGINEER'S APPROVAL
AS PER MNDOT SPEC. 1717.2E FOR CONCRETE MANAGEMENT, WORK IN ENVIRONMENTALLY
SENSITIVE AREAS, AREAS IDENTIFIED IN THE PLANS AS "SITE PLAN REQUIREMENT AREA", ANY
WORK THAT WILL REQUIRE DEWATERING, THE STAGING OF INLET PROTECTION DEVICES OVER
THE LIFE OF THE CONTRACT AND AS REQUESTED BY THE ENGINEER. ALL SITE PLANS MUST BE
SUBMITTED TO THE ENGINEER IN WRITING. THE CONTRACTOR SHALL ALLOW A MINIMUM OF 7
DAYS FOR MNDOT TO REVIEW AND APPROVE SITE PLAN SUBMITTALS. THE CONTRACTOR WILL
NOT BE ALLOWED TO COMMENCE WORK FOR WHICH A SITE PLAN IS REQUIRED UNTIL APPROVAL
HAS BEEN GRANTED BY THE ENGINEER. THE CONTRACTOR WILL NOT BE GIVEN ANY EXTRA TIME
IN THE CONTRACT DUE TO THE UNTIMELY SUBMITTAL OF A SITE PLAN.
4. THE CONTRACTOR WILL COMPLY WITH THE REQUIREMENTS REGARDING POLLUTION
PREVENTION MANAGEMENT DURING CONSTRUCTION, WHICH WILL INCLUDE, BUT NOT LIMITED
TO:
A. CONCRETE WASHOUT AREAS FOR USE BY ALL SUBCONTRACTORS AND MN/DOT PERSONNEL.
LOCATION OF WASHOUT AREAS MUST BE IDENTIFIED BY SIGNAGE AND MUST BE AT LEAST
200' FROM SITE PLAN REQUIREMENT AREAS OR ENVIRONMENTALLY SENSITIVE AREAS, AND
UTILIZE A LEAK-PROOF CONTAINMENT FACILITY OR IMPERMEABLE LINER THAT PREVENTS
RUNOFF ONTO ADJACENT SOILS. AN ENGINEERED COLLECTION SYSTEM CAN ALSO BE USED
IF IT IS APPROVED BY THE PROJECT ENGINEER.
B. SOLID WASTE COLLECTION AND REMOVAL.
C. SECONDARY CONTAINMENT.
D. SECURED HAZARDOUS WASTE STORAGE CONTAINERS.

5. CHEMICALS MUST BE KEPT IN A SECURE STORAGE AREA WHEN NOT IN USE. CHEMICAL
STORAGE CONTAINERS MUST HAVE SECONDARY CONTAINMENT WHEN BEING USED OR STORED
ON THE PROJECT SITE. CHEMICAL SPILLS OF ANY KIND (OIL, FUEL, FERTILIZER, ETC.) MUST BE
CLEANED UP AND REMOVED FROM THE SITE IMMEDIATELY. THE CONTRACTOR MUST HAVE A
SPILL KIT ON SITE AT ALL TIMES.
6. THE CONTRACTOR IS RESPONSIBLE FOR CREATING AND FOLLOWING A WRITTEN DISPOSAL
PLAN FOR ALL WASTE MATERIALS. THE PLAN WILL INCLUDE HOW THE MATERIAL WILL BE
DISPOSED OF AND THE LOCATION OF THE DISPOSAL SITE. SUBMIT TO THE ENGINEER.
7. BURNING OF ANY MATERIAL IS NOT ALLOWED WITHIN PROJECT BOUNDARY.
8. THE EROSION PREVENTION AND SEDIMENT CONTROL BMPS SHALL BE PLACED AS
NECESSARYTO MINIMIZE EROSION FROM DISTURBED SURFACES AND TO CAPTURE SEDIMENT
ONSITE. ALL EROSION CONTROL MEASURES SHALL BE IN PLACE PRIOR TO COMMENCEMENT OF
ANY REMOVAL WORK AND/OR GROUND DISTURBING ACTIVITIES COMMENCE AND SHALL BE
MAINTAINED UNTIL THE POTENTIAL FOR EROSION HAS BEEN ELIMINATED.
