HomeMy WebLinkAboutCCMin_73Sep13n 1 1 MINUTES OF REGULAR COUNCIL MEETING FALCON HEIGHTS, MINNESOTA SEPTEMBER 13, 1973 A regular meeting of the Falcon Heights Village Council was called to order by Mayor Warkentien at 8:00 P.M. Mayor Warkentien, Councilman Stone, and Councilwoman PRESENT Stocker. Also present were Clerk-Administrator Barnes, Engineer Lemberg and Attorney Kenefick. Councilman Ecklund arrived at 8:55 P.M., due to being on afire call . Councilman Black. ABSENT Councilman Stone moved, seconded by Mayor Warkentien, MINUTES to approve the minutes of the meeting of August 23, 1973, as corrected. Motion carried. Councilwoman Stocker moved, seconded by Mayor Warkentien, CONDITIONAL USE that the request for a conditional use by the H & R H 8c R BLOCK Block Tax Company, 15~.l~ W. Larpenteur Avenue, allowing them to hold income tax instructional classes at the above address, be approved. Motion carried. Councilman Stone moved, seconded by Mayor Warkentien, that Mr. Charles J. Volin, 376 Bailey Road, Newport, be granted four new cigarette licenses, for machines that he operated on the fairgrounds during the State Fair. The locations of these machines were: Block 28, Block 36 A-1, Block !~2 9-1, and the Prime Steak House, Block 3~, Lot B, for the period beginning July 1, 1973 and ending June 30, 197I~. Motion carried. Mayor Warkentien moved, seconded by Councilwoman Stocker, that the request for blocking off the streets for the following neighborhood parties be app roved. The party on Albert Street between Ruggles and Roselawn on September 21, 1973, from 6 - 9 P.M., and the party on Arona Avenue between Crawford and Garden on September 30, 1973, from 1 - 5 P.M. Motion carried. CIGARETTE LICENSES -NEW- BARRICADING OF STREETS FOR NEIGHBORHOOD BLOCK PARTIES Councilman Stone moved, seconded by Councilwoman Stocker, VOLUNTEER FIREMAN that the application submitted by Michael Ho1l, 1300 APPLICATION APPROVED W. Skillman Avenue, for Volunteer Fireman, be approved, subject to a physical and six months probation. Motion carried. 68 Councilwoman Stocker stated that she has received several REQUEST FOR MICROPHONES complaints from citizens who stated that when they attend AND SPEAKERS council meetings they cannot hear the Council action. She requested that the purchase of microphones and loud- speakers be looked into. Clerk-Administrator Barnes stated that he has requested quotes from several companies, ,and that he will submit these quotes to the Council at the next meeting. Mr. H. Peter Albrecht and his associate Mr. Stephen PROPOSED AMENDMENT TO THE Simon, Village Prosecuting Attorneys, were present to ORDINANCE RE: UNAUTHORIZED discuss Mr. Albrecht's letter of July 2~, 1973, re- VEHICLE USE ferring to unauthorized vehicle use. The present Ordinance reads: "It is unlawful for the owner or any other person, employing or otherwise directing the driver of any vehicle to require or knowingly permit the oper- ation of such vehicle upon a highway in any manner contrary to law.'' Mr. Albrecht stated that he interprets this law as applying to an employer-employee situation, and proposed that this Ordinance be amended to read: "No person having possession or control of a motor vehicle shall knowingly authorize or allow the same to be driven or operated by any person prohibited from driving or operating such vehicle." Attorney Kenefick was thereby directed to draft this proposed Ordinance amendment and submit it to the Council at the meeting of September 27, 1973• Councilman Stone introduced the following Resolution and moved its adoption: RESOLUTION #73-23 A RESOLUTION APPROVING THE ENGINEER'S HOURLY RATE IN- CREASE FROM $15.00 TO $20.00, AS SUBMITTED BY OTTO G. BONESTR00, OF BONESTR00, ROSENE, ANDERLIKE & ASSOCIATES, INC. Councilwoman Stocker seconded the foregoing Resolution, and upon a vote being taken thereon, the following voted in favor thereof: Mayor Warkentien, Councilman Stone, and Councilwoman Stocker, and the following voted against the same: None. rSotion carried. s~ ENGINEER'S RATE INCREASE ~Tohn