MINUTES OF REGULAR COUNCIL MEETING
FALCON HEIGHTS, MINNESOTA
JANUARY 24, 1974

A regular meeting of the Falcon Heights City Council was called to order by Mayor
Warkentien at 7:35 P.M.
Mayor Warkentien, Councilmen F31ack and Ecklund, and PRESENT
Councilwoman Stocker. Also present were Clerk-Adminis-
trator Barnes, Engineer Lemberg and Attorney Keaefick.
Councilman Steele due to business. ABSENT
Councilman Ecklund moved, seconded by Councilman Black, APPOINR~III~ITS
to approve Mayor Warkentien's appointmenrt of Mrs. Geraldine PLANNING COMMISSION
Jenkins, 2252 Folwell Street to the Falcon Heights Planning
Commission for a term of three years, said term to expire
on December 31, 1976. Motion unanimously carried.
Mayor Warkeatien moved, seconded by Councilwoman Stocker, HUMAN RIGHTS COMMISSION
to approve the appointment of Mrs. Sue Wyckoff, 1834
Arona Avenue to the Falcon Heights Human Rights Commission
for a term of three years, said term to expire on
December 31, 1976. Motion unanimously carried.
Mr. and Mrs. Richard Brown, 1546 Crawford Avenue, were
present to discuss the water runoff from the Falcon Heights
Municipal Liquor Store paxking lot into their yard and
the basement of their home. They were seeking settlement
for items damaged by water due to the raised elevation
of the Liquor Sty re pa~3cing lot, in the amount of $65.00.
The Council reminded the Brown's of the Engineer's
survey conducted on August g, 1873, which is on file in
the Clerk's office. Mayor Warkentien again requested
that the gown's submit the damaged articles for the
inspection of the Gounail as requested at an earlier
date. Mrs. Brown stated that she no longer had them.
She was also unable to give the Council the date that
the damages occurred.
The Brown's stated that they had consulted with an
attorney and an appraiser, and have been told that the
valuation of their home had dimiehed because of the
problems they have had.
No action was taken on the matter.
Mr. James Loughrey, 1859 Simpson Avenue, was present at
the meeting to request that there be some communication
between the Council, Ramsey County Highway Department and.
the residents of the City concerning snowplowing. Fie
stated that he feels Falcon Heights does have good
service but that the City should have acme system such
as the one utilized by the City of St. Paul and the City
of Minneapolis, plowing north - south streets one day
and east - west streets the next day.

It was explained that because of the Bize of the City, it 1
is more feasible to get all of the plowing done in one
day, thus giving the residents better service and cleaner
streets, It was also explained that the Council has
looked for ways to notify the residents of the snowplowing
but that as of this time there has been no satisfactory
solution.
Councilman Black moved, seconded by Councilman Ecklund, CONDITIONAL USE PERMIT
that the request for a conditional use permit by Richard 1841 ASBURY
Elhardt of 1841 Asbury be taken frown the table. Motion
carried.
Present for the discussion were Mr. Elhardt and Mr.
Steven Nelson, the attorney representing Mr. and Mrs.
John Struble, 1851 Snelling Drive.
Both parties stated that as of this time, the ease has
not been settled,, and Mr. Nelson stated that his clients
have instructed him to pursue the matter into district
court if need be. He also suggested that the Council
wait for the dispostion of the case before making a
decision on the matter of the conditional use.
Councilwoman Stocker moved, seconded by Councilman Black,
that this matter be tabled until some decision has been
made by the parties involved pertaining to the res-
trictive deed clause, and until the Council is presented
with a signed agreement between the property owners or
a court order.. Motion carried.
Mayor Warkentien moved, seconded by Councilman Hlack, APPLICATION -
that the application for a volunteer fireman by Thomas VOLUNTEER FIREMAN
Bianchi, be tabled until there is an opening on the
Falcon Heights Fire Department upon recommendation of
the City Attorney. Motion carried.
The increases in the natural gas and electrical rates GAS & ELECTRIC RATES
by Northern States Power, were noted.
The designation of the animal. control .firm was deferred ANIMAL CONTROL FIRM
until the next meeting.
The report on the ~.oeal Government Study Coaanission was
noted and the Council requested copies for their own use.
Fire reports numbers 1, 2 and 3 were noted.
The Sheriff's report for December, 1973, was noted.
Councilman Ecklund moved, seconded by Mayor Warkentien,
to authorize Clerk-Administrator Barnes to construct a
platform for the council chambers, in reference to his
report on the estimated cost. Motion carried.

Councilwcm4an Stocker moved, seconded by Councilman Black, GENERAL PAYROLL
to approve the general payroll for the second half of
January, 1974, in the amount of $3,268.66. Motion carried.
Councilman Black moved, seconded by Councilwoman Stocker,
to approve the general disbursements for the second half
of January, 1971+, in the amount of $12,490.58. Motion
carried.

Councilman Ecklund moved, seconded by Councilman Hlack, to
approve the general sinking funds for the second half of
January, 1974, in the amount of $20,000.00. Motion carried.
Councilman Black moved, seconded by Councilwoman Stocker,
to approve the liquor payroll for the second half of
January, 1974, in the amount of $1,352.26. Motion carried.

Mayor Warkentien moved, seconded by Councilwoman Stocker, LIQUOR DISBURSEMENTS
to approve the liquor disbursements for the sew nd half of
January, 1974, in the amount of $1.2,058.74. Motion carried.
Councilman Ecklund moved, seconded by Councilwcrosan Stocker, ADJOURNMENT
to adjourn the meeting at 10:50 P.M. Motion carried.