9. SEDIMENT CONTROL DEVICES MUST BE ESTABLISHED ON ALL DOWN GRADIENT PERIMETERS
BEFORE ANY UP GRADIENT LAND DISTURBING ACTIVITIES BEGIN. SEDIMENT CONTROL DEVICES
INCLUDE, BUT ARE NOT LIMITED TO:
A. PERIMETER CONTROL SHALL BE LOCATED ON THE CONTOUR TO CAPTURE OVERLAND,
LOW-VELOCITY SHEET FLOWS DOWN GRADIENT
B. OF ALL EXPOSED SOILS AND PRIOR TO DISCHARGING TO SURFACE WATERS WITH THE BMP
J-HOOKED AT A MAXIMUM OF 100 FOOT INTERVALS AND SHALL CONTAIN NO MORE THAN
1/4 ACRE OF DRAINAGE AREA. DITCH CHECKS WILL BE PLACED AS INDICATED ON THE
PLANS DURING ALL PHASES OF CONSTRUCTION.
1. TEMPORARY DITCH CHECKS WILL CONSIST OF USING ROCK DITCH CHECKS, BIOLOGS,
AND ROCK WEEPERS IN FRONT OF CULVERT INLETS. IN LIEU OF REMOVING TEMPORARY
DITCH CHECKS, THE ROCK MAY BE PUSHED INTO THE GROUND.
2. FILTER LOGS WILL BE PLACED DURING PERMANENT TURF ESTABLISHMENT AT THE
INTERVALS IDENTIFIED IN THE PLAN.
A. SEDIMENT DAMAGE FROM STOCKPILES WILL BE MINIMIZED BY PLACING A ROW OF SILT
FENCE A MINIMUM 5 FEET FROM THE TOE. IF THERE IS NOT ADEQUATE PROJECT AREA TO
PLACE THE SILT FENCE MORE THAN 5 FEET FROM THE TOE OF THE SLOPE, THE
CONTRACTOR MAY SUBMIT AN ALTERNATIVE FOR APPROVAL BY THE PROJECT ENGINEER.
10. STORM SEWER INLETS WILL BE PROTECTED AT ALL TIMES WITH THE APPROPRIATE INLET
PROTECTION FOR EACH SPECIFIC PHASE OF CONSTRUCTION. INLET PROTECTION DEVICES MAY
NEED TO BE PLACED MULTIPLE TIMES IN THE SAME LOCATION OVER THE LIFE OF THE CONTRACT.
INLET PROTECTION DEVICES WILL BE PAID FOR ONCE PER INLET REGARDLESS OF THE NUMBER
OF TIMES THE BMP IS PLACED. ALL STORM SEWER INLET PROTECTION DEVICES WILL BE KEPT IN
GOOD FUNCTIONAL CONDITION AT ALL TIMES. IF THE PROJECT ENGINEER DEEMS AN INLET
PROTECTION DEVICE TO BE NONFUNCTIONAL, IN POOR CONDITION, INEFFECTIVE, OR NOT
APPROPRIATE FOR THE CURRENT CONSTRUCTION ACTIVITIES IT WILL BE REPLACED WITH A
SUITABLE ALTERNATIVE AT NO COST TO MNDOT. FAILURE TO PERFORM WILL RESULT IN
DEDUCT.
11. THE CONTRACTOR WILL PLACE CONSTRUCTION EXITS, AS NECESSARY, TO PREVENT
TRACKING OF SEDIMENT ONTO PAVED SURFACES AND IN COMPLIANCE WITH PART IV OF THE
NPDES PERMIT. CONSTRUCTION EXITS WILL BE SUFFICIENTLY SIZED AND MAINTAINED TO
PREVENT TRACK OUT. TYPE 5 MULCH (SLASH MULCH) OR AN APPROVED ENGINEERED PRODUCT
WILL BE ALLOWED FOR CONSTRUCTION EXITS IN LIEU OF CRUSHED ROCK.
