HomeMy WebLinkAboutCCMin_74Nov14 MINUTES OF REGULAR COUNCIL MEETING FALCON HEIGHTS, MINNESOTA NOVEMBER 14, 1974 A regular meeting of the Falcon Heights City Council was called to order by Mayor Warkentien at 7:30 p.m. Mayor Warkentien, Councilmen Black, Ecklund, Steele, and Labalestra. Also present were Clerk-Administrator Barnes, Engineer Lemberg, and Attorney Kenefick. None. Councilman Ecklund moved, seconded by Councilman Labalestra, to approve the minutes of the meeting of October 24, 1974 as corrected. Motion carried. Councilman Black moved, seconded by Councilman Labalestra, to approve General Corporate License No. 298 for the University of Minnesota Forstery Club Christmas Tree Lot. Motion carried. Councilman Black moved, seconded by Councilman Steele, to approve the variance request of Robert A. Videen for the redwood fence, as received from the Planning Commission. Motion carried. Councilman Labalestra asked that his variance request for an addition and remodeling of his home be deferred at this time. 1 The proposed subdivision of the Thatcher property was discussed, and the letter of October 30, 1974 from Engineer Lemberg, which had two recommendations, was read. Size of lots and storm drainage were a concern of the Council, and Clerk-Administrator Barnes was directed to inform iiichel's Construction, who represents Mr. Thatcher, of the recommen- dation and the requirements for subdividing, Attorney T. J. Salmen, representing Mr. and Mrs. Nestor Riviere, appeared before the Council to discuss several issues that the Rivieres' are concerned about in respect to nuisance, liability, and property damage when children play on the City owned property east and adjacent to their property at 1958 Summer. It was noted that there was a sign ;laced on the property that permits recreational activities to be conducted during daylight hours. Attorney Salmen suggested that there be a "no trespassing" sign placed on the property and that qualified officials of the city patrol and enforce it. Attorney Salmen also suggested that the adjacent property owners be permitted to maintain and landscape the property in such a manner which would minimize the use of the property for recreational purposes. Councilman Black read the letter from Attorney Stanley J. LUTHER L. JOHNSON Mosio, representing Luther L. Johnson, requesting the Council REQUEST FOR SUB- to subdivide a certain tract of land described as follows: DIVISION OF UNPLATTED Except the East 25 feet, the North 150 feet of the South LANDS 825 feet of the East 1/3 of the NW 1/4 of East 60 acres of the SG1 1/4 of Section 16-29-23. Clerk-Administrator Barnes was directed to advise Attorney rlosio of the requirements of Ordinance No. 69. Councilman Black motioned, seconded by Councilman Ecklund, to PLANNED UNIT set up a public hearing by the Planning Commission on December DEVELOPMENT DISTRICTS 3, 1974 at 7:30 p.m., and a public hearing before the Council PUBLIC HEARINGS on December 12, 1974 at 8:00 p.m. to consider amending Ordinance No. 64 to include a section relating to Planned Development Districts. 2~otion carried. Councilman Steele moved, seconded by Councilman Labalestra, POLICE CONTRACT to authorize Clerk-Administrator Barnes to execute the Police FOR 1975 Contract for 1975. Motion carried. Mayor Glarkentien motioned, seconded by Councilman Labalestra, GEORGE M. HANSEN CO. to authorize the George M. Hansen Company to conduct the 1974 AS AUDITING FIRr~4 audit of the General, Sanitary Sewer, and Sinking Funds. Z~otion carried. Councilman Black introduced the following ordinance and moved SUNDAY LIQUOR its adoption: ORDINANCE N0. 137 ORDINANCE N0. 