HomeMy WebLinkAboutCCMin_72May1131 MINUTES OF REGULAR COUNCIL MEETING FALCON HEIGHT S, MINNESOTA MAY 11, 1972 A regular meeting of the Falcon Heights Council was called to order by Mayor Warkentien at 7:35 P.M. PRESENT: Mayor Warkentien, Councilmen Ecklund, Stone and Taylor. Councilman Black arrived at 9:05 P.M. Also present were Clerk-Administrator Barnes and Attorney Seed. ABSENT : None Minutes: Motion by Councilman Ecklund, seconded by Councilman Stone, to appznve the minutes of the regular meeting of April 27, 1972, as amended. Motion carried. Ramsey County Mr. Douglas Fink, Director, Ramsey County League of Munici- Ditch and palities, requested that the Council select one m'~nber to Drainage Study: serve on a Committee to study changes in the Ramsey County ditch and drainage. No action was taken. Subdivision of Mr. James C. Stroud, Attorney for Mrs. Edna B. Stewart, Land - 1761 North 1761 North Fairview Avenue, was present at the meeting to Fairview Avenue: request approval for subdivision of land at 1761 North Fairview Avenue. Motion by Councilman Stone, seconded by Councilman Ecklund, that the matter of subdivision of land be submitted to the Falcon Heights Planning Commission for recommendation. Motion carried. Justice of the Justices of the Peace Ronald Riach and Steven Nelson were Peace Revised present at the meeting to discuss the new revised fins Fine Schedule: schedule for the Village and they related that this new schedule is now more in line with surrounding Villages. Motion by Councilman Stone, seconded by Councilman Taylor, to authorize the Clerk-Administrator to publish the stew revised fine schedule. Motion by Councilman Taylor, seconded by Councilman Stone, that the Mayor and Clerk-Administrator be authorized to enter into an agreement with the University of Minnesota Law students, to prosecute court cases fora 6 month period, for the Village of Falcon Heights, at a cost of $25 per evening and necessary expenses subject to approval of the Clerk Administrator. Motion carried. ~~~~/~~- 1 1 1 ~~ Marijuana Attorney Seed reported to the Council that a request was Ordinance made by Ramsay County Sheriffs Department for the Village Request: to adopt a marijuana ordinance. Attorney Seed recommended that the Village do not adopt such an ordinance at this time. Councilman Ecklund reported at the 1971 Control Substances Act stated that possession of 1~ ounces of mari- juana was a gross misdeamenor and could not be prosecuted in Falcon Heights Village Court. No action was taken. Residents Present Mr. and Mrs. George Nielsen, 1795 Fry Street, Mr. Leonard to Object to E. Vanek, 1665 Garden Avenue, Mr. Paul W. Miller, 165l~ Garden Park: Maple Kno11 Drive, wire present at the meeting to discuss the proposed Garden Park playground. Mr. Nielsen stated that the tennis ct~urts would be agreeable but a public playground should have a buffer between the playground and the residents properties which was the request of the remaining objecting residents. They were also concerned with the maintenance of the park. Satellites at Motion by Councilman Taylor, seconded by Councilman Ecklund, West Falcon Woods that the Village provide two Satellite facilities, one at and University West Falcon Woods playground and one at the University Grove Playgrounds: Grove playground, at a cost of $10 each for installation and $38 per month rental, for a two month period ending August 11, 1972. Motion carried. University of Motion by Councilman Ecklund, seconded by Mayor Warkentien, Minnesota Sewer to author3.ze the Clerk-Achninistrator to apply a credit on Service Charge the University of Minnesota Sanitary Sewer service charge Credit: for the year 1971, based on a sprinkler gallonage usage in the amount of $t~,576.50. Councilman Black abstained as he arrived after the discussion had started. Motion carried. Variance Application - J.1~82 West Idaho Avenue: Amendment to Subdivision Ordinance No . 69 to Provide Fee - Ordinance No. 119: Idaho-Snelling Upgrading and Drainage: 1972 Sanitary Sewer Maintenance Program Motion by Councilman Black, seconded by Councilman Stone, that the variance application submitted by Harold W. Green, 1182 West Idaho Avenue, be referred to the Falcon Heights Planning Commission for reconunendation. Motion carried. Motion by Councilman Black, seconded by Councilman Stone, to adopt Ordinance No. 119: AN ORDINANCE AMENDING ORDINANCE N0. 69 RELATING TO THE 'i'3C+Ai OF~BBIr A~+ID PLA~EING LANDS IN THE VILLAGE OF FALCON HEIGHTS AYES: Mayor Warkentien, Councilmen Black, Ecklund, Stone, Taylor, Motion carried. Motion by Mayor Warl~ntien, seconded by Councilman Black, to author3.ze the Clerk-Administrator to proceed with up- grading of the Idaho-Snelling Avenue ponding area in con- junction with the County of Ramsey and State of Minnesota, with expenditures to be charged to the Storm Sewer Fund. Motion carried. Mr. Leland Gottstein and Representatives of American Pipe Services appeared before the Council to discuss their quote on the proposed Sanitary Sewer Maintenance Cleaning Program J and the possible misunderstanding the Council might have in respect to the validity of their quote. Mr. Gottstein asked the question, what are you going to get for your money and what type of work should be performed. He stated that there are two ways to clean sewers. A jet machine will not clean sewers in respect to rooted areas. He also stated that a bucket machine must be used to clean roots and such from the sewer line. Mr. Gottstein reminded the Council that a color coded map was presented at the time of the original survey and they should review it to see the results of American Pipe Service performance, also locations of work areas to be televised are in the original survey. Mr. Gottstein informed the Council that cutters and full gauge instruments are needed on at least 63~ of the clean- ing and the balance could be done by jetting. Councilman Black moved, seconded by Councilman Stone, that the sewer cleaning program be tabled. AYES: Councilmen Black, Ecklund, Stone, Taylor. NAY: Mayor Warkentien. Motion carried. Counter Offer Motion by Mayor Warkentien, seconded by Councilman Black, to Purchase to offer $75,000 for purchase of Weber's Cottage Inn, 170$ Weberis Cottage North Snelling Avenue, for the purpose of establishing a Inn for Liquor Municipal "Off Sale" Liquor Store. AYES: Mayor Trdarkentien, Store Site: Councilmen Black and Stone. NAYS: Councilmen Ecklund and Taylor, Motion carried. Solicitors Permit Motion by Mayor Warkentien, seconded by Councilman Black, Granted: to grant permission to Ted Hooter of Jobs for Kids of Minnesota, Inc., I~012 South lt2nd Street, Minneapolis, Minnesota, to sell candles house to house on Saturday, May 13, 1972, the money to be usedfor camp for underprivileged children. AYES: Mayor Warkentien, Councilmen Black, Taylor. NAYS: Councilmen Ecklund, Stone. Motion carried. Payroll: Motion by Councilman Taylor, seconded by Mayor Warkentien, to approve the payroll for the period ending May 15, 1972, in the amount of $2,036.l~9. Motion carried. General Motion by Councilman Taylor, seconded by Councilman Black, Disbursements: to approve the general disbursements for the period ending May 11, 1972, in the amount of $23,6l~0.32.