12. THE CONTRACTOR MUST USE METHODS AND OPERATIONAL PROCEDURES THAT PREVENT
DISCHARGE OR PLACEMENT OF BITUMINOUS GRINDINGS, CUTTINGS, MILLINGS, AND OTHER
BITUMINOUS WASTES FROM AREAS OF EXISTING OR FUTURE VEGETATED SOILS AND ALL WATER
CONVEYANCE SYSTEMS, INCLUDING INLETS.
13. THE CONTRACTOR MUST USE METHODS AND OPERATIONAL PROCEEDURES THAT PREVENT
CONCRETE DUST, PARTICLES, SAW CUT SLURRY, PLANING WASTE AND OTHER CONCRETE
WASTES FROM LEAVING THE RIGHT OF WAY, DEPOSITING IN EXISTING OR FUTURE VEGETATED
AREAS, OR ENTERING STORMWATER CONVEYANCE SYSTEMS,
INCLUDING INLETS AND CURB FLOW LINES.
14. DITCHES AND EXPOSED SOILS MUST BE KEPT IN AN EVEN ROUGH GRADED CONDITION IN
ORDER TO BE ABLE TO APPLY EROSION CONTROL MULCHES AND BLANKETS.
15. ALL EXPOSED SOIL AREAS MUST BE TEMPORARILY OR PERMANENTLY STABILIZED NO MORE
THAN 14 DAYS (7 DAYS IF WITHIN 1 MILE OF AND DRAINING TO A SPECIAL OR IMPAIRED WATER)
AFTER CONSTRUCTION ACTIVITY ON THAT PORTION OF THE SITE THAT HAS TEMPORARILY OR
PERMANENTLY CEASED. IN MANY INSTANCES, THIS WILL REQUIRE STABILIZATION TO OCCUR
MORE THAN ONCE DURING ROUGH GRADING. RAPID STABILIZATION METHODS 1, 2, 3 OR 4 WILL
BE USED TO PROVIDE TEMPORARY COVER, AS APPROPRIATE, IN THESE AREAS.
16. THE NORMAL WETTED PERIMETER OF ANY TEMPORARY OR PERMANENT DRAINAGE DITCH
THAT DRAINS WATER FROM THE CONSTRUCTION SITE OR DIVERTS WATER AROUND THE
CONSTRUCTION SITE MUST BE STABILIZED WITHIN 200 LINEAL FEET FROM THE PROPERTY EDGE
OR POINT OF DISCHARGE TO ANY SURFACE WATER. STABILIZATION MUST OCCUR WITHIN 24
HOURS OF CONNECTION TO A SURFACE WATER, EXISTING GUTTER, STORM SEWER INLET,
DRAINAGE DITCH, OR OTHER STORMWATER CONVEYANCE SYSTEM ACCORDING TO MN/DOT SPEC
1717.2A2. RAPID STABILIZATION METHOD 4 WILL BE USED TO STABILIZE THESE AREAS. THE
REMAINDER OF THE DITCH MUST BE STABILIZED WITHIN 14 DAYS (7 DAYS IF WITHIN 1 MILE OF
AND DRAINING TO A SPECIAL OR IMPAIRED WATER) OF CONNECTING TO THE SURFACE WATER.
PERMANENT EROSION CONTROL BLANKET OR RAPID STABILIZATION METHOD 4 WILL BE USED TO
STABILIZE THESE AREAS. DISC ANCHORED MULCH AND HYDRAULIC SOIL STABILIZERS ARE NOT
ALLOWED TO BE USED FOR PERMANENT DITCH STABILIZATION.
