2685 MEETING OF MARCH 28, 1968 The meeting was called to order at 7:00 P.M. with the following members present= Mayor Warkentien, Clerk Strandquist, Councilmen Black, Ecklund and Stone._ Also .present were Treasurer Olsen, Attorney Galvin, and Engineer Lemberg. Cynthia Boyd and Thomas Reiff were present to observe. Minutes: Black moved, seconded by Stone that the minutes of the meeting of March 1l~, 1968 be approved as ' corrected. Ayess All. Nays: None. Motion was carried. ltlaintenance Department Kenneth Quarn, maintenance department and weed Reports inspector, was .present Gnd reported on 'Need Inspectors+ meeting held by Ramsey County on March 21, 1968. He stated that village can now demand that all weeds be cut - not merely sprayed. The City of Austin has an ordinance that the city cuts any grass that is over six inches high and charges the owner for services. It was stated at said meeting that owners of property can only be requested by villages or municipalities to keep dandelions under control; municipalities can take no further action. Quarn stated that Dutch Elm disease was also discussed. I'ry Street Traffic A delegation of residents from Fry Street was present Problem - Turning to discuss the problem of cars turning around in Grounds driveways. Mr. and Mrs. Geo. Arley Waldo 1736 ~+ Suggestion was made by Mr. and Mrs. Kulkay that parking be banned on both sides of Fry Street up to Maple Knoll Drive. Residents are of opinion that apartment dwellers can find plenty of parking in the parking lot during the day. They are of opinion that Fry Street home-owners have ample off-street parking for themselves and guests without using the street. In answer to suggestion that a turn-around be placed on Spiegler Apartment property, engineer Lemberg advised that is not a recommended practice. _ Mayor Warkentien stated that residents of Maple Knoll and Garden Avenue objected strenuously when proposal was made some years ago to making Fry Street and St. Mary+s Street one way streets. Suggestion was made that play area behind apartments could be used as extension of present parking lot. 2686 Mrs. Kulkay volunteered to take survey of all residents living on Fry Street with regard to banning parking on the entire street. She will submit results of survey and signatures at next meeting of council. Financial Statement - Year Certified Public Accountant Carl L Pearson was present Ended December 31, 1967: and copies of Financial Statement and Audit for the year ended December 31, 1967 had been previously distributed.to council members. After review, Strandquist moved, seconded by Black that the Village Clerk be authorized to submit the Financial Statement to the Suburban Sun Newspapers for.. official publication. Ayes; All., Nays: None. Motion was carried. Management Letter: Carl Pearson~s Management letter of March 18, 1968 listed cash adjustments that should be made. Stone moved, seconded by Black that the Village Clerk be instructed to make cash adjustments to Accounts #1~, ~5, #6, and #1 as outlined in above letter. Ayes: Warkentien, Strandquist, Black, Ecklund and Stone. Nays: None.. Motion was carried. Expand General Ledger Pearson reviewed present accounting system with council- to Cover A11 Accounts: men, and as recommended in management letter, con- „ sideration was given to expanding general ledger to - cover all accounts. This will increase amount of formal recording and work as a cross check to aid in mechanical proof of work performed and will also conform more closely to generally accepted practices for Municipal Accounting on a cash basis. Black moved, seconded by Ecklund that Clerk and Treasurer be authorized to implement said recommendation as soon as conveniently possible. Ayess All. Nays: None. Motion was carried. Dog Controls Donald Bona of B & E Patrol was present to discuss animal control.. He stated that when dogs are impounded, owners are instructed to obtain registration from the village office before dog is released and he would like council approval to keep about five registration forms and tags on hand at his office as a convenience to dog owners who claim dogs after village office hours. After inquiry, Bona advised that his firm was equipped to_ handle more hours of patrolling Falcon Heights. He also stated that survey will be made either by phone or house B & E Patrol to house, to determine kinds and numbers of animals kept authorized to patrol within Falcon Heights. All dog owners will be advised Falcon Heights an that dog registrations must be obtained. additional eight hours a month: Strandquist moved, seconded by'Ecklund that B & E Patrol n 1 be authorized to add another eight hours a month to patrolling village streets for the months of April, May, and June. The first eight hours of patrolling, as per contract, will be at ~l~.00 and the additional eight hours at X5.00 an hour. It is understood that above-mentioned survey will be conducted during this period. Mr. Bona is to appear Survey to be to make report to the council on the 28th of June at gonducteds which time council will discuss continuance ef-- 2687 of the increased patrolling. Ayess All. Proposed Apartment Ken Nordby of Northwest Design Inc, 1061 Rice Street, Building - 1800 and James Boyd, owner of .property at 1800 West harpenteur, West Larpenteurs presented conditional use and variance applications for a thirty-six unit apartment which is in a 5-~1A District. Af ter review, Black moved, seconded by Strandquist that the following resolution be adopted. WHEREAS, James H. Boyd, Jr. has made application to the Village of Falcon Heights for (1) a conditional use permit to construct a 36 unit apartment building at 1800 West Larpenteur Avenue, which property at the present time is zoned B-~.A, and pursuant to Ordinance No. 6t~ as as amended by Ordinance No. 71, a conditional use permit is required for the construction of an apartment building in a Bl A district, and (2) a variance permit for a side lot setback of ten (10) feet instead of the required twenty (20) feet, and (3) a variance with respect to roof elevation,.and WHEREAS, the Village of Falcon Heights has referred said requests for conditional .use permit and variance permits to the Planning Commission of the Village of Falcon Heights, and said Planning Commission has approved said conditional use permit and variance requests by a report dated March 28, 1968, a copy of which is on file in the Clerkts office and incorporated herein