137 n AN ORDINANCE REGULATING AND LICENSING THE SALE AND CONSUMPTION OF INTOXICATING LIQUORS IN CERTAIN ESTABLISHP~IENTS ON SUNDAYS. Mayor Warkentien seconded the foregoing ordinance, and upon a vote being taken, the following voted in favor; Mayor t~arkentien, Councilmen Black, Ecklund, and Steele. The following abstained: Councilman Labalestra. Motion carried. The City of St. Paul's request for the City of Falcon Heights to particip~xte in NSP's "Electric and Gas Rate Study Service'' was discussed. The date and the location of a meeting to be held at the St. Paul Hotel on November 13, 1974 at 10:00 a.m. was noted, however; it was decided that there was not enough information available at this time on the subject as far as cost to the City of Falcon heights for such a study, and Clerk- Administrator Barnes was directed to make an inquiry of the League of Minnesota Municipalities to estimate cost. NSP GAS AND ELECTRIC RATE STUDY SERVICE RESOLUTION RECOMMENDING APPOINTMENT OF MRS. JAMES J . JENKINS TO METROPOLITAN COUNCIL 9/ Aiotioned by Councilman Black, seconded by Mayor Warkentien, to adopt F.esolution No. 74-25 recommending to Governor A~iderson the appointment of Mrs. James J. (Geraldine) Jenkins to the newly created post in District No. 2 on the Metropolitan Council. Upon a vote being taken, the following voted in favor: Mayor Warkentien, Councilmen Black, Ecklund, Steele, and Labalestra. Motion carried. A discussion was held in respect to the proposed G,Forld AGROmart WORLD AGROMART Development, and it was noted that Mr. Jack Hanley would l;e DEVELOPMENT present at the December 12, 1974 meeting to discuss with the PROPOSAL Council any further development in respect to the proposal. Councilman Labalestra moved, seconded by Mayor Warkentien, to FALCON LE~NES approve the application of Clement A. Lehnen for a Bottle Club BOTTLE CLUB License at the Falcon Heights Bowling Lanes, 1550 West Lar- LICENSE penteur Avenue. Upon a vote being taken, the following voted in favor: Mayor Warkentien, Councilmen Blac?c, Steele, and Labalestra. The following voted against: Councilman Ecklund. Diotion carried. Councilman Ecklund moved, seconded by Mayor Warkentien, to RAMSEY COUNTY LEAGUE approve the Ramsey County League request for the use of the REQUEST FOR USE OF Council Chambers for their meeting of November 20, 1974 at COUNCIL CHAMBERS 8:00 p.m. Metro Transit is one of the topics to be discussed rdOVEr1BER 20, 1974 at their meeting. riot ion carried. The Sound System proposal of Electronic Design was read by Clerk-Administrator Barnes and discussed by the Council. It was noted that the price would be $1,870.00 for a regular system, and $2,028.00 for an alternative system. Councilman Steele suggested lookint for a ;portable system which would include a tape recorder, six mikes, and one speaker. Also, Councilman Steele suggested allocating $2,000.00 for the system. Clerk-Administrator Barnes suggested that the pro- posed system be tried out for meetings December 3, December 10, and. December 12. Nir. Anderson discussed the technical and price ranges of the system. The Council directed Clerlc-Administrator Barnes to come up with some other recommendations. Fire Reports 56, 57, 58, 59, and 60 were noted. Councilman Black moved, seconded by Councilman Steele, to approve bhe general payroll for the first half of November in the amount of $2,665.00 Motion carried. Councilman Labalestra moved, seconded by Councilman Black, to approve the liquor payroll for the first half of November in the amount of $1,604.71 Motion carried. Councilman Ecklund moved, seconded by Diayor Warkentien, to approve the general disbursements for the first half of November in the amount of X5,271.83 P4otion carried. Councilman Labalestra moved, seconded by Councilman Ecklund, to approve the liquor disbursements for the first half of November in the amount of $12,438.72 Motion carried. Councilman Ecklund moved, seconded by Councilman Blaclc, to Y47CA TENNIS LESSONS authorize Elaine Jones of the YWCA to give tennis lessons ELAINE JONES at the new tennis courts on ti~7ednesdays during the months of April and May from 1:00 to 3;00 p.m. if the tennis courts are completed and if there is no cost to the City. Upon a vote being taken, the following voted in favor: Mayor Warlcentien, Councilmen Black and Ecklund. The following voted against: Councilmen Steele and Labalestra. Motion carried.