17. OUTLETS INTO SURFACE WATERS SHALL BE STABILIZED WITH ENERGY DISSIPATION WITHIN
24 HOURS OF BEING CONSTRUCTED
18. ALL EXPOSED SOIL AREAS WILL BE STABILIZED PRIOR TO THE ONSET OF WINTER. ANY WORK
STILL BEING PERFORMED WILL BE SNOW MULCHED, SEEDED, OR BLANKETED WITHIN THE TIME
FRAMES IN THE NPDES PERMIT.
19. TOPSOIL BERMS MUST BE STABILIZED IN ORDER TO BE CONSIDERED PERIMETER CONTROL
BMPS. USE RAPID STABILIZATION METHOD 2, 3, OR 4 AS DIRECTED BY THE ENGINEER. THE SEED MIX
USED IN THE RAPID STABILIZATION MAY BE SUBSTITUTED AS FOLLOWS:
A. SINGLE YEAR CONSTRUCTION BETWEEN MAY 1 - AUGUST 1, SEED WITH SEED MIXTURE 21-111
B. SINGLE YEAR CONSTRUCTION BETWEEN AUGUST 1 AND OCTOBER 31, SEED WITH SEED
MIXTURE 21-112
C. MULTI YEAR CONSTRUCTION 22-111
20. THE CONTRACTOR SHALL COMPLY WITH THE FOLLOWING INSPECTION AND MAINTENANCE
REQUIREMENTS:
A. SILT FENCE MUST BE REPAIRED, REPLACED, OR SUPPLEMENTED WHEN IT BECOMES
NON-FUNCTIONAL OR SEDIMENT REACHES 1/3 THE HEIGHT OF THE SILT FENCE. REPAIRS
MUST BE MADE WITHIN 24 HOURS OF DISCOVERY.
B. INLET PROTECTION DEVICES SHOULD BE REPAIRED WHEN THEY BECOME NON-FUNCTIONAL
OR SEDIMENT REACHES 1/3 THE HEIGHT AND/OR DEPTH OF THE DEVICE
C. TEMPORARY SEDIMENT BASINS MUST HAVE THE SEDIMENT REMOVED ONCE THE SEDIMENT
HAS REACHED 1/2 THE STORAGE VOLUME WITHIN 72 HOURS OF DISCOVERY
D. TRACKED SEDIMENT MUST BE REMOVED WITHIN 24 HOURS OF DISCOVERY OF TRACKING
ONTO PAVED SURFACES.
E. ALL OTHER NON-FUNCTIONAL BMPS MUST BE REPAIRED, REPLACED, DR SUPPLEMENTED
WITHIN 24 HOURS OF DISCOVERY
F. CONTRACTOR IS RESPONSIBLE FOR MAINTAINING ALL BMPS UNTIL WORK HAS BEEN
COMPLETED, SITE HAS GONE UNDER FINAL STABILIZATION, AND THE NOTICE OF
TERMINATION <NOTI HAS BEEN SUBMITTED TO THE MPCA IN ACCORDANCE WITH PART
II.B.5 OF THE CONSTRUCTION GENERAL PERMIT.
21. IF SEDIMENT DEPOSITS IN A WATER OF THE STATE, THE MATERIAL MUST BE REMOVED WITHIN
7 DAYS.
22. PAVEMENT SURFACES SHALL BE SWEPT WITHIN 24 HOURS OF DISCOVERY OF SEDIMENT DR
TRACKING ONTO PAVEMENT THAT DRAINS TO CURB, INLETS, DITCHES, OR PONDS. PAVEMENT
SHALL BE LIGHTLY WETTED PRIOR TO SWEEPING. THIS WORK IS INCIDENTAL.
