FALCON HEIGHT S, MINNESOTA
DECEMBER 27, 1973
A regular meeting of the Falcon Heights Village Council was called to order by
Mayor Warkentien at 7:30 P.M.

and Councilwoman Stoeker. Also n resent were Clerk Ad-
ministrator Barnes, Engineer Lemberg and Attorney
Kenefick.

Councilman Stone moved, seconded by Councilwoman Stocker, MINUTES
to app rove the minutes of the meeting of December 13,
1973, as corrected. Motion carried.
Mr. William T. Butler, President of Poor Richard's, Inc.,
l~00 Whitall Street, St. Paul, was present at the request
of the Council and by notice of the Village Attorney
to appear in the matter of the license suspension or
revocation of Poor Richard's, Inc.. This action was
deemed necessary after evidence of proof of criminal
conduct was brought forth on the part of Richard A.
Wybierala, former president of Poor Richard's,. Inc.
Mr. Butler stated that he recently purchased
eighty-seven per cent of the company, formerly held
by Richard A. Wybierala, doing business as Poor
Richard's, Inc., refuse hauler, outright. Mr.
Wybierala's father owns the remaining thirteen per
cent. Mr. Butler is also President of Metropolitan
Refuse and Disposal. He stated that he employs only
qualified and highly responsible employees and that
his businesses are respectably run. He also stated
that Richard A. Wybierala will not be associated
with the company at any time in the future.
In view of the fact that Richard A. Wybierala is no
longer associated with the business and of the inten-
tions of William T. Butler, President of Poor Richard's,
Inc., it was the Council's decision that no further
action was needed at this time. The license does
expire on June 30, 197t~, and if at that time cause is
shown that said license should be revoked, the matter
will again be brought to the Council for review.
Councilman Black introduced the following Resolution
and moved its adoption:

A RESOLUTION AUTHORIZING TEMPORARY TRANSFER OF AN
ADDITIONAL $500.00 TO THE MUNICIPAL LIQUOR IMPRESET
FUND
Mayor Warkentien seconded the foregoing Resolution
and upon a vote being taken thereon, the following
voted in favor thereof: Mayor Warkentien, Councilmen
Black, Ecklund, and Stone, and Councilwoman Stocker,
and the following voted against the same: None.
Motion carried.

Mayor Warkentien moved, seconded by Councilwoman Stocker, APPROVAL OF RINK ATTENDANTS
that the rink attendants for the 1973-197t~ season be
approved as submitted by the Clerk-Administrator. Motion
carried.
Two special meetings were set by the Council at which it ON-SALE LIQUOR ORDINANCE
will be working on an ordinance pertaining to the issuance
of on-sale liquor licenses to be held Wednesday, January
16, 197) at 7:30 P.M., and Monday, January 21, 1971, at
8:00 P.M.
Attorney Kenefick reported that in order to permit a
business holding an on-sale liquor license to operate on
Sundays, a special election would have to be held in
order to get voter approval of said operation. This
would not include holiday sales.
John Labalestra, Oscar Goedert and Clem Lehnen were
present for discussion of the liquor issue. All ex-
pressed concern that when drafting the ordinance the
Council might overlook the shall businessmen and
make the regulations impossible for them to meet,
such as fees, minimum investment, investigation fees,
space requirements and eligibility.
Mrs. Richard Brown, 1516 Crawford, was present to
discuss the traffic problem in the alley behind their
home at the above address. Flower City and the National
Surplus Store use this alley as a receiving entrance and
their trucks nark there while the employees unload
the merchandise. Customers also use the alley to pick
up merchandise. She stated that it is almost impossible
to get into their driveway at times without waiting for
other traffic to clear the alley.
Clerk-Administrator Barnes was directed to contact the
managers of the above stores and request that they
enforce a no-parking or ban stopping in that alley,
because as it is now, it would be difficult for
emergency vehicles to get into the alley in case of
an emergency.
Mrs. Brawn also stated that she feels there will be
a water run-off problem from the liquor store parking
lot when the snow melts. It was agreed to again
check the lot this spring to see if the problem can
be resolved. Mrs. Brown said that they have also
made plans of selling the property, after consultation
with an attorney. Clerk-Administrator Barnes was
directed to contact Mr. Doug Rees owner of the business
property on the northeast corner of Larpenteur and
Snelling to see if he is interested in purchasing
the property to utilize as parking space.
Discussion of the Municipal State Aid Fund Usage was
deferred .
Fire reports numbers 51, 52, 53, SIt, and 55 were noted.

Mayor Warkentien introduced the following Resolution and
moved its adoption:

A COMMENDATION FOR SERVICES TO CHARLES P. STONE, AS
COUNCILMAN FROM OCTOBER 2, 1961 TO DECEMBER 31, 1973
Councilwoman Stocker seconded the foregoing Resolution and
anon a vote being taken thereon, the following voted in
favor thereof: Mayor Warkentien, Councilmen Black and
Ecklund, and Councilwoman Stocker. Councilman Stone ab-
stained. Motion carried.
COMMENDATION FOR SERVICES
CHARLES P. STONE
Councilman Stone moved, seconded by Councilwoman Stocker, LIQUOR STORE EMPLOYEES
that the Falcon Heights Municipal Liquor Store employees WAGE INCREASES
receive the following wages for the year 1971.1:
George Willkom - $13,200.00 per year
John Sosniecki - $7,1.110.00 per year
Joseph Strzyzewski - $2.65 per hour
Curt Conzett - $2.65 per hour
Tom Kelly - $2.65 per hour
Motion unanimously carried.
Councilwoman Stocker moved,. seconded by Councilman Stone, GENERAL PAYROLL
to approve the general payroll for the second half of
December, 1973, in the amount of $2,916.OIt. Motion
carried.
Councilman Ecklund moved, seconded by Councilman Black, GENERAL DISBURSEMENTS
to approve the general disbursements for the second half
of December, 1973, in the amount of $16,128.02. Motion
carried.
Councilman Black moved, seconded by Councilwoman Stocker, LIQUOR PAYROLL
to arn~rove the liquor payroll for the second half of
December, 1973, in the amount of $l,lt1I1.9~. Motion
carried.
Councilman Stone moved, seconded by Councilwoman Stocker, LIQUOR DISBURSEMENTS
to approve the liquor disbursements for the second half
of December, 1973, in the amount of $9,3911.11. Motion
carried.
Councilwoman Stocker moved, seconded by Councilman Black, SINKING FUNDS
to approve the sinking funds for the second half of
December, 1973, in the amount of $852.13. Motion carried.
Mayor Warkentien moved, seconded by Councilwoman Stocker, CANCELLATION OF CHECK
to approve the cancellation of check #7599 in the amount
of $39.00 ~,ssued to Ronald J. Riach. Motion carried.
Councilwoman Stocker moved, seconded by Councilman Black, ADJOURNMENT
to adjourn the meeting at 950 P.M. Motion carried.