by reference,, and _ WHF,REAS, the Village Council of the Village of Falcon Heights has reviewed the request for variance permits and conditional use permits, has reviewed the report of the Planning Commission, and has conferred and consulted with said applicant personally NOV1, THEREFORE, BE IT RESOLVED by the Falcon Heights Village Council that 1. The Village of Falcon Heights finds that there are practical difficulties and particular hardships in the carrying out to the strict letter of the regulations of this ordinance, and that the granting of the variances requested does not apply generally to other land or structures in the district in which said land is located, and that the granting of said application is necessary for the preservation and enjoyment of a substantial property right of the applicant, and that the granting of the proposed variance tivill not impair an adequate supply of light and air to adjacent property, unreasonably increase the congestion in the public streets, increase the danger of fire, endanger the public safety, unreasonably diminish or impair established property values in the surrounding area, or in any other way impair health, safety, comforts, morals ' or in any other respect be contrary to the intent of Ordinance No. 6!~ or the comprehensive plan of said village. 2688 2. The conditional use permit is granted because of special or unique characteristics of said property, and the council hereby determines that the granting of the conditional use permit will not be detrimental to the health, safety or general welfare of the community, nor cause serious traffic congestion nor hazards, nor will seriously depreciate surrounding property values, _ and that the granting of said conditional use permit is in harmony with the general purpose and intent of the ordinance and comprehensive plan of the village. 3. That the Village Clerk and Village Zoning Administrator are hereby empowered and authorized to issue said variance permits and conditional use permit. Upon a vote being taken the following voted in favor of sames Warkentien, Strandquist, Black, Ecklund and Stone and the following voted against same: None. Whereupon said resolution was declared. passed and adopted this 28th day of March, 1968. Variance Application R• J. Stock of White Drug Company, Jamestown, North Establishment Dakota and Mr. George Keller, owner of property at 1l~07 107 West Larpen- West Larpenteur Avenue. presented conditional use appli- teur Avenue - cation to the council. Conditional Use Applications Black introduced the following resolution and moved. its adoption: WHEREAS, Mr. Keller, the owner of the gas station property at 107 West Larpenteur Avenue currently leased to the She11 Oil Company, Falcon Heights, Minnesota, has made an application to the Village of Falcon Heights for a conditional use permit to use said property presently zoned B2 for a dry-cleaning establishment pursuant to Ordinance No. 6~., Sec. 11.2 (subd. 12), and WHEREAS, the~Village Council of the Village of Falcon Heights has referred said request for conditional use 2689 permit to the Planning Commission of the Village of Falcon Heights, and said Planning Commission has approved said conditional use request by a report dated March 28, 1968, a copy of which report is on file in the office of the Village Clerk and made a part hereof by references NOVP, THEREFORE, BE IT RESOLVED by the Village Council of .the Village of Falcon Heights, 1. There are special or unique characteristics involved herein, and the ,granting of said conditional use permit will not be detrimental to the healthy safety, or general welfare of the community, nor will cause serious traffic congestion nor hazards, nor will seriously depreciate surrounding property values, and that the granting of said conditional use permit is in harmony with the general purpose and intent of the ordinance and the comprehensive plan of said village. 2. Said conditional use permit is subject to the provisions of Fire Prevention Ordinance No. 61 of the Village of Falcon Heights, and observance of all pro- visions of said ordinance is imposed as a condition upon the granting of said conditional use permit. 3. Upon compliance witi~ the foregoing, the Village Clerk and Zoning Administrator are empowered to grant such conditional use permit. The motion for adoption of the foregoing resolution was duly seconded by Strandquist and-upon a vote being taken, the following voted in favor of same: Warkentien, Strandquist, Black, Ecklund and Stone and the following voted against. same: None. Whereupon said resolution was declared passed and adopted this 28th day of March, 1968. Lemberg's letter was for purpose of inquiring. as to Univezs.ty's means of providing public utilities and whether or not village will be asked to provide these services. Stone introduced.. the following resolution and moved its adoptions WHEREAS, the attorney for the Village of Falcon Heights has been consulted in the preparation of proposed Ordinance No. 83, and WHEREAS, the Village Council has held discussions to consider the adoption of proposed Ordinance No. 83, NOW, THEREFORE, 13E TT RESOLVED by the Village Council of Falcon Heights that Ordinance No. 83 entitled "An Ordinance to Prevent, Reduce or Eliminate Blight,_Blighting Factors or Cause of Blight within the Village of Falcon Heights, Minnesotas To Provide for the Enforcement Hereof: and to Provide Penalties for the violation Thereof' be adopted. _ Motion for passage of Ordinance 83-was duly seconded. by Ecklund. Upon a vote being taken thereon, the following voted in favor of sames i~arkentien, Strandquist, Black, Stone and Ecklund and the following voted against same: .IV'one. Whereupon said Ordinance was declared adopted and shall be in full force and effect 30 days from date of publication. Master Gas Installers It is attorney Calvin's opinion that inasmuch as the Master Sewer Installers. state does not regulate Master Gas Installers or Licenses Required= Sewer Installers, the Village of Falcon Heights can continue.to require licensing of same and they are of ^sufficient import for the village to regulate. 2691 County of Ramsey Strandquist introduced the following resolution and DatEt Processing moved. its adoption: Department: . Street Sweeping -1968: Stone moved, seconded by Strandquist that the village engineer be authorized to negotiate for tY~e best possible price and job of sweeping the village streets. Ayes: All.
