Acting T~Zayor Stone, Councilmen Black and Ecklund, and PRESENT Councilwoman Stocker. Also present were Clerk Adminis- trator Barnes, Engineer Lemberg and Attorney S'cor. Mayor Warkentien arrived at 8:16 P.M. "lone. ARSE ~~T ~ 8~ Acting ATayor Stone opened the public hearing on the PUBLIC HEARIAIG rezoning request of Nick J. Pothen, for property at REZO~~TI"TG OF POTHEPI PROPERTY 1889 North Hamline Avenue at 8:01 P.M., and the notice 1889 PdORTH HAMLITTE of:?public hearing was read. The affidavit of publication and mailing certification were noted. Councilman Black stated that the Falcon Heights Planning Commission met on Wednesday, October 21~, 1973, and at that time held a public hearing of which all property owners within 300 feet of the said property were sent notice. A petition was presented to the Planning Commission with signatures of 2I~ of the property owners opposing the rezoning. Councilman Black reported that the Planning Commission voted unanimously to recom- mend to the Village Council that the application for rezoning of property at 1889 P?orth Hamline, be denied. Councilman Black then stated that he had received a letter WITHDRAWAL OF APPLICATIOPI from rdick .i. Pothen, withdrawing his application for FOR REZONING rezoning, on Thursday, October 25, 1973. Councilman Black moved, seconded by Councilman Ecklund, that the withdrawal of the application for rezoning be accented. I~"otion carried. Joseph O~Tdei11, an attorney representing P~Sr. Oscar Goedert, 1803 Simpson Avenue, presented a petition to the Village Council with 200 signatures, requesting that a special election be held, for the voters to decide if the Village of Falcon Heights should be authorized to issue on-sale liquor licenses. Plfr. Goedert is interested in operating a supper club type restaurant at 1552 W. Larpenteur Avenue. PZr. John McDono~zgh of Wisconsin National Insurance Co., and P?r. Lowell Anderson of the Falcon Heights Pharmacy, were present and stated that they feel this type of operation would be an asset to the business community. Mr. Larry Dittel, Deputy of the Ramsey County Sheriff ~s Department stated that he feels there would be a minimum of problems with a business of this type. •TOhn Labalestra of the Lido Cafe stated that he also feels this tyn e of business would be an asset to th e business community. The Lido Cafe has been interested PETITION FOR ON-SALE LIQUOR in obtaining a liquor license for some time, but the Board k 8 ~• of Directors has decided that it will not petition for a liquor license at this time and will wait to see if leg- islation is passed concerning wine and strong beer. Several questions were brought to the floor that the Council felt should be answered before any decision was' made regarding this issue. Upon a vote being taken thereon, the following voted in favor thereof: Mayor Warkentien, Councilmen Black and Stone, and Councilwoman Stocker, and the following voted against the same: Councilman Ecklund. Motion carried. Councilwoman Stocker moved, seconded by 24ayor Warkentien, SETTING OF SPECIAL MEETING that a special meeting be set for Thursday, November 1, DATE 1973, at 7:30 P.P•7., for discussion of the liquor issue. Motion carried. Councilman Stone moved, seconded by Councilman Black, that the minutes of the meeting of October 11, 1973, be approved as corrected. THE VILLAGE OF FALCOTd HEIGHTS" Councilman Ecklund moved, seconded by Councilman Black, that the above ordinance be adopted. Upon a vote being #~aken thereon, the following voted in favor thereof: P4ayor Warkentien, Councilmen Black, Ecklund, and Stone, and Councilwoman Stocker, and the following voted against the same: None. Whereupon the ordinance was adopted. The ordinance ri ebtaining to the licensing of peddlers, mobile vehicles and itinerant merchants was tabled. P4INOTES MASTER GAS INSTALLER'S LICENSE ORDINANCE RELATI?~dG TO USE OF HIGHWAYS ORDINANCE PERTAINING TO PEDDLERS Mayor Warkentien moved, seconded by Councilman Ecklund, APPLICATION FOR VOLUNTEER that the application for volunteer fireman, submitted FIREME^1 by Ralph Dowdell, 2110 E. Hennepin, be approved, sub- ject to a physical and six months probation. Motion carried. Councilwoman Stocker moved, seconded by 1~Sayor Warkentien, APPROVAL OF ELECTION NUDGES to approve the election .fudges for the December ltth election as submitted. Motion carried. Councilman Stone moved, seconded by Councilman Ecklund, DEI~TIAL OF CONTRIBUTIOr1 TO to deny the request for a contribution to the North NORTH SUBURBAN DAY ACTIVITY Suburban Day Activity Center for retarded children. CETdTEFt Motion carried. 1 1 Engineer Lemberg explained his report to the Council on 1`~Iunicipal State Aid Fund Usage which was presented to the Council at the last meeting. With funds now avail- able~ improvements could be made on Arona Avenue from California to Hoyt, Crawford Avenue from Snelling to Arona, and Garden Avenue from Snelling to Hamline. Councilwoman Stocker moved, seconded by Councilman Stone, that no assessments be made on any of the above nro~ects, should the Council decide to make improvements on the above streets. Engineer Lemberg stated that these proects should be completed in 1971, because of rising constructions and labor costs. The Council suggested that a hearing be set for the second meeting of January, 197., to notify the people involved on the forthcoming improvements. MUNICIPAL STATE AID FUPID REPORT Attorney Doug Skor stated that he had discussed with CHANGES IN POLLII'dG PLACE Attorney Kenefick the matter of changes in polling places and that he had stated that he would not recommend any change for the coming election. Mayor Warkentien moved, seconded by Councilman Stone, that a phone be installed in the Tlorthwest Greenhouse precinct number four, for the day of the election. PZotion carried. Councilwoman Stocker stated that she, Councilman Ecklund, and Clerk Administrator Barnes attended a Metro Council committee meeting on the Domed Stadium, and that the Stadium committee heard testimony on a proposed site of between four and five hundred acres on the St. Paul University Campus and Fairground property. She stated that there will be more hearings regarding the stadium and that the officials of the Village of Falcon Heights will be invited to attend. Fire reports numbers I~2 and i~3 were noted. Motion carried. 84 Councilman Black moved, seconded by Councilwoman Stocker, LIQTJOR DISBURSEMEPITS that the liquor disbursements for the second half of October, 1973, in the amount of $5,09~:?.72, be approved. Motion carried. Councilman Stone moved, seconded by Mayor Warkentien, to SIPdKING FtJRTDS approve the general sinking funds for the second half of October, 1973, in the amount of $5.50, be approved. Motion carried. Mayor Warkentien moved, seconded by Councilwoman Stocker, CANCELLATIOPdS that general disbursements check #7677 in the amount of $8.00 be cancelled.. Motion carried. Councilwoman Stocker moved, seconded by Councilman Black, that liquor disbursements check #1711 in the amount of $511.00 be cancelled. I~:otion carried.