23. TEMPORARY DEWATERING ACTIVITIES MAY BE REQUIRED FOR ROADWAY CONSTRUCTION
AND UTILITY WORK. THEREFORE IT IS POSSIBLE THAT A PERMIT FOR THE TEMPORARY
APPROPRIATION OF WATERS OF THE STATE, NON-IRRIGATION FROM MNDNR WILL BE REQUIRED
FOR THIS PROJECT. THE CONTRACTOR WILL BE RESPONSIBLE FOR OBTAINING THIS PERMIT. ALL
TEMPORARY DEWATERING SHALL BE DISCHARGED TO AN APPROVED LOCATION FOR
TREATMENT PRIOR TO DISCHARGE TO THE RECEIVING WATER. THE CONTRACTOR IS REQUIRED
TO SUBMIT SITE PLANS TO MNDOT ENGINEER FOR APPROVAL PRIOR TO COMMENCING WORK
ACCORDING TO MNDOT SPEC 1717.2E.
24. SITE DRAINING ACTIVITIES OF TURBID OR SEDIMENT LADEN WATER WILL BE DISCHARGED TO
TEMPORARY SEDIMENT BASINS WHENEVER POSSIBLE. IN THE EVENT THAT IT IS NOT POSSIBLE TO
DISCHARGE THE SEDIMENT LADEN WATER TO A TEMPORARY SEDIMENT BASIN, THE WATER
MUST BE TREATED 50 THAT IT DOES NOT CAUSE A NUISANCE CONDITION IN THE RECEIVING
WATERS DR TO DOWNSTREAM LANDOWNERS.
25. IT IS THE DESIGNER'S INTENT THAT THE CONTRACTOR BUILD PONDS AND INSTALL EROSION
CONTROL BMPS BEFORE PUTTING THEM INTO ACTIVE SERVICE TO THE MAXIMUM EXTENT
PRACTICABLE. ALL PONDS FOR THE PROJECT WILL BE SUBJECT TO THE SITE PLAN REQUIREMENT
AREA EROSION CONTROL SCHEDULE AS PER MNDOT SPEC 1717.
26. THE CONTRACTOR MAY NOT DRIVE ANY EQUIPMENT ON FINISHED POND BOTTOMS OR POND
CORNERS. IF DISTURBED, POND BOTTOM AND POND CORNERS MUST BE RESTORED TO
PRE-EXISTING CONDITIONS WITHIN 24 HOURS. ANY RUTS OR DAMAGED TURF THAT COULD
CREATE SEDIMENT DISCHARGE TO POND BOTTOMS MUST BE REPAIRED WITHIN 24 HOURS
27. ANY SUBSURFACE DRAINAGE TILES DAMAGED DURING CONSTRUCTION SHALL BE REPAIRED,
REPLACED OR REROUTED, AND CONNECTED TO THE EXISTING TILE OR DRAINAGE SYSTEM TO
ENSURE THAT EXISTING UPLAND DRAINAGE IS PERPETUATED. THIS SHOULD BE DONE TO THE
APPROVAL AND SATISFACTION OF THE ENGINEER.
28. FILTER LOGS SHALL BE PLACED, AS NEEDED, TO TRAP SEDIMENT ON THE LOWER EDGE OF
BEDS OR TREE HOLES. FILTER LOGS WILL BE LEFT TO PHOTO DEGRADE.
29. TILLING FOR BEDS OR TREE HOLES MUST BE PLANTED ANO MULCHED WITH WOODCHIP
WITHIN 7 DAYS OR STRAW MULCHED UNTIL PLANTING OPERATIONS CAN BE COMPLETED.
30. ANY POND CORNERS OPENED DUE TO TILLING FOR SHRUB BEDS OR TREE HOLES MUST BE
PLANTED AND MULCHED WITH WOODCHIP WITHIN 24 HOURS OR STRAW MULCHED UNTIL
PLANTING OPERATIONS CAN BE COMPLETED.
31. ALL PERMANENT STORMWATER BASINS USED AS TEMPORARY SEDIMENT BASINS OR
TEMPORARY SEDIMENT TRAPS WILL BE CLEANED OUT TO THE DESIGN CAPACITY AFTER ALL