Labalestra of the Lido Cafe, was present to request ORDINANCE RELATING TO that the Village reconsider adopting an Ordinance re- BOTTLE CLUBS lating to bottle clubs. He stated that the Lido Cafe is losing money because they cannot rent their party rooms out for private parties where the guests bring their own liquors. The Council stated that this sort of an Ordinance had been discussed some time before, but was deferred. One item that would cause concern they felt was the controls they would have over the issuance of this type of license. Attorney Kenefick stated the Village of Falcon Heights would probably be able to issue a minimum of two licenses, and that this Ordinance could be related specifically to the restaurant business. Attorney Kenefick was directed to draft an Ordinance n ertaining to bottle clubs, relating specifically to the restaurant business, to be submitted to the Council at the meeting of September 27, 1973• Mr. Dale Henderson of Southern California, was present ORDII~TAPICE RELATING TO to request that the Village allow him to sell his LICENSING OF MOBILE VEHICLES paintings within the Village of Falcon Heights. He ITINERANT MERCHANTS AND stated that he had requested a license for his STREET CORNER PEDDLERS business, but because there was nothing in the zoning ~,~ ordinance to prohibit him from selling his painting, the Village had allowed him to sell them. Councilman Ecklund moved, seconded by Mayor Warkentien, Fire reports numbers 35 and 36 were noted. FIRE REPORTS Councilman Ecklund moved, seconded by Councilwoman Stocker, APPOIDITMENTS TO THE to approve the following appointments made by the Mayor RECREATION COMMITTEE to the Falcon Heights Recreation Advisory Committee: Mrs. Ruth Rauch, Mr. Charles K. Stahly, and Mrs. Cheryl Dickson. Motion carried. Mayor Warkentien read the minutes of the Recreation MIPIUTES OF RECREATION Committee meetings of August 1~, 1973 and September MEETINGS 11, 1973• i Councilman Ecklund moved, seconded by Councilwoman Stocker, STATE FIRE CHIEF'S that Assistant Chief's Bob Luey and Henry Dachtera, of CONVENTION the Fire Department attend the State Fire Chief's Con- vention on October 13, 11~ and 15, in Minneapolis, with per diem and registration fees in the amount of $200.00, paid by the Village of Falcon Heights. Motion carried. Clerk-Administrator Barnes was directed to set up a BUSINESS MEETING WITH meeting between Harvey Cohen, owner of the business HARVEY COHEN property at the corner of Larpenteur and Snelling, the Village Council and the tenants of the building. Clerk-Administrator Barnes was authorized to have the PAINT THE "NO PARKING" ZOP1E maintenance men paint the "No Parking" zone in front AND FIRE HYDRANTS of the liquor store, yellow. He was also authorized to look into the procuring of paint for painting the fire hydrants in the Village yellow. Councilman Stone moved, seconded by Councilwoman Stocker, GENERAL PAYROLL that the general payroll for the first half of September, 1973, in the amount of $3,338.23, be approved. Motion carried. 1 that Attorney Kenefick draft an ordinance to cover the licensing of mobile vehicles, itinerant merchants and street corner peddlers, to be submitted to the Council at the meeting of September 27, 1973. Motion carried. Councilman Ecklund moved, seconded by Mayor Warkentien, GENERAL DI SBURSEMENTS that the general disbursements for the first half of September, 1973, in the amount of $17,61~2.1~1, be approved. Motion carried. Councilman Stone moved, seconded by Mayor Warkentien, GENERAL SINKING FUPIDS that the general sinking funds for the first half of September, 1973, in the amount of $70,375.45, be approved. Motion carried. . Mayor Warkentien moved, seconded by Councilwoman Stocker, LIQUOR PAYROLL that the liquor payroll for the first half of September, 1973, in the amount of $1,434.81, be approved. Motion carried. Councilwoman Stocker moved, seconded by Mayor Warkentien, LIQUOR DISBURSENfENTS that the liquor disbursements for the first half of September, 1973, in the amount of $11,t~71~.23, be approved.